I, FLOR M. REYES, of legal age, single, and living at JC 455


Central Pico, La Trinidad, Benguet, after having been duly sworn,
hereby attests that:

PREFATORY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which


prescribes the use of judicial affidavits to serve as the direct
examination testimony of the witness, on the basis of which the
adverse party may conduct their cross-examination on such a witness,
I hereby execute this judicial affidavit in a question and answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-8-
SC, I also state that the person examining me is Atty. STEPHANIE
MAE B. DOMINGO with office address at No. 07 Central Pico, La
Trinidad, Benguet. The examination is being held at the same address.
I am answering her questions fully conscious that I do so under oath
and may face criminal liability for false testimony and perjury.

PURPOSE

This affidavit/testimony is being offered to prove that:

1. That she is a relative and neighbor of Petitioner Juan D. Cruz;

2. That she and Petitioner have the working together in the field
of trading vegetables; and
3. That the Petitioner had been occupying the land for almost 40
years already in the concept of an owner whose possession
is adverse to other people.

Question 1: What language would you want to use for this


examination?
Answer 1: English, Ma’am.

Q2: Are you aware that you are under oath and may be criminally
charged for false testimony or perjury if you lie?
A2: Yes, Ma’am.

Q3: Please state your name and other personal circumstances for
the record.
A3: I am Flor M. Reyes, a Filipino citizen, married, 71 years old, and
residing at JC 455 Central Pico, La Trinidad, Benguet

Q4: Why are you here in our office today?


A4: I want to give my testimony regarding the Petition for Land
Registration that Mr. Juan D. Cruz filed in court.

Q5: Where do you work at Ma’am?


A5: I trade vegetables Ma’am and I am also a member of the
Sangguniang Barangay.

Q6: How did you know the Petitioner in this case?


A6: I came to know Petitioner Juan D. Cruz because he is a relative on
my Mother’s side. I also came to know of him more when he started
occupying the land beside ours. He had been my neighbor since 1979.

Q7: Do you know the history of the land as to who was the prior
possessor before the Petitioner occupied it?
A7: Yes, the land was not occupied before the Petitioner came into
possession. Before the Petitioner occupied it, the land was filled with
grass and no person ever claimed ownership over the land.

Q8: Did the Petitioner asked his neighbors or any members of the
Barangay before he started occupying the land?
A8: Yes, the Petitioner asked me whether the land was owned by any
person or by the government before he occupied the land.

Q9: What did you answer the Petitioner?


A9: I said that since birth, I have never known anyone who occupied
and claimed possession of the land.

Q10: Aside from your answer in the previous question, did you
give other advice to the Petitioner?
A10: Yes Ma’am, I advised Petitioner that he should coordinate with
the different government agencies in order for him to make sure that
the land was not owned by any person and that the land was alienable
and disposable.

Q11: As to your occupation as a trader of vegetables, can you


please describe the nature of your functions?
A11: We usually go to the farmers directly to buy their products. After
that we would go to the trading post and sell our products to the buyers.
We usually start in the early morning and after we sell the vegetables
we would again visit and negotiate with the farmers.

Q12: Do you know the occupation of the Petitioner?


A12: Yes Ma’am. The Petitioner is also a trader of vegetables.

Q13: How did you know that the Petitioner is also trader of
vegetables?
A13: I know that the Petitioner is also a trader of vegetables because
we work together in trading vegetables. Whenever I feel ill, he would
help me sell the vegetables I bought from the farmers.

Q14: Do you know whether Petitioner had any other occupation


aside from trading vegetables?
A14: I only knew that the Petitioner is a trader of vegetables.

Q15: Do you have any proof that you are a trader of vegetables?
A15: Yes Ma’am. I have a Business Permit from the Municipal office
stating that I am a trader of vegetable.

Q16: Mrs. Reyes, I am showing to you a copy of a Business


Permit. Can you please examine the document and confirm if this
the same Business Permit that you are referring?
A16: Yes Ma’am

Q17: Mrs. Reyes, I will be marking this document as Annex “A”.


Do you have any objections?
A17: I do not have any objections Ma’am.

Q18: Have you ever been received a letter from any government
office or agency requiring you to vacate the land?
A18: None Ma’am, I have never received a letter from any government
office or agency requiring us to vacate our land.

Q19: Do you have title over your land?
A19: Yes Ma’am, I have a title over our land.

Q20: Mrs. Reyes, I am showing to you a copy of a Tranfer


Certificate Title (TCT). Can you please examine the document and
confirm if this the same TCT that you are referring?
A20: Yes Ma’am, that is the TCT covering my land.

Q21: Mrs. Reyes, I will be marking this document as Annex “B”.


Do you have any objections?
A21: I do not have any objections Ma’am.

Q22: I have no more questions to ask, do you wish to add or


change any of your answers?
A22: None ma’am, and no more.

Q23: Are you willing to execute this document under oath?


A23: Yes ma’am.
