The prohibition of same-sex marriage restricts individual liberty and autonomy. 1987 Konstitusyon ng Republika ng Pilipinas Artikulo 3 Bill of Rights Seksyon 1: No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. - Artikulo 2 Declaration of State Policies and Principles Seksyon 11: The State values the dignity of every human person and guarantees full respect for human rights. 1987 Konstitusyon ng Republika ng Pilipinas Artikulo 3 Bill of Rights Seksyon 5: No law shall be made respecting an establishment of religion, or prohibiting the free exercise thereof. The free exercise and enjoyment of religious profession and worship, without discrimination or preference, shall forever be allowed. No religious test shall be required for the exercise of civil or political rights. 1987 Konstitusyon ng Republika ng Pilipinas Artikulo 13 Social Justice and Human Rights Seksyon 1: The Congress shall give highest priority to the enactment of measures that protect and enhance the right of all the people to human dignity, reduce social, economic, and political inequalities, and remove cultural inequities by equitably diffusing wealth and political power for the common good. According to John Stuart Mill (1859/1963), liberty comprises: first, the inward domain of consciousness …liberty of thought and feeling …secondly, the principle requires liberty of tastes and pursuits; of framing the plan of our life to suit our own character; of doing as we like, subject to the consequences as may follow; without impediment from our fellow- creatures, so long as what we do does not harm them, even though they should think our conduct foolish, perverse, or wrong. Thirdly, from this liberty of each individual, follows the liberty, within the same limits, of combination among individuals; freedom to unite for any purpose not involving harm to others; the person combining being supposed to be of full age, and not forced or deceived 2. 5. (1.2) 11. Slavery was once legal, and is now condemned. If we aim to stick to history and religious beliefs, then we must implement slavery once again. That is not how it works so why can the prohibition of same-sex marriage be eliminated in the modern time? 12. 15. REBUTTAL FOR ANTI SAME-SEX MARRIAGE NOTIONS 1. Religion is a part of Philippine culture. In creating constitution and laws, culture will always be a vital part, therefore, religion is a vital part in the law. Religion prohibits same-sex marriage. 1987 Konstitusyon ng Republika ng Pilipinas Artikulo 2 Declaration of State Policies and Principles Seksyon 6: The separation of Church and State shall be inviolable. Marami nang mga local na ordinansang naipapasa sa mga lugar sa Pilipinas kaya’t unti-unti na ring napoprotektahan ang karapatan ng komunidad ng LGBTQ: Anti-Discrimination Ordinance of Angeles City, Anti-Discrimination in Employment Ordinance of Antipolo City, The Batangas City Gender-Fair Ordinance, Anti-Discrimination Ordinance of the City of Baguio, Lesbians, Gays, Bisexual and Transgenders (LGBT) Anti-Discrimination Act of Puerto Princesa City, An Ordinance Prohibiting All Acts of Discrimination Directed Against Homosexuals in any Office in Quezon City, Whether in the Government or in the Private Sector, and Providing Penalties for Violation Thereof, etc. 3. The Family Code of the Philippines defines marriage as "a special contract of permanent union between a man and a woman". The family code itself violates the constitution: Section 1, Article III: No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. Section 3(1), Article XV: The State shall defend the right of spouses to found a family in accordance with their religious convictions and the demands of responsible parenthood Articles 1 and 2 of the Family Code trigger a strict judicial scrutiny because it violates the fundamental rights to decisional and marital privacy and because it created a suspect classification. 4. 5. Interracial marriages have a high failure rate. Since interracial and same-sex marriages have the same historical background, same-sex marriages may have a high failure rate too. If marriage promotes stability, then it is hypocritical to argue that heterosexual marriage contributes to good of society while homosexual marriage results in social harm. 6. Limiting marriage to a biological conception of procreation ignores the reality of blended families, assisted reproductive technologies, and the choice of many couples to remain childless. 8. Articles that prove that children need a mother and a father. Hindi lahat ay nais magkaanak. Studies consistently demonstrate no significant differences between children raised in heterosexual and homosexual households (Ewing, 2009; Racjzi, 2008; Steiner, 2009) 9. Prohibition of SSM satisfies the criterion of paternalistic and moralistic policies. This interference does not promote good. 12. Maaari naming magkaroon ng civil unions at domestic partnerships. Even through complex and expensive legal arrangements under contract and property law, same-sex couples may not be fully able to share health and retirement benefits, file joint tax returns, benefit under property inheritance laws or visit loved ones in medical facilities. (Steiner, 2009)
