“UPLB MURDER CASE”

 As time goes by , the crime rate of the Philippines increases day by day ,and
rape is biggest crime case of today's generation.Therefore the criminals also increases
its population.Consequently the prisons ran out of room.Under former president Benigno
"Noynoy" Aquino III signed the Republic Act 10592 or Good Conduct Time Allowance
(GCTA) Law in 2013 to reduce the population of convicted prisons by their good
conduct time inside the jail.This law was supposed to be "prospectively" meaning it was
to be applied only to sentences after the law was passed but a Supreme Court
decision in June 25th this year penned by Justice Diosdado Peralta who is running for
chief justice that Republic Act 10592 will be applied "Radioactively".Many are
questioning this. And at this August 2019,eleven thousand of convicts will be set free
pursuant to a recent supreme court ruling that allows radioactive application of law
providing GCTA as basis of reduced prison term law.One of the thousands convicts who
will be set free is the rapist-murderer Antonio Sanchez of 1993. Many are opposed by
this especially the families of the victims.How come that the impending release of
Sanchez shows good conduct while he's showing his bad behavior in his sell?.But,Is
GCTA Law really effective?.Was it really good for the family of the victim to freed the
convicted suspect?

The fail implementation of law in the Philippines regarding the increasing

population rate in jail. (Thesis statement) red highlight

Mary Eileen Sarmenta and Allan Gomez brutal murder crime in 1993,rape and
murder case that involved the former Mayor of Calauan Laguna Antonio Sanchez with
his 6 henchmen who were tried and convicted of the brutal crime Sanchez was
accused of masterminding the abduction of Sarmenta and her companion,
Gomez,and the subsequent rape-murder of Sarmenta and the torture-murder of
Gomez ,both students of University of the Philippines Los Baños (UPLB).Sanchez is
currently serving 7 terms of Reclusion Perpetua which is equivalent to 40 years each
term for the crime.

On January 28,1999,the Philippine Supreme Court affirmed the decision of the

Regional Trial Court on August 29,1999 ,this was his conviction about murdering the
Father and Son Nelson and Rickson in 1991 and sentence 2 life terms together with his 7
life terms for the Sarmenta and Gomez case.Sanchez will have to spend a total of 360
years in jail.In capital punishment also known as Death Penalty,ending his life as quickly
and as peacefully as possible rather than imprisoned him and suffer in 360 years.

One also of the reason why we want to Death Penalty rather than GCTA is the
brutal rape-slay in Lapu-Lapu City ,the 16 year- old girl,Cristine Silawan who was found
half-naked body and face is disfigured.This case is the same as Sarmenta-Gomez
case.They deserve justice.The convicted criminals of this case not enough to pay their
sins in jail only,they get the lives of those victims so they must get their lives too in order
to pay their sins and give justice.There is rightful sympathy or empathy directed toward
the family of those victim.These people are losing their loved one because of those
criminal case that they don't want to.Through this capital punishment,the family of the
convicted suspect has also lost someone as well.The person who does not deserve
sympathy is the crimal who decoded to commit the capital act in the first place.When
the death penalty is one of the possible consequences that someone faces for their
conduct,then it shields the family of the victim from another form of victimization.In
some point of view under this GCTA Law,the criminals like Antonio Snachez who have
the money and power ,will be set free,possible that he do again the same criminal act
and another victim again will lost their future or life too,go to jail and make use of his
power to cover his bad conduct.

We just want to conclude that using this capital punishment or death penalty will
much effective than making use of Republic Act 10592 or GCTA.Application of capital
punishment in just ways the threat will disappear,which means there will be no future
victims either and it becomes possible to manage the population issues and limit costs
without creating the potential for harm in the rest of society.
