MALOLOS CONSTITUTION

1. No definition was made about the national territory during the Malolos Constitution
2. Established a parliamentary system wherein the president is the head of the government
instead of a prime minister.
3. Judicial power was exercised by the court, defined as the power to apply the laws, in the name
of the Nation, in all civil and criminal traits.
4. The president can declare war, ratify and make treaties at his disposal the army and the navy
with prior consent from the Assembly.
5. The assembly on its own initiative or with the president of the republic can propose
amendments to the constitution wherein they will specify what article or articles are to be
amended. With this, the president will dissolve the assembly and convoke a constituent
assembly which will meet within three months.

1935 CONSTITUTION (COMMONWEALTH CONSTITUTION)

1. Territories which was handed over by Spain to the United States through the Treaty of Paris.

3. National Assembly has the power to define, prescribe and apportion the jurisdiction of various
courts but will not deprive the Supreme Court of its power over its original jurisdiction.
4. President can suspend the writ of habeas corpus or place the country in martial law if the public
safety demands it.
5. With votes of three-fourths from all its members, the national assembly may propose
amendments to the constitution or call convention for it. Amendments made shall be valid part
of the Constitution when approve by a majority of votes in a election and which are submitted
to the people for ratification.

1973 CONSTITUTION

1. Comprises the Philippine archipelago, including the waters and islands which surrounds it. Also
included are territories by historic right or legal title including the territorial sea, the air space,
the subsoil, the sea-bed, the insular shelves, and the other submarine areas over which the
Philippines has sovereignty or jurisdiction. The waters around, between, and connecting the
islands of the archipelago, irrespective of their breadth and dimensions, form part of the
internal waters of the Philippines.

3. The Batasang Pambansa shall have the power to define, prescribe, and apportion the
jurisdiction of the various courts, but may not deprive the Supreme Court of its jurisdiction over
cases enumerated in Section five hereof.

danger thereof, when the public safety requires it.
5. Instead of National Assembly, it is now known as Batasang Pambansa wherein additional
provisions are stated: any amendment shall be valid when ratified majority of votes in a
plebiscite which should be held not later than 3 months after approval or revision.

1987 CONSTITUTION

3. Judicial power includes the duty of the courts of justice to settle actual controversies involving
rights which are legally demandable and enforceable, and to determine whether or not there
has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of
any branch or instrumentality of the Government.
4. President is the commander-in-chief of all armed forces of the Philippines. whenever it becomes
necessary, he may call out such armed forces to prevent or suppress lawless violence, invasion
or rebellion but not exceeding to 60 days. President has a duty to submit a report or writing.
5. Amendments to this Constitution may likewise be directly proposed by the people through
initiative upon a petition of at least twelve per centum of the total number of registered voters,
of which every legislative district must be represented by at least three per centum of the
registered voters therein. No amendment under this section shall be authorized within five
years following the ratification of this Constitution nor oftener than once every five years
thereafter.
