SCOPE: DTI authorized enforcers (main office, attached agencies, regional offices or provincial
offices)

2. COVERAGE: All monitoring and enforcement activities (Trade and industry laws and consumer act
of the Philippines)

5. ENFORCEMENT TEAM: 1 enforcement team per DTI regional office (not more than 5 DTI/DTI
attached employees, representative from private industry association, consumer group as
observer/technical expert)

6. BASES OF THE NEED TO CONDUCT MONITORING – based on DTI’s motu proprio (an official act
taken without a formal request from another party) to conduct the same or from verified reports or
complaints either through phone call, e-mail, fax message, text message, walk-in or mailed
complaints.

7. MANNER OR MODE OF MONITORING

 On the spot monitoring – dti on its own intitiative


 Report-based/complaint-based – dti based on report/complaint gathered or received
 Test-buy operation – team on its own initiative, based on verified report, buy samples of
local/imported goods, submit to gov accredited labs
 Seizure operation – during monitoring/operation, non-conforming local/imported goods
may be seized provided an inventory duly prepared signed and a copy thereof left at the
establishment

8. duties of heads of enforcement team

 Review and scrutinize complaints


 Give instructions to verify complaits
 Make an overall plan regarding the details of operation
 Identify logistics needed
 Team wear valid id during conduct of monitoring
 Dti recognized Private industry / consumer group with valid ID
 Team attend seminars or trainings relative to TI LAWS AND CONSUMER ACT OF THE
PHILIPPINES
 Sign incident report
 Decide whether or not conforming products shall be sealed in the premises of establishment
and or withdrawn and placed in the DTI designated holding area.

9. duties of team members

 Familiarized with laws and rules TI LAWS AND CONSUMER ACT OF THE PHILIPPINES
 Obey legal instructions/directives from the head of team
 Immediately inform/relay to the head any information or complaint received or gathered
 Take photos of the premises and subject products/goods
 Prepare inventory of goods/products within the period of team’s enforcement activity or
operation.
 Prepare written report of what transpired during monitoring/enforcement

10. general enforcement procedure

 Head shall get the members’ input regarding the strategies and steps to be taken and come
up with a detailed plan
 Head shall brief and give clear instructions to the members before proceeding to target
establishment
 The team shall proceed to target establishment equipped with necessary documents
 Upon arrival to target establishment the head shall first look for the owner and inform the
latter of the teams identities and the purpoe of their presence
 Teal shall roam around the premises and observe and check on the goods/products and the
manner of business beig operated
 Notice of violation for non conformance goods/products/ business
 Team in the presence of representative of the establishment shall make an inventory of non-
conforming goods. The head shall decide whether the non-conforming goods/products shall
be sealed or withdrawn or transferred to dti designated holding area
 Written report on what transpired during monitoring shall be prepared
