AN ORDINANCE REGUIATING THE CONDUCT AND BEHAVIOR OF


PEDESTRIANS ATONG MAIN HIGHWAY AND MAJOR ROADS AND
PROVIDING PENATTIES FOR ANY VIOIATION THEREOF.

WHEREAS, the traffic situation ln Metro Manila today, particularly i n


Valenzuela City has turned from bad to worse to the detriment of the commuting
public, and the useless waste of energy and resources;

WHEREAS, some of the main contributory factors to this traffic problem are
certain thoughtless acts or conduct of pedestrians along main highways and major
roads, such as, disregarding traffic signals, crossing the streets and thoroughfares at
points not designated for the purpose, etc.;

WHEREAS, said acts or conduct on the part of pedestrians not only result in
traffic congestion but also road accidents, where the vehicles involved are badly
damaged and the victims are either seriously injured or killed;

WHEREAS, statistics available at the PNP Central headquarters in Valenzuela


City revealed that for the year 2008 - 2010 alone, pedestrians accidents reached an
aggregate of !,073 cases of which represent injured persons and a good number of
these cases involved jaywalking pedestrians;

WHEREAS, it shall serve the best interest of public safety and welfare,
especially of residents of Valenzuela City, if jaywalking along main highways and
major roads is eliminated or reduced to the barest minimum;

NOW, THEREFORE, be it
ORDAINED as it is hereby ORDAINED by the
Sangguniang Panlungsod of Valenzuela City in session duly assembled:

SECTION 1. IIILE. This Ordinance shall be known and cited as the


" ANTI.TAYIAIALKING ORDINANCE OF VALENZUELA CITY.''

SECTION 2. DEFINITION OFTERMS.

1. Pedestrians - a person who crosses or walks publi streets


and thoroughfares.

2. Jaywalking - the unlawful conduct and behavior of a pedestrian


main highways ond mojor roods as enumerated in Section 3
hereof.
3. Main Highway shall mean every public thoroughfares, public
boulevards, drive way, avenue, park, alley but shall not include road
way upon grounds owned by private persons, colleges, universities
or other similar institution.
4. Major Road sometimes called street, highway or thoroughfare, .

means that part of the land surface designed or used for the '
passage of vehicle, whether motorized or not.
5. Pedestrian Crossing or sidewalks - a designated point or area on a
road or highway where a pedestrian may cross safely.
6. Pedestrian overpass a bridge designed for pedestrians safe
-
crossing without affecting traffic.

SECTION 3. Acts Constituting Jaywalking. The following acts or


conduct of pedestrians in moin highways ond mojor roods are hereby prohibited to
wit:
a. crossing moin highways ond mojor roods in violation of a red light
pedestrian signal.
b. crossing main highwoys and major roods at points other than at the duty
designated pedestrian lanes.
c. crossing at the designated or marked pedestrian lane at a time when the
green signal light for vehicle is on.
d. Boarding and alighting from a motor vehicle when the same is still in
motion or has not yet been brought to a full stop close to the sidewalk
designated as loading/unloading zones.
e. walking along the streets or thoroughfare instead of the sidewalk, except
when the latter suffers from certain obstructions.
f. Non use of pedestrian overpass in main highway and major roads where
the same was constructed.

SECTION 5.
VIOUTION OFANTI -IAYWALKING ORDINAIVCE -Violation
of this ordinance shall be penalized by any of the following.

7. First Olfense - Warning. The apprehending officer shall introduce this


Ordinance to the violator and the latter shall be lectured on the
importance of observing traffic rules and regulations.
2. Second Olfense - Community Service of not more than one (1) day or fine
in the amount of Two Hundred Pesos (Php200.00).
3. Third Ollense - Community Service of not more than one (1) day and fine
in the amount of Two Hundred Pesos (Php200.00).
4. Fourth & Subsequent Olfense - lmprisonment, a legal action shall be
instituted against the violator in the proper court where imprisonment of
not more than three (3) days may be imposed at the discretion of the
co u rt.

sEcTtoN 6. The amount of TWo HUNDRED PESOS (Php200.00) shall be


paid by the apprehended violator at the Traffic Management Office and upon the
issuance of Ordinance Violation Receipt (OVR) by the apprehending officer.

SECTION 7.
ENFORCEMENT. This Ordinance shall be enforced by duly
deputized member of Valenzuela Traffic Management Office.

SECTION 8. IMPLEMENTATION. - The Traffic Management Office is


hereby tasked to implement the provisions of this Ordinance. lt sh intain a
record of apprehended violators and prepare all the documentary fo ms essary
for effective implementation.

sEcTtoN 9. DUE TO DESIGNATE PEDESTRIAN CROSSING, TRAFFIC
LIGHTS, AND ROAD MAKTNGS lt shall be- the duty of the Traffic Management
Office to designate pedestrian crossings and traffic lights for the safety and
convenience of the pedestrians. Designated pedestrian crossings or crosswalks
shall be marked with the white stripes to provide guidance and information to the
pedestrians: provided, however, that until such pedestrian crossings have been
marked and properly designated and traffic lights were installed, no prosecutions
shall be instituted against anyone for violation of this Ordinance.

SECTION 10.
NO TAYWALKING SIGNBOARD - ln addition to the
designation of pedestrian crossings, traffic lights and road makings, the Traffic
Management Office shall provide for a signboard prohibiting jaywalking with the
following notation:

SECTION 11. TRAFFTC DEVELOPMENT TRllST FUND - All collections


for
violating this Ordinance shall accrue to the Trust Fund of the City Government of
Valenzuela. The City Accountant shall keep and maintain a special and all records
related thereto. The fund shall be disbursed only for traffic and pedestrian
improvement and other activities and requirements of the Traffic Management
Office, including maintenance of traffic control devices, but excluding salaries of
personnel.

SECTION L2.
TMPLEMENTING RI.,LES AND REGULAIIOAIS The Citv -
Government of Valenzuela, in coordination with the Traffic Management Office, is
hereby task to formulate necessary rules and regulations in pursuant to the
implementation of this Ordinance.

SECTION t3. CAUSE. All ordinances, rules or regulations or

parts thereof which are inconsistent with any of the provisions of this ordinance are
hereby repealed or modified accordingly.

SECTION L4. SEPARABILITY CLAUSE. lf any part, section, or provision

of this Ordinance is declared unconstitutional, the part, section or provision not
affected thereby shall continue to be in force and effect.

SECTION L5. EFFECiM|fY. This Ordinance shall take effect fifteen (15)
er its publication once in a newspaper of g eneral circulation.
