Dear Vice-Mayor Quifr ones:

This has reference to your letter dated 20 August 2010 requesting for
authority to practice your profession as a CPA-lawyer subject to the limitations
set bV law.

In reply thereto, please be informed that this Department has already

addressed a similar concern in
legal opinion, we opined that a Vice-Mayor/ who is also a lawyer, is not
precluded from practicing his profession for as long as he complies with Section
90 (b) of the Local Government Code of 1991 (RA 7160), Section 90 (b) of the
Local Government Code of 1991 is the proper provision that applies to a Vice-
Mayor with respect to his practice of profession or engagement in any occupation
since the Vice-Mayor is a Member of the Sangguniang Bayan, We also opined
therein that the requirement of
authorization or
permission from this
Depaftment, the Ombudsman or the Civil Service Comrnission applied only to
appointive officials within their respective jurisdictions who want to engage in the
practice of their profession.

Hereto attached is a photocopy of the aforesaid DILG opinion for your

readv reference.
