The second Criminal Commission convened in the Federal Court of Cassation on 9/5/2019.
Headed by the head judge Munther Ibrahim and the membership of judges Haidar Jawad
and Shahab Ahmed and Ayoub Abbas and Mahmoud Abbas, authorized to rule on behalf
of the people, and issued the following decision:

Transfer Applicant / Defendant / Ziad Tariq Abdallah

On 11/4/2011, (Ali Abdel-Jabbar and Hamed Jabr) the attorneys for the aforementioned
Defendant submitted a request to the Federal Court of Cassation to transfer his case No.
34/cn/A-a/2011 Appeals from the Al Rusafa Criminal Court for Integrity Cases to the
Karkh Criminal Court for Integrity Cases. The appropriate judge indicated in his opinion
dated 18/4/2019 that he does not object to the transfer.

Decision

After examination and deliberation, it was found that the transfer request dated 11/4/2019
submitted by the Defendant (Ziad Tariq Abdallah) through his attorneys (Ali Abdul Jabbar
and Hamed Jabr), fulfills the legal requirements applicable to the provisions of Article 142 of
the Criminal Procedure Code, because the transfer helps to reveal the truth. Therefore,
[handwritten: it was decided]to transfer (the case) to the (Karkh Criminal Court for Integrity
Cases) and to notify the (Al Rusafa Criminal Court for Integrity Cases) of this. The decision
was unanimously issued on 9/5/2019.

In accordance with referral decision number 1019 on 8/12/2010, the Honorable Judge of Integrity
Investigations of Baghdad has referred the fugitive Defendants Bruska Nouri Shawis, Ziad Tariq
Abdallah, and Sawsan Jasim Mohamed, because they intentionally caused financial damage to
public funds while they held managerial positions at the Ministry of Defense, through infractions
related to the concluding of a contract for the rehabilitation of military equipment in Taji and
Miqdad[iyah]. [The contract] was concluded in Baghdad on 19/10/2004 between the Ministry of
Defense and the General Investment Group Company, to provide money for the Ukrainian
company that rehabilitates (T55 and T72) tanks. After reviewing the ongoing basic and judicial
investigation, the legal representative’s statement to the Ministry of Defense, the recommendations
of the investigation committee, and the concluded contracts, it is clear that the Defendants actually
committed [the crimes], according to the provisions of accusation article 340 CP. Therefore, we
request to convict them in accordance with [this article] and to impose an appropriate sentence.

Code;

2. It ruled to keep the right to the Plaintiff (MoD) to request compensation before the civil courts

5. The unanimous decision was issued based on the provisions of Article 182/A of the Criminal

the date of trial in two local newspapers: Al-Mawqif number 81, on 20/1/2011 and Al-Manar number

initiated in absentia. The Court read the referral decision publicly, then the testimony of the legal

charged the Defendants under the provisions of Article 340 of the Criminal Code and the indication of
articles 47 and 48-49 and [a plea of] ‘innocent’ was recorded, as they are fugitives. The Court heard the
case of the Prosecutor and the attorney of the Defendants, and the trial was concluded, and the case was
put under investigation and deliberation. The Court issued the following decision:

After investigation and deliberation and what is established before this Court from the proceedings of
the preliminary and judicial investigations, and the ongoing trial, the Court finds that the facts of this
case are that the fugitive Defendants, Bruska Nouri Sadeeq, Ziad Tariq Abdallah [Qattan] and Sawsan
Jasim Mohamed have allegedly on 25.10.2004, in their capacity as persons affiliated with the MoD,
concluded an agreement with GIG [General Investment Group Company] to provide funds for the
Ukrainian company which carries out rehabilitation of tanks for the MoD, and that they have
deliberately caused harm to the property and interests of the entity that they represent, which
is MoD.

The Court convened in the presence of General Prosecutor Falah Hassan Rahim. He brought the
Defendant convicted in absentia, Ziad Tariq Abdallah. His case file was pulled from this Court’s
storage files. This Court noted that the Criminal Court of Al Rusafa had previously issued ruling
number [handwritten:34]C/[handwritten: 2011] on [handwritten 24/3/2011], thereby sentencing
the aforementioned convicted Defendant to [handwritten: seven] years in prison, pursuant to the
provisions of article [handwritten: 340] of the Criminal Code. A warrant was issued for his arrest,
and his case was pursued according to the provisions of the aforementioned article. The Court
asked the aforementioned Defendant whether he wished to appeal his aforementioned sentence in
absentia, namely imprisonment. Based on the provisions of foundational article 245/D, the Court
ruled to accept his appeal in form and to set the trial date for [handwritten: (illegible)/11]/2018.
The Court ruled to request a report on his future, because he had been convicted in other cases.
The investigation documents related to the Defendant/Appellant from the original case were filed

Upon examination and deliberation, it has been noted that the Criminal Court of Al Rusafa C3,
which has jurisdiction to look into integrity cases, previously issued ruling number 34/C3/2011 on
24/3/2011 in absentia, with regard to the fugitive convicted Defendant (Ziad Tariq Abdallah).
After his arrest, the Criminal Court of Al Rusafa decided in [ruling] number 34/CN/appeal/2011
on 31/7/2018, to accept the appeal the appeal of the sentence in absentia and to postpone the
decision on the future of the Defendant Ziad Tariq Abdallah. The Federal Court of Cassation
decided, in [ruling] number 6253/HJ/2019 on 9/5/2019, to move the case to this Court, based on
examination of the case documents and on the desire not to skip over any of the phases of litigation
for the Defendant, namely investigation, the recording of statements as [part of the] investigation,
and allowing him to defend himself against the charges with which he is accused, as these are
among the rights guaranteed to defendants. Therefore, the cassation intervention has decided to
refer, overturn, and send the case to the Investigations Court authorized to hear Integrity Cases, so
that it may conduct the aforementioned [procedures] and complete all investigations. This decision
is issued unanimously, based on the provisions of foundational article 264. It was presented on
17/6/2019.
