COMMENT ON THE MOTION FOR

HOSPITALIZATION OF THE ACCUSED

COMES NOW, the State, through the undersigned Public Prosecutor, and unto
this Honorable Court, most respectfully submit this comment for the hospitalization of the
accused and avers that:

The defense earlier filed a motion for the hospitalization of the accused who is
presently detained in Cebu Provincial Detention and Rehabilitation Center (CPDRC) on
the basis of the aforesaid charges filed against him;

The defense on August 20, 2019, manifested orally and reiterated its motion for
the hospitalization of the accused. Thus, the prosecution was given by the Honorable
Court to give its comment to the motion filed by the defense;

Finding such motion filed by the defense meritorious, the prosecution, for
humanitarian reasons, interpose no objection on the said motion, provided that after due
evaluation and treatment of the accused of his illness by the attending physician, he
should return to the penal establishment where he is confined, as his presence during
trial and hearing of his cases is indispensable.

PRAYER

WHEREFORE, premises above considered, for interest of substantial justice, the

Motion for hospitalization of the accused filed by the defense should be granted.
