PETITION UNDER ORDER 39 RULE 2 (3) READ WITH RULE 4 &

SECTION 94, 151 CPC

Respectfully submitted:-

1- That the above mentioned suit is pending adjudication

before this Honourable Court and is fixed for 10.12.2013

for ex-parte evidence.

2- That in the said suit, this learned court had passed an

interim injunction in favour of applicant / plaintiff

restraining the defendants from removing the energy

meter from existing location.

3- That in clear violation of court order, the subordinates

of respondents have removed the energy meter on

07.11.2013.

4- That the respondents / defendants have violated the

order passed by this honourable court deliberately and

willfully and such conduct on their part falls within the

purview of contempt of court and calls for severe and

exemplary punishment.

5- That if the respondents are not proceeded against due

to contempt of court and the status quo is not restored

as on the date of filing the suit, serious complications

would arise in the matter and the applicant would suffer

irreparable loss.

Under the circumstances, it is respectfully

prayed that the respondents may kindly be

proceeded/ punished due to committing

contempt of court and status quo be

restored as on the date of filing the suit.
