PLAINT WITH SUMMONS
1. Plaintiffs are persons of good character, honour and reputation. Plaintiffs are the
daughters of Mr. Dawood Ajum Rawat.
2. Defendant No.1 is domestic company limited by shares which was incorporated on
19/12/2018 under file No. C161161 having its registered office at No.55, Lord
kitchener St, Port Louis, with the following direciors:
i. Dhunny Cassam Defendant No. 4
ji. Molla Maneesha Defendant No. 5
ii, Packiry Poulle Satiaven Defendant No. 6
3. The Defendant No. 1 was at all material times and more especially on the 14
October 2019, the owner and publisher of the weekly Newspaper Mazavaroo.
4, The Defendant No.2 was at all material imes and more especially on the 14 October
2019. the Editor in Chief of the said newspaper Mazavaroo which has a wide
circulation in Mauritius and abroad and is also posted on the intemet in ils website:
www mazavaroo.mu
5. The Defendant No.3 was at all material times and more especially on the 14 October
2019 the printer of the said newspaper Mazavaroo.
6. Incan unsigned article in its issue of Monday 14 October 2019, the Defendants Nos.1
and 2 printed and/or cavsed fo be printed and published on the front poge of ts

7. At page 3 of the same issue of 10 June 2006, the Defendants printed and\or caused
to be printed and published the following fille "INTERROGATION: MME LAINA RAWAT-
BURNS LA VERITE SI JE MENS!” Immediately undemeath is a picture of the front part of
@ cap bearing the words I'M THE BOSS in capitol and next to it a picture of Plaintiff
No.1 and her husband Plaintiff No.2 and her husband all four standing together.
8 The arficle reads as follows
Assez fréquemment Mme Laina Rawat Burns se filme et poste des vidéos sur les
réseaux sociaux nous racontant les miseres qu'elle et sa soeur ainée ont eu a
endurer, aprds la chute de l'empire de leur paternel. Mme Rawat Burns s‘affiche
aussi lors de meetings politiques. Elle justifie sa prise de position comme de la
reconnaissance & ceux qui les ont soutenues, sa famille et elle, lors de leurs
démélés avec Ia toi. Tout cela peut aisément se comprendre. Ce que l'on
comprend moins en revanche, est, pourquoi dans toute son histoire qui n'est
certes, pas réjouissante, et qui provoque méme de la compassion, il y a une vérité
qu'elle se garde bien cependant de nous dire ? En effet, Mme Rawat Burns omet
consciemment un détail crucial, notamment que la santé financiére de la BAI était
déja trés febrile avant Vaffaire de la Bramer Bank et le reste de la saga Super
Cash Back Gold (SCBG. ) La politique de déshabiller St Pierre pour habiller St
Jacques telle qu'on la pratiquait & outrance au sein de la BAI depuis pas mal
d’années avant la chute, est l'une des raisons pourquoi les épargnants avaient
jusgu’au dernier moment toujours recouvert leur argent et les intéréts. Toutefois,
une telle situation ne pouvait pas durer éternellement et ce détail- [a, les Rawat le
savaient et le savent pertinemment bien. C'est la raison pour laquelle d’ailleurs la
compagnie avait commencé un exercice de dégraissage bien avant 2014 & telle
enseigne que le HR Manager d’alors du groupe, un certain MC y a laissé sa
santé, étant aujourd'hui terriblement marqué, & cause du stress accumulé durant
cette période qui a précédé I’écroulement du groupe. Selon les dires de son
entourage cet homme d'une droiture et d'une gentillesse appréciées de tous,
survivait ses longues heures de travail au bureau sur une barre de snicker et du
coca-cola, faute de pouvoir trouver le temps pour déjeuner, tant les soew's Rawat
lui metiaient de la pression, pour rédiger et distribuer en masse les letters de

groupe. Le chagrin et la douleur d’annoncer aux gens que leur service n’était

soeurs Rawat, mais bien celui du HR Manager qui en subit encore les séquelles.
Puis vint le bouquet final, oit, une fois la derniere letter remise au dernier ou
plutot Vavant-dernier employé licencié, Monsieur MC fut regu dans le bureau de
Mme Laina Rawat Burns, oit trénait en permanence une casquette sur laquelle

L’écroulement de empire Rawat n'est pas survenu «overnight» comme on veut le
faire croire. La compagnie était en difficulté et au rythme du train de vie de
certaines demoiselles, cette chute allait survenir t6t ou tard. La question qui reste
posée @ toutes celles concernées est : est-ce le revers de la médaille d'une
injustice vis-d-vis des employés ? La vérité si je mens C'est devenu une
échappatoire, une esquive de brander la réligion comme un bouclier de défense
pour attirer sur soi la sympathie, la solidarité DE TOUTE UNE COMMUNAUTE,
quand on subit des revers du destin ou essuie des malheurs personnelles. Et,on a
Vaudace, le culot d’assimiler ses déboires au fait que sa religion soit en danger et
fasse Vobjet d’oppression. Méme si on vivait en marge de ces préceptes et
convictions spirituelles, tout d’un coup, comme par enchantement on se découvre
une ferveur, un zile et s ‘applique & mener, entrainer les autres d s‘apitoyer sur
son sort, C'est ce faux-fuyant qui est dangereux et non pas la religion qui est en
danger.
By the said article the Defendants meant and are understood to mean that Plaintiffs
are responsible for the downfall of BAI by their lifestyle and were heartlessly
terminating employees.
By the tenor of the said article the Defendants are insinuating that the Plointiffs,
despite being Muslims, were, at the time the BAl existed, oppressing people of the
same faith and they re now playing on the sentiments of the Muslim community
and the public in general to get public compassion and that of the Muslim
‘Community.
Plaintiff No.1 is the person refered to in the said article in as much as she is referred
to by her name and her photographs have been published.
Plaintiff No.2 has also been referred to in the said arlicle in as much as reference is
made fo “les soeurs Rawat" and her photograph has also been published.
The averments referred to above are false and highly defamatory. consists of spite.
il-wil, improper motive and are meant to harm the Plaintiffs, to attack their integrity
and to diminish them in the esteem of the public at large and of the Muslim
community.
Plaintiffs further aver that the said article is instigating and stiring communal and
religious hatred towards Plaintiffs

specifically that Plaintiffs are against Muslims and ore hypocrites and users.
16. Plaintiffs aver that the Defendants have committed a “faute” and/or have acted in
reckless and negligent manner as they have never contacted the Plaintiffs for any
‘comments or information prior to such publication
17. Plainfifs aver that the said publication has caused and is sfil causing the Plaintiffs
great hardship, damage and prejudice.
18. Plaintiffs aver that the Defendants through their “faute" and/or tortious and/or
negligent acts and doings have caused and are causing damage and prejudice to
the Plaintiffs. In the altemative, the Defendants were imprudent and/or negligent in
publishing and/or allowing the said article to be published.
19. By the aforesaid acts and doings and imprudence and/or negligence of the
Defendants, the Plaintiffs have suffered and are still suffering damage and prejudice
which they value at Rs. 500,000,000.- and which the Defendants are bound jointly
and in solido to make good to the Plaintiffs.
20. Plaintiffs therefore humbly pray from this Honourable Court for a judament ordering
the Defendants, joinily and in solido =
(a) to pay to Plaintiffs the sum of Rs. 500,000,000.- as damages and;
(5) to publish and cause to be published the judgment of the above Court in a
prominent place in the Newspaper and on its website within a delay to be
fixed by the Court
NOW TAKE NOTICE you the abovenamed Defendants that you are hereby called upon
and summoned tg, be and appgar on the floor of the SUPREME COURT OF MAURITIUS on.
THURSDAY the ..JYI. day of ...04 Nat 09:30 a.m. to answer the Plaintiff in
the above matter.
WARNING YOU that failure by you to attend or fo be represented on the aforesaid day,
hour and place may result in the above Court delivering judgment against you in favour of
the Plaintiff in terms of the present piaint.
