EXECUTIVE ORDER NO. 04

Series of 2018

“AN ORDER RECONSTITUTING THE CITY ECOLOGICAL SOLID WASTE

MANAGEMENT BOARD OF TUGUEGARAO CITY”

WHEREAS, Section 12 of Republic Act 9003, otherwise known as the “Ecological

Solid Waste Management Act of 2000,” mandates the creation in every city of a Solid
Waste Management Board which shall prepare, submit, and implement a plan for the
safe and sanitary management of solid wastes generated in areas under its geographic
and political coverage;

WHEREAS, Tuguegarao City Ordinance No. 058-2017 otherwise known as the

“Comprehensive Environmental Management Code of Tuguegarao City,” recognizes the role
and functions of the City Ecological Solid Waste Management Board (CSWMB) in the
developmental and environmental undertakings particularly in the formulation of plans
and implementation of programs, projects and activities designed for the proper waste
management of the city;

WHEREAS, Executive Order No. 13, series of 2016, implementing the provisions
of Section 12 of R.A No. 9003, created the Solid Waste Management Board of
Tuguegarao City which originally reviewed and endorsed the Ten Year Ecological Solid
Waste Management Plan of Tuguegarao City;

WHEREAS, on November 28, 2017, the National Solid Waste Management

Commission issuedResolution No. 786 A series of 2017, entitled“Resolution Approving
the Ten Year Solid Waste Management Plan of Tuguegarao City Province of Cagayan” after its
thorough review and evaluation through the NSWMC Secretariat;

WHEREAS, it is imperative to reconstitute the Board in order to update its

composition and strengthen its membership;

WHEREAS, the CSWMB is tasked to be part in the implementation of the

Enhanced Ten Year Ecological Solid Waste Management Plan of Tuguegarao City;

NOW, THEREFORE, I, ATTY. JEFFERSON P. SORIANO, City Mayor of

Tuguegarao, by virtue of the powers vested in me by the Constitution and by the laws,
do hereby reconstitute the Tuguegarao City Ecological Solid Waste Management Board.

Section 1. Composition. The Solid Waste Management Board of Tuguegarao City shall
be composed of the following:

The City Solid Waste Management Board may, from time to time, call on any
concerned agency or sectors as it may deem necessary.

Section 2.Duties and Responsibilities. The City Solid Waste Management Board shall
have the following duties and responsibilities:

(1) Develop and formulate the City Solid Waste Management Plan that shall
ensure the long-term management of solid waste, as well as integrate the
various solid waste management plans and strategies of component
barangays in its area of jurisdiction. In the development of the Solid Waste
Management Plan, it shall conduct consultations with the various sectors of
the community;

(2) Adopt measures to promote and ensure the viability and effective
implementation of solid waste management programs in its component
barangays;

 (3) Monitor the implementation of the City Solid Waste Management Plan
through its various political subdivisions and in cooperation with the private
sector and the NGOs;

(4) Adopt specific revenue-generating measures to promote the viability of its

Solid Waste Management Plan;

(5) Convene regular meetings for purposes of planning and coordinating the
implementation of the solid waste management plans of the respective
component barangays;

(6) Oversee the implementation of the City Solid Waste Management Plan;

(7) Review every two (2) years or as the need arises the City Solid Waste
Management Plan for purposes of ensuring its sustainability, viability,
effectiveness and relevance in relation to local and international
developments in the field of solid waste management;

(8) Develop the specific mechanisms and guidelines for the implementation of
the City Solid Waste Management Plan;

(9) Recommend necessary logistical and operational support to component

barangays;

(10) Recommend measures and safeguards against pollution and the

preservation of the natural ecosystem;

(11) Provide the necessary logistical and operational support to its component
cities and municipalities in consonance with subsection (f) of Sec. 17 of the
Local Government Code; and

(12) Coordinate the efforts of its component barangays in the implementation

of the City Solid Waste Management Plan.

Section 3.Secretariat. The City Environment and Natural Resources Office shall
constitute the Board Secretariat.

Section 4.Meetings.The members of the board shall meet regularly on quarterly basis on
the date fixed by them. However, the Chairman may call for special meeting to discuss
urgent and important matters which require immediate disposition and or action.

Section 5.Repealing Clause. All prior issuances or parts thereof inconsistent with this
Executive Order are hereby repealed, amended or otherwise modified accordingly.

Section 6.Effectivity Clause. This order shall take effect immediately.
