TERMS AND CONDITIONS OF COMAIR TRAINING SERVICES

(For Individuals)

Comair Limited (“Comair”) is a fully registered and listed aviation company in accordance with the regulations
governing companies within the Republic of South Africa. Furthermore, Comair operates a registered airline
operation and training facility with the approval of the South African Department of Transport (DoT) and South
African Civil Aviation Authority (SA CAA) and are as such approved under Civil Aviation Regulations Part 141.

The training services offered by Comair Limited (“Comair”) are subject to the terms and conditions (the
“Terms and Conditions”) contained herein. Please read these Terms and Conditions carefully, as your
acceptance of them will be legally binding upon you (“You” or “Your”) and Comair in respect of the training
services for which you are enrolling.

Training Services
All training is conducted in accordance with an approved syllabus, whether it is for initial rating, recurrent
training or aircraft type training. Should practical procedures be required, evaluations are conducted on an
aircraft or static trainer that realistically resembles the “aircraft”.
Selection of instructors is effected in accordance with their experience, qualifications and ability. All instructors
are trained to a standard acceptable to and receive written approval from the SA CAA and are suitably qualified
to provide applicable training.
The Comair Training Centre has the accommodation necessary to meet the requirements of SA CATS 64; 121;
141. The lecture rooms are sufficiently ventilated and adequately illuminated to permit training Programmes
to be conducted proficiently. There is a reasonable working area for each student as well as sufficient space
available for the equipment being used. Only one lecture at a time will be given in a classroom. The lecture
rooms are equipped with audio-visual facilities.
Certificates are issued on satisfactory completion of each course.

Student obligations
Students must:
• attend on the date and times advised to you by Comair;
• arrive promptly for all classes and participate in all training and classroom interactions;
• study the course contents and revise the training undertaken each day;
• comply with Comair’s instructions whilst at the Training Centre;
• not cause any damage to the equipment in the B737 or the Training Centre or whilst on the premises
of Comair;
• familiarise themselves with the emergency evacuation procedure at the Training Centre and acquaint
themselves and comply with the regulations as laid down and advised to you by Comair and the
instructors from time to time;
• not bring into the B737 transmitters of any kind (including, for example and not limited to, mobile
phones, radios, cameras, radio microphones, laser printers or CD-Rom services) or any dangerous
goods or items that could cause damage to the B737 or the Training Centre.
• be responsible for and arrange at your own cost all hotel accommodation, transport, meals, etc.,
required for the duration of the training programme for which you are enrolled;
• pay all fees and charges on or before the due date for payment;
• be able to speak English;
• have a valid licence
Standards for Evaluation
All students will be required to write an exam on conclusion of each of the compulsory modules as
prescribed in the training standard. In addition, all students will be required to demonstrate competence in
a practical evaluation, which will consist of the following:

• Practical procedures of the operation of the aircraft;


• Procedures related to the fighting of fires;
• Ditching procedures;
• Practical operation of emergency procedures in a simulated environment;
• Practical operation of the IATA Dangerous Goods Regulations manuals.

Pass Marks

In order to qualify, students must pass both the theoretical and practical components of the examinations.
The following written examination standards are set by this training school:

Conversion Courses Technical Pass mark 80%


Dangerous Goods Pass mark 80%
Safety Emergency Procedures Training Pass mark 90%
Performance theory Pass mark 80%
Recurrent Training Pass mark 80%
RVSM Pass mark 80%

to standards equal or better than industry standard is there no guarantee that a student will pass the course.
A student’s success will be determined by their own commitment and performance.

As a student, you acknowledge that the training Programmes (including all associated student material and
documentation) (collectively, the “Training Programmes”), including the original and any copies thereof, in
whole or in part, and all trade secrets, copyrights, patent and other intellectual and proprietary rights
therein, are and remain the valuable property of Comair or its third-party licensors.
The Training Programmes may not be copied, reproduced, stored in a retrieval system, or retransmitted in
whole or in part, in any form or by any means, whether electrical, mechanical, photocopying, recording or
otherwise without the prior written permission of Comair.
Restrictions on Use
The Training Programmes are provided for your individual use solely for training purposes. Students may not:
(a) copy, reproduce, or publish the Training Programmes; (b) electronically transfer or distribute the Training
Programmes to others; (c) modify, adapt, translate, or create derivative works based on the printed,
electronic, or written content of the Training Programmes; (d) assign, rent, lend, share, or sublease the
Training Programmes; or (e) sell or transfer the Training Programmes.
Payment
50 % of the training to be paid within twenty (20) days of invoice, the balance will be due ten (10) Business
days before the commencement of training. All fees and payments must be paid in full prior to the
commencement of the Training Programme, failing which the student’s placement on the Training
Programme will not be guaranteed
DISCLAIMER
YOU UNDERSTAND AND AGREE THAT COMAIR’S TRAINING PROGRAMMES ARE SUPPLEMENTARY ONLY,
AND IN NO WAY REPLACE YOUR OWN OBLIGATION TO BECOME FULLY TRAINED. COMAIR ASSUMES NO
RESPONSIBILITY OR LIABILITY WHATSOEVER FOR FULLY AND COMPLETELY TRAINING YOU, WHICH
OBLIGATION RESTS SOLELY WITH YOU. YOU WILL INDEMNIFY COMAIR FROM ANY ACTION, SUIT OR
PROCEEDING BASED UPON ANY ALLEGATION THAT YOU HAVE NOT BEEN PROPERLY OR ADEQUATELY
TRAINED. COMAIR MAKES NO GUARANTEE FOR (I) EMPLOYMENT OR PLACEMENT FOLLOWING TRAINING,
(II) ANY CERTIFICATION AND/OR (III) ANY LICENSE ISSUANCE.
Complaints
Complaints which cannot be resolved between the student and the instructor or with the Comair Training
Centre Manager, may be mailed directly to Comair Limited, attention: Operations Director, P.O. Box 7015,
Bonaero Park, Kempton Park, Gauteng, South Africa, 1622.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of South Africa,
without regard to conflicts of law principles thereof, regardless of its place of execution or performance. The
United Nations Convention on Contracts for the international sale of goods will not apply to these Terms and
Conditions.

REFUND POLICY

Students not accepted by the Training Centre and students who cancel their enrolment in a Training
Programme by notifying Comair Limited no later than ten (10) business days prior to the class start date are
entitled to a full refund of all tuition and fees paid. Students who withdraw within ten (10) business days of
the commencement of a course, but before commencement of classes are entitled to a refund of tuition fees
paid less the cost of books, tools, supplies and a cancellation fee of 50% of the fees paid will be applicable. If
a student withdraws after commencement of the applicable class, the student will not be entitled to any
refund as the Training Centre is not able to fill the position after the commencement of any Training
Programme and costs have been incurred by the Training Centre in respect of that student.
Undertaking Not to Sue, Liability Release, and Assumption of Risk Agreement

I, ______________________________, hereby affirm that I am aware that the training programme for which I have
enrolled and activities associated with flying have inherent and unforeseeable risks which may result in serious injury or
death. I understand and agree that neither my instructor nor Comair Limited, nor any of their respective employees,
officers, agents, contractors, or assigns, (hereafter referred to as “Released Parties”) may be held liable or responsible in
any way for any injury, death, or other damages to me, my family, estate, heirs or assigns that may occur as a result of
my participation in any training programme offered by Comair Limited, flying aircraft, flying in aircraft, flight instruction,
aircraft rental, aircraft operations, ramp operations, or any associated activities involved with these activities, (hereafter
referred to as Flight Activities), or as a result of the negligence of any party, including the Released Parties, whether
passive or active.

In consideration of being allowed to participate in Flight Activities, I hereby personally assume all risks of Flight Activities,
whether foreseen or unforeseen, that may befall me while I am participating in these activities. I, further release, exempt,
and hold harmless the Released Parties from any claim or lawsuit by me, my family, estate, heirs, or assigns, arising out
of my participation in Flight Activities including both claims arising during any course of training or after I receive my
certification(s).

I also understand that Flight Activities are physically demanding and that I must seek the ongoing care of a licensed and
authorized aviation medical examiner and that I will not hold Released Parties responsible for events resulting from my
physical condition, limitations, or incapacitation.

I, undertake to complete all assignments and tasks to the best of my abilities and I warrant that same shall be done
independently unless otherwise directed by Comair. The work submitted shall be that of my own. I undertake not to
commit any misconduct while undertaking any tests or examinations in completion of the requirements for my selected
course of study. I acknowledge that should any misconduct be noted, that I shall be subject to a supplementary
examination or test of Comair’s decision. Should I be found guilty of dishonest conduct, such conduct shall be noted
against any qualification that I shall be eligible to receive and noted against my record of attendance by Comair.

I further state that I am of lawful age and legally competent to sign this liability release or that I have acquired the written
consent of my parent or guardian.

I understand the terms herein are contractual and not merely recital, and that I have signed this document of my own
free act and with the knowledge that I hereby waive my legal rights. I further agree if any provision of this Agreement is
found to be unenforceable or invalid, that provision may be severed from this Agreement; however the remainder of this
Agreement shall then be construed as though the unenforceable provision had never been contained therein.

I, ______________________________ BY THIS AGREEMENT AGREE TO EXEMPT AND RELEASE MY INSTRUCTORS, COMAIR


LIMITED, AND ALL RELATED ENTITIES AS DEFINED ABOVE FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR
PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH, HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO,
THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OF ACTIVE.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND ASSUMPTION OF RISK
AGREEMENT BY READING IT BEFORE I SIGNED IT ON BEHALF OF MYSELF AND MY HEIRS.
