DEED OF CONDITIONAL SALE OF LAND

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF CONDITIONAL SALE is made and entered into by and between:

NESTOR SOFELANAS VILLAFUERTE, of legal age, Filipino, married to


Jackielyn O. Villafuerte and a resident of Purok 3-A, Feeder Road #1, Brgy.
Tibal-og, Sto. Tomas, Davao del Norte, Philippines and herein referred to as the
VENDOR;

- and -

LEOPOLDO ENGBINO LABAJO, of legal age, Filipino, married to Mary B.


Labajo, and a resident of Purok 4, Puerto Azul Subd., Brgy. Tibal-og, Sto.
Tomas, Davao del Norte, Philippines, hereinafter referred to as the VENDEE;

W I T N E S S E T H:

WHEREAS, the VENDOR is the registered owner of a certain parcel of land


specifically identified as Lot No. 2340-J-8, PSD-112318-122101, covered by
Transfer Certificate of Title (TCT) No. 142-2013008983, with a total area of Three
Hundred Fifty Seven (357) square meters, more or less, located at Brgy. Tibal-og, Sto.
Tomas, Davao del Norte, Philippines.

WHEREAS, the VENDEE has offered to buy and the VENDOR has agreed to
sell the entire above-described subject property for the consideration and the terms
and conditions set forth herein below;

NOW THEREFORE, for in consideration of the foregoing premises the VENDOR


hereby SELLS, TRANSFERS, CONVEYS the aforesaid land in consideration of the
following terms and conditions, to wit:

1. The total consideration of the sale shall be in the amount of Three Hundred
Fifty Seven Thousand Pesos only (Php. 357,000.00) Philippine
currency, to be paid by the VENDEE to the VENDOR of which shall be paid
in full within the month of March 2020;

2. Upon execution of this document, the VENDEE shall deliver to the VENDOR
the amount of One Hundred Thousand Pesos Only (Php.100,000.00) as
partial payment;

3. It is hereby agreed by the parties that the purchased price shall not be
increased by the VENDOR for the entire period;

4. Upon the full payment of the balance of the purchased price, the VENDOR
shall immediately execute an Deed of Absolute Sale and/or other
instrument of transfer of ownership of the aforementioned property in
favor of the Vendee, his heirs, assigns and/or beneficiaries;

5. In case of death of the herein parties, their heirs, assigns and successors-in-
interest shall be bound by the terms and conditions of this sale;

This DEED OF CONDITIONAL SALE OF LAND is executed by the aforesaid


parties voluntarily under their own volition, act and deed and without the use of
force, intimidation, threat, undue influence neither from any individuals and/or third
persons nor to defraud creditors.

IN WITNESS WHEREOF, the parties have hereunto set their hands this

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for and in the Province of Davao del Norte, this
___________________________ at Sto. Tomas, Davao del Norte, Philippines, personally
appeared the aforementioned persons and exhibited to me their respective competent
evidences of identity numbers shown below their respective names and signatures
and represented to me to be the same persons who executed the foregoing Deed of
Conditional Sale of Land and that they acknowledged to me that the same is their free
act and voluntary deed.

This instrument consisting of two (2) useful pages including this page wherein
this acknowledgment is written has been signed by the parties together with their
instrumental witnesses on the left margin of each and every page thereof.
