IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH

CR NO.5535 OF 2013
DATE OF DECISION : 12th SEPTEMBER 2013

Amardeep Singh
…. Petitioner

Versus

Harveen Kaur

…. Respondent

CORAM : HON’BLE MR. JUSTICE L. N. MITTAL

****

Present : Mr. Arun Jindal, Advocate for petitioner.

****

L. N. MITTAL, J. (ORAL)

Husband Amardeep Singh has invoked the jurisdiction of this

Court under Article 227 of the Constitution of India by filing this revision

petition seeking expeditious disposal of divorce petition Annexure P-1 filed

by him against his wife Harveen Kaur-respondent and one Rakesh Kumar

as respondent no.2 (not impleaded as party to the revision petition)

I have heard counsel for the petitioner and perused the case file.

Scanty material has been placed on record, from which it

cannot be inferred as to who is responsible for the delay. However,

whatever has been placed on record depicts that the petitioner, having filed

the divorce petition dated 24.01.2009 in Delhi which now stands transferred

to Patiala, closed his oral evidence only on 23.05.2013 and the case was

adjourned to 30.05.2013 for tendering of documents by the petitioner.

However, what happened on 30.05.2013 and thereafter has not been

mentioned in the revision petition nor relevant zimni orders of the trial Court

in this regard have been placed on record. Be that as it may, prima facie it

appears that petitioner himself might have been responsible for the delay in

the progress of the divorce petition.

Nevertheless, since the lis pertains to matrimonial dispute

between the parties, it is required to be disposed of as expeditiously as may

be practicable.

Resultantly the instant revision petition is disposed of by

directing the trial Court to dispose of, in accordance with law, divorce

petition Annexure P-1 filed by the petitioner and petition Annexure P-2 filed

by respondent under Section 9 of the Hindu Marriage Act (both cases having

been consolidated) as expeditiously as possible keeping in view its docket.
