 BAC determines completeness of the bid;


 Bid Security in the prescribed form, amount and validity period;

 The ABC shall be the upper limit or ceiling for acceptable bid
price. There shall be no lower limit or floor on the amount of the
award.
 Statement of ALL Ongoing Government and Private Contracts;

agreements submitted by bidder
 The bidder shall bear all costs associated with the preparation
and submission of his bid, and the Procuring Entity will in no
case be responsible or liable for those costs, regardless of the
conduct or outcome of the bidding process;
 Prospective bidders may request for clarification(s) on and/or
interpretation of any part of the Bidding Documents. Such a
request must be in writing and submitted to the Procuring Entity
at least ten (10) c.d. before the deadline for the submission and
receipt of bids.
If the BAC determines that the LCB passes all the criteria for post-
qualification, it shall declare the said bidder as LCRB and
recommend to the HOPE the award of contract to the said bidder at
its submitted bid price or calculated bid price, whichever is lower.
 PCAB License and Registration;

Bid Evaluation
Decisions of the BAC at any stage of the procurement process may
be questioned by filing a request for reconsideration within 3 c.d.
upon receipt of written notice or upon verbal notification.
Pre-bid Conference
Failure to submit any of the post-qualification requirements on time
shall disqualify a bidder for award.
Within 10 c.d. from receipt of NOA the winning bidder shall enter into
contract with the Procuring Entity and post the requried

Protests shall be resolved strictly on the basis of the records of the
BAC. The HOPE shall resolve the protest within 7 c.d. from receipt
thereof.
In case of approval, the HOPE shall immediately issue the Notice of
Award (NOA) to the LCRB
 Unsealed or unmarked bid envelopes shall be rejected.
 Bidder, by the act of submitting a bid, shall be deemed to have
inspected the site, determined the general characteristics of
the contract works and the conditions for the Project and
examine all instructions, forms, terms, and project requirements
in the bid docs.
 The Procuring Entity will accept bids only from those that have
paid the applicable fee for the Bidding Documents at the
office indicated in the Invitation to Bid.

 Latest income and business tax returns; and
The first envelope shall contain the following technical
information/documents, at the least: (Procurement of Infra)
 Other appropriate licenses and permits required by law and
indicated in the bidding documents.
 The BAC shall open the first envelope in public to determine
each bidder's compliance with the documents required.
The BAC shall decide on the request for reconsideration within 7 c.d.
from receipt thereof. The bidder shall not be allowed to submit
additional documents to correct any defects in the bid submitted.
In the event the request for reconsideration is denied by the BAC,
the decision may be protested in writing to the HOPE within 7 c.d.
from receipt of decision, by filing a verified position paper
accompanied by the payment of non-refundable protest fee.
"Bidders shall submit their bids through their duly authorized
representative using the forms specified in the Bidding Documents in
two (2) separate sealed bid envelopes, and which shall be
submitted simultaneously. The first shall contain the technical
component of the bid, including the eligibility requirements under
Section 23.1 of th(e) IRR for the procurement of Goods and
Infrastructure Projects, and the second envelope shall contain the
financial component of the bid."
"All bidders shall upload and maintain in PhilGEPS a current and
updated the following Class "A" eligibility documents":
 Registration Certificate
 Mayor's/Business Permit
 Tax Clearance
 PCAB license and registration and
 Audited Financial Statements
"The Bidding Documents shall be prepared by the Procuring Entity
following the standard forms and manuals prescribed by the GPPB."
 Bidder's stated competence and experience, and its key
personnel to be assigned to the project
Post-qualification involves verification, validation, and ascertainment
of all statements made and documents submitted by the bidder with
the LCB using non-discretionary criteria, which shall consider, but not
limited to the following:
PLATINUM Membership
 Bidding documents shall be the latest edition prescribed by the
GPPB (5th Ed.);
 Non-attendance of the bidder will in no way prejudice its bid;
however, the Bidder is expected to know the changes and/or
amendments to the bidding documents as recorded in the
minutes of the pre-bid conference and the Supplemental/Bid
Bulletin.
Bid Submission
 The bidder or their duly authorized representatives may attend
the opening of bids.
Managing
Government
Procurement
 Sole responsibility of the bidder to determine and to satisfy itself
as to all matters pertaining to the Project, including: (a)
location and nature of the project; (b) climatic conditions; (c)
transportation facilities; (d) nature and condition of the terrain,
geological conditions at the site, communication facilities,
requirements, location and availability of construction
aggregates and other materials, labor, water, electric power
and access roads; and (d) other factors that may affect the
cost, duration and execution or implementation of the
contract, project or work.
 Technical Requirements - to determine compliance with the
requirements, including:
 Organizational chart for the contract to be bid;
 Failure of the contractor to commence repair works on
ongoing contracts within 7 c.d. and to complete them within 30
c.d. after receipt of the Procuring Entity's notice of defects and
deficiencies;
 Before submitting their bids, the Bidders are deemed to have
become familiar with all existing laws, decrees, ordinances,
acts and regulations of the Philippines which may affect the
contract in any way.
 Bidders are encouraged to attend the pre-bid conference to
ensure that they fully understand the Procuring Entity's
requirements.
Protest Mechanism

 BAC evaluates the financial bid to determine the LCB;
 Original copy of the bid form shall be typed or written in ink and
shall be signed by the bidder or its duly authorized
representative.

If the BAC determines the bidder with the LCB fails the criteria for
post-qualification, it shall immediately notify said bidder in writing of
its post-disqualification and the grounds for it.
Preparation and Submission of
Bidding
Documents
 PhilGEPS Certificate of Registration and membership (Platinum);
 Verification of availability and commitment, and/or inspection
and testing for the required capacities and operating
conditions, of equipment units to be owned/leased/under
purchase by the bidder for use in the contract under bidding,
as well checking the performance of the bidder in its ongoing
government and private contracts, if any of the ongoing
contracts shows:
 Omnibus Sworn Statement
The Procuring Entity shall issue the Notice to Proceed (NTP) with the
copy or copies of the approved contract to the successful bidder
within seven (7) c.d. from approval of contract.
 BAC considers computational errors and omissions to enable
proper comparison of all eligible bids;
(Blue Membership is no longer acceptable)
In case of disapproval of award, it shall be based only on valid,
reasonable and justifiable grounds under Section 41 of the IRR or RA
9184.
 Procuring Entity shall not assume any responsibility regarding
erroneous interpretations or conclusions by the prospective or
eligible bidder out of the data furnished by the procuring entity.
 Negative slippage of at least 15% in any one project or a
negative slippage of at least 10% in each of 2 or more
contracts;
Within 3 c.d. from the issuance of BAC Resolution recommending
award of contract to the LCRB, the BAC shall notify all other bidders,
in writing of its recommendation
The bidder with the LCB shall be notified by the BAC to submit the
following additional documents within five (5) c.d. from receipt of
notice:
 Failure of the contractor to commence repair works on
contracts with pending certificates of acceptance within 30
c.d. and complete them within 90 c.d. after receipt of the
Procuring Entity's notice of defects and failures; or
 Decisions of the BAC amending any provision of the bidding
documents shall be issued in writing through a
Supplemental/Bid Bulletin at least seven (7) c.d. before the
deadline for submission of bids.
 Bidder's responsibility to carefully examine all of the bidding
documents;
 Financial Requirements - bid price of the bidder, or the bidder's
NFCC
SPECS
 It shall be the responsibility of all Bidders who have properly
secured the Bidding Documents to inquire and secure
Supplemental/Bid Bulletin that may be issued by the BAC.
 Substandard quality of work as per contract plans and
specifications or unsatisfactory performance of the contractor's
obligations at the time of inspection.
 The BAC shall respond to such request by issuing a
Supplemental/Bid Bulletin, to be made available to all those
who have properly secured the Bidding Documents, at least
seven (7) c.d. before the deadline for submission and receipt of
bids.
Post-Qualification
 List of contractor's major equipment units, which are owned,
leased and/or under purchase agreements, supported by
proof of ownership or certification of availability of equipment
from the equipment lessor/vendor for the duration of the
project;
 NFCC Computation;
 List of contractor's personnel to be assigned to the contract to
be bid, with their complete qualification and experience data;
The HOPE shall notify the BAC and the bidder in writing of such
decision and the grounds for it. A request for reconsideration may be
filed by the bidder with the HOPE within 3 c.d. from receipt of notice
of disapproval.
PhilGEPS Registration
 BAC evaluates all bids on an equal footing to ensure fair and
competitive bid comparison. All bidders are required to include
the cost of all taxes, and other fiscal levies and duties which
shall be itemized in the bid form and reflected in the detailed
estimates.
Court action may be resorted to only after the protests shall have
been completed, i.e., resolved by the HOPE with finality.
