AFFIDAVIT OF WITNESS

I, ZENAIDA A. BATUMBAKAL, Filipino, of legal age, and with residence at House

4, Kapuyatan Subdivion, Brgy. Recodo, Zamboanga City, Zamboanga del Sur, do hereby
depose and state THAT:

1) I am regular customer and a neighbor of DIOSDADO A. CATUMBAL aka

"DODONG";

2) On or about 10:00 in the morning of May 22, 2017, I bought 2 kilos of rice
from Dodong's store and while I was about to leave, a man approached Dodong, I did not
bother looking because I was trying to count the money that I had left but I remember
hearing the man ask if Dodong had a lighter, and within a split second, the store became
crowed with law enforcers and the media;

3) I have been buying commodities from Dodong's store since it opened in

2015 and I have personal knowledge that Dodong never sold contrabands and he has
continuously showed a good reputation, and is very kind to every customer and to our
neighbors;

I executed this affidavit to attest the truthfulness of the foregoing facts and to
support the refutation of the Criminal Case against Diosdado alias “ Dodong” A.
Catumbal for violations of Sections 5 and 11 of Article II of R. A. 9165 otherwise known
as The Comprehensive Dangerous Drugs Act of 2002.
