AFFIDAVIT COMPLAINT

I, MR. ERNESTO UY, of legal age and with business address at #213 Biak-na-Bato,
Manresa, Quezon City, after having been duly sworn to in accordance with law hereby depose
and state:

1. That herein affiant is the authorized representative of the Complaint with powers to
represent the company to appear; testify; to enter into stipulation of facts; to enter into a
Compromise Agreement; to settle the criminal liability of the instant case; and to sign the
Affidavit of desistance. That said powers are hereby delegate by the company as reflected
in the Secretary’s Certificate is hereto attached as Annex “A”.
Photocopy of Hi-Purpose Corporation’s Mr. Zhi Wei Cai’s Special
Power of Attorney to Ernesto Uy is attached herewith and marked as
ANNEX “B”.

2. That from January to April 2014, the respondent Mr. Alex D. Aciss, with
business/residential address at Alex D. Aciss, Bldg., beside Riverspring School, #18
Esguerra St., Pinagbuhatan, Pasig City, Came to my office to replace his bounced checks
and in payment thereof, he issued, signed, and delivered to me the following post-dated
checks.

3. That however, contrary to his assurance and representation, the subject checks when
deposited for payment with Philippine Business Bank Head Office, Grace Park,
CALOOCAN CITY, were dishonored by the drawee bank for the reason: “Account
Closed” as may be gleaned from the stamp mark appearing on the face of the checks.
Photocopy of the front and back of the checks are attached herewith and marked as
ANNEXES “C”, “C-1”, “D”, “D-1”, “E”, “E-1”, “F”, “F-1”, “G”, “G-1”, “H”, “H-1”,
“I”, “I-1”, “J”, “J-1”, “K”, “K-1”, “L”, “L-1”, “M”, “M-1”, “N”, “N-1”, “O”, “O-1”, “P”,
“P-1”, “Q”, “Q-1”, “R”, “R-1”, “S”, “S-1”, “T”, “T-1”, “U”, “U-1”, “V”, “V-1”, “W”,
“W-1”, “X”, “X-1”, “Y”, “Y-1”, “Z”, “Z-1”, “AA”, “AA-1”, and “BB”, “BB-1”

4. That verbal and written demand were made thereafter upon Mr. Alex D. Aciss to
make good the said checks but he failed and refused and still fails and refuses to
make good the same, to my damage and prejudice. On December 5, 2016, I personally
served the demand letter dated December 1, 2015 to Mr. Alex D. Aciss at the front gate
of his residence in Alex D. Aciss Bldg., beside Riverspring School, #18 Esguerra St.,
near Urbano Ave., Pinagbuhatan, Pasig City. He received and read the demand letter
but refused to sign his name, still, I left a copy of the demand letter and made the
annotation of his refusal to sign.
Photocopy of the demand letter dated December 1, 2015 served personally to Mr. Alex
D. Acis is attached herewith and annotation are marked as Annexes “CC”, “CC-1” while
the Affidavit of Service of is hereto attached as Annex “DD” respectively.

5. On December 7, 2015, I personally went to Manila Post Office and mailed by registered
mail the demand letter dated December 1, 2015 to Mr. Alex D. Aciss.
Photocopy of the demand letter together with the registry receipt and return card are
hereto attached as Annexes “EE”, “EE-1”, “EE-2”.

6. I have executed this affidavit to attest to the truth of all the foregoing statements and for
the purpose of filing a complaint for violation of Batas Pambansa Blg. 22 against Mr.
Alex D. Aciss with the authorities.

In witness thereof, I have hereunto signed this instrument this _____ day of February
2019 in Caloocan, Philippines.
