AFFIDAVIT-CUM- DECLARATION – INDEMNITY

follows:
1. I/We hereby submit that I/we am/are purchasing the property bearing No.______________________ situated

(herein after referred to as “the Property”) from M/s./Mr/Ms/Mrs
____________________________________________, the developer/ owner/seller of the Property and
allotment letter / builder buyer agreement / agreement for sale / sale deed has been executed in my / our
favour.
2. I/We am/are availing housing loan from Tata Capital Housing Finance Limited, (hereinafter referred to as
“TCHFL”) for purchase of the Property by creating security by way of mortgage on the Property.
3. I/We am/ are aware that I/We will be eligible to receive subsidy under the “Housing for All” Scheme under
the Pradhan Mantri Awas Yojna (“Credit Linked Subsidy Scheme” or “Scheme”) subject to I/we fulfil the
conditions stipulated under the Scheme. I/We am/are aware that in case I/We am/are eligible to receive the
subsidy under the Scheme, the said subsidy amount shall be appropriated against my/our principal that is
outstanding under my/our home loan account and the amount shall be reduced accordingly.
4. I/We declare that the annual income of my / our beneficiary family as defined under the Scheme does not
exceed Rs.<__________> and I/We fall under EWS/LIG/MIG 1 /MIG 2 < ___________ >
5. I/We further declare that I / our beneficiary family does not own a pucca house (an all-weather dwelling unit)
either in my / our name or in the name of any member of my / our family in any part of India.
6. I / We confirm and declare that I/we or any of my/our family member(s) have not availed any central / state
assistance under any housing scheme of Central / State Government till date.
7. I/We am/are fully aware that on my/our aforesaid declaration / representation, TCHFL at its sole discretion
has agreed to sanction the housing loan facility to me/us under the Scheme.
8. I / We am / are made aware of the conditions of Credit Linked Subsidy Scheme guidelines and have fully
understood the terms and conditions applicable thereto and accord consent to avail the same.
9. I/We understand that in the event any of the aforesaid representation / declarations proved to be incorrect
and I/we am/are found ineligible under the Scheme or in case my/our loan contract is classified as Non-
Performing Asset by TCHFL or in the event where the said interest rate granted to me/us has been rejected by
the National Housing Bank, for any reason whatsoever or the allotment in favour of me/us has been cancelled
by the developer , TCHFL shall reverse the subsidy appropriated against my/our loan contract and at its sole
discretion either make us liable to make repayment of the entire loan sanctioned at the prevailing rate of interest
as per the revised repayment schedule or terminate the loan contract and recall the entire loan sanctioned along
with all other costs, charges and expenses etc as and when recalled by TCHFL in the aforesaid eventualities,
notwithstanding the term of the loan and securities availed thereon without any demur or protest.
10. Notwithstanding the above, I/We hereby irrevocably agrees and undertakes to indemnify TCHFL, and keep
TCHFL, its Directors and Officers indemnified, saved and harmless against any loss, damage costs, charges and/or
expenses suffered or incurred by TCHFL, arising on account of any misrepresentation made herein and/or any
of the aforesaid declarations proved to be wrong/ incorrect and by reason whereof the subsidy claimed under
the Scheme under my/our loan contract has to be reversed or refunded to National Housing Bank / the
government / any other concerned authority.
11. I/We understand that TCHFL shall also be entitled to take any action against me/us, whether under any law
or agreement as TCHFL may deem fit including recalling the entire loan along with interest, additional interest,
costs, charges, expenses, etc. thereon, if any statements contained herein found to be false or not adhered by
me/us.
12. I/We agree and confirm that the final sale deed to be executed by the developer/owner/seller should be in
my/our name and my/our details contained therein are the same as contained in the allotment letter/ builder
buyer agreement/agreement for sale. I/We agree that I/We shall handover/ cause to handover the original duly
stamped and registered sale deed directly to TCHFL.
13. I/We hereby declare that whatever I/we have stated in this Affidavit is true and correct to the best of our
knowledge, information and belief.
