CONTRACT OF LEASED

KNOW ALL MEN BY THESE PRESENT:


This Contract of Lease, made and entered into this_______day of at Makati City, by and
between:

L.P.LEVISTE & CO., INC a corporation duly organized and existing under and
by the virtue of the laws of the Philippines with postal address at Crown
Tower, 107 H. dela Costa Street, Salcedo, Village Makati City, represented herein
by its Vice President and gen. Manager, AMELITA L. DE LEON, hereinafter referred
to mas the ‘LESSOR;”

And
MARCO GALICIA BAUTISTA, of legal age, Filipino, with residence and postal address at Marawoy, Lipa
City, hereinafter the referred to as a “LESSEE”.

WITNESSSETH

WHEREAS, the LESSOR is the owner of house and lot situated at_____SQUARE METER LOT more
or less located bat Marawoy, Lipa City, hereinafter referred to as the LEASED PREMISES.

WHEREAS, the LESSEE desires to lease the LEASD PREMISES and the LESSOR is willing to lease
the same unto the LESSEE subject to the terms and conditions hereinafter specified:

NOW, THEREFORE, for and in consideration of the foregoing and mutual covenants herein
contained, the LESSOR has let and by these presents does hereby lease and let unto the LESSEE the
LEASED PREMISES and the LESSEE hereby accept the same by way of lease, subject to the following
terms and conditions:

1. Period – This Contract shall be for a period of Six (6) MONTHS beginning on July 01, 2019-
December 31, 2019. Unless otherwise agreed upon by written application at least sixty (60)
days before the end of the terms, this Contract shall terminate on the date of the term
stipulated herein.

2. RENTAL – LESSEE shall pay the LESSOR for the use and occupancy of the Leased Premises a
monthly rental of SEVEN THOUSAND PESOS (7,000.00), which monthly rental shall increase
by five (5%) on the second year if renew upon SIXTY (60) DAYS WRITTEN NOTICE and upon
mutual agreement of both parties.

Rental shall be payable monthly in advance within the first five (5) days of each month
without necessity of demand. Any delay in the payment of rental shall be charged a penalty
(3) consecutive months if and when the rental had become due and payable shall entitle
the LESSOR to rescind or cancelled this Contract, and the LESSEE bind herself/himself to
vacate the leased premise immediately, without prejudice on the part of the LESSOR or
collect whatever is due, from the LESSEE.
3. WATER, ELECTRIC BILL ETC. - All expenses for water, gas, and electric current shall be for the
account of the LESSEE.

4. IMPROVEMENTS – No permanent improvement is to be placed in the premises in as much


as the LESSOR may make use of the leased property after (1) year. The LESSEEE shall not
make any major structural changes, alternations or improvements in the leased premises
without the written consent of the LESSOR. However, any major alternations or
improvements made or introduced by the LESSEE in the LEASED PREMISES with the written
consent of the LESSOR shall, upon the termination of this contract automatically inure to
the benefit of the Leased premises and become property of the LESSOR without any
obligation on the latter’s part to pay or refund its value or cost to the LESSEE.

5. PURPOSES – The LEASED PREMISES shall be used only by MARCO GALICIA BAUTISTA for his
car exchange business purposes only.

6. SUB – LEASE-The LESSEE may not assign or sublease the leased premises to any other party
without the written consent of the LESSOR.

7. SANITATION AND REPAIRS -The LESSEE shall keep the LEASED PREMISES clean and in
sanitary condition. The LESSEE has inspected the LEASED PREMISES and found the same to
be in good and tenantable condition.

8. FIRE HAZARD AND OBNOXIOUS SUBSTANCE – The LESSEE hall not keep, deposit or store in
the LEASED PREMISES any obnoxious substances or inflammable materials or substance
that might constitute a fire hazard.

9. TAXES AND INSURANCE – Real ETATE taxes and Government Assessment charges shall be
for the LESSOR’s account.

10. THIRD PARTY LIABILITY – The LESSEE during his occupancy of the LEASED PREMISES shall
hold the LESSOR free and harmless from any damage or liability or responsibility to any
person or property arising out of or a consequence of the use of the LEASED PREMISES by
the LESSEE, his agent, employee, domestic helps and guest, when such damage or liability is
caused by fortuitous events or acts of God Such as typhoon, earthquake, or flood etc ,
which are beyond the control of the LESSEE, the latter shall not be liable to the LESSOR.

11. SALE<,TRANSFER AND MORTAGE – In the events of sale, transfer, mortgage or any other
encumbrance of the LEASED PREMISES, or any existing sale, transfer, mortgage or
encumbrance of the same , the LESSOR shall warrant that the purchases, mortgage or
encumbrances shall respect all the terms and conditions of this lease agreement including
the provision for renewal thereof. Notwithstanding any conveyance or title over the leased
premises to a third party (pursuant to or as a consequence of any such sale, transfer,
mortgage or other encumbrance), the LESSOR shall however, continue to be bound by this
undertaking in favor of the LESSEE TO RETURN or REIMBURSE to the LESSEE any advanced
rentals and/or deposit under the circumstances, unless such third party has expressly
assumed in writing the LESSOR’S said undertaking and such assumption is accepted by the
LESSEE.
12. RETTURN OF PREMISES – Upon the termination of this contract for any reason whatsoever.
The LESSEE shall immediately vacate the LEASED PREMISES and return possession thereof to
the LESSOR, upon the latter’s request, unless the Contract of lease is extended. The LEASED
PREMISES shall be returned by the LESSEE to the LESSOR in a clean and orderly manner and
in the same good and habitable condition, reasonable wear and tear expected. Cost of such
cleaning shall be for the account of the LESSEE.

13. Any violation of the terms provided for in this contract on the part of the LESSEE or LESSOR
shall be sufficient ground for the termination of the Contract of Leased by the aggrieved
party.

IN WITNESS WHEREOF, the parties hereto have signed these presents on the date
and at the place first above mentioned or written.
