General statement:

We need to urgently address underage use of vapor products and earn the trust of regulators,
policymakers and other stakeholders. That is why we are focusing on taking aggressive actions to reduce
the access and appeal of our products, working through the PMTA process and supporting and
complying with FDA’s final guidance on flavored products once effective.

When K.C. Crosthwaite joined JUUL Labs as CEO last month, he said: “I have long believed in a future
where adult smokers overwhelmingly choose alternative products like JUUL. That has been this
company’s mission since it was founded, and it has taken great strides in that direction. Unfortunately,
today that future is at risk due to unacceptable levels of youth usage and eroding public confidence in
our industry. Against that backdrop, we must strive to work with regulators, policymakers and other
stakeholders, and earn the trust of the societies in which we operate. That includes inviting an open
dialogue, listening to others and being responsive to their concerns.”

JUUL Labs actions to combat underage use:

• We strongly advocate for Tobacco 21 legislation, stopped the sale of non-tobacco and
non-menthol based flavored JUULpods to our traditional retail store partners, enhanced our
online age-verification process, strengthened our retailer compliance program with over
2,000 secret shopper visits per month, and shut down our Facebook and Instagram accounts
while working constantly to remove inappropriate social media content generated by others
on those platforms.

• We recently announced the deployment of technology at retail stores that automatically


restricts the sale of JUUL products until a government-issued ID is electronically scanned to
verify age and ID validity. This technology also limits the amount of JUUL products that can be
purchased to prevent reselling or sharing to those underage, and it will be mandatory for all
JUUL product sales across the country.

• Most recently, we suspended the sale of non-tobacco and non-menthol-based flavors in


the U.S. Previously, they were made available by JUUL Labs in the U.S. only at JUUL.com,
which has strict age-verification controls.

Statement on Hill hearing:

The two student presentations we made were part of our short-lived Education and Youth Prevention
Program which was ended in September 2018 after its purpose - to educate youth on the dangers of
nicotine addiction - was clearly misconstrued. In November, we launched our industry leading plan to
combat youth vaping.

Statement on marketing:
We never designed our marketing to appeal to youth and do not want any non-nicotine users to try our
products as they exist to help adult smokers find an alternative to combustible cigarettes. We need to
urgently address underage use of vapor products and earn the trust of regulators, policymakers and
other stakeholders. That is why we are focusing on taking aggressive actions to reduce youth usage of
our products, working through the FDA's PMTA process and supporting and complying with FDA’s final
guidance on flavored products once effective.

Most recently, we suspended all broadcast, print and digital product advertising in the U.S. as part of a
broad review of the company’s practices and policies to ensure alignment with its aim of responsible
leadership within the industry.

Statement on UC Riverside study:

This study used an unrealistic in vitro (i.e. cell culture) model for human exposure to nicotine
and as a result it produced potentially misleading and unreliable conclusions. The researchers
exposed cells to a nicotine concentration approximately 10,000 times higher than nicotine levels
measured in human plasma after either cigarette smoking or the use of smokeless tobacco
products (as reported in the 2014 U.S. Surgeon General’s Report). In addition to these extreme
exposure levels, the researchers continuously exposed cells to nicotine for 4, 24, and in one
case 72 hours in a static, closed environment with no ventilation or flushing mechanism, which
also fails to realistically mimic how the human body functions. Taken together, it is not surprising
these extreme and unrealistic conditions resulted in cell damage. The experiment was so poorly
designed it provides little to no relevant and reliable evidence regarding effects of realistic
human exposure to vapor products.

Several previous in-vivo (animal or human) studies — Werley et al., 2016; Randazzo et al.,
2017; Lee et al., 2019 — have measured nicotine’s effect and not found similar effects.
