Whereas, the right of every person to a clean and wholesome environment is a fundamental right
guaranteed in the Constitution;
Whereas, it is the primary responsibility of the state to promote the general welfare of the people
as well as its full enjoyment;
Whereas, it is also a policy of the state to afford full protection and advancement of the right of
the people to a healthful and balanced ecology in accordance with the rhythm and harmony with
nature;

Whereas, recyclable wastes are few of the wastes we dispose in our day-to-day activities, more
vividly in establishments and even households;
Whereas, the amount of waste products are increasing and improperly disposed without the
recycling, pose a nuisance to the environment in a way that these wastes take time to decompose
that contribute to greenhouse effects, wayer pollution and air pollution;
Whereas, to safeguard and conserve our environment, there is a need to have a proper recycling
process of these waste products with the contribution and cooperation of the local government
agencies, the citizens and the establishments in the locality.
Section 1. Title:
Section 2. Purpose:
“Basuranihan” is coined from the term “Basura” which mans waste and “Bayanihan”
which is a filipino culture of cooperative effort.
This Ordinance aims for the fulfillment of the shared mandate and responsibility of the
local government of San Miguel together with its constituents including People’s organizations,
establishments, partnered junk shops, Barangay Officials, Non-government organizations and
private sectors in the management and maintenance of the ecological balance, preservation and

protection of our environment through the monthly collection by the partnered junk shops of
recyclables (metals, glass, paper, cardboard, plastic, tires, textiles, batteries, and electronics) in
the registered households and establishments through the initiative of barangay council
specifically the duly designated environmental officer. This should organize and strengthen the
proper recycling of the waste products because throwing away things wastes resources. It wastes
the raw materials and energy used in making the items and it wastes money. Recycling through
individual and government efforts means less harmful environmental impact, less resources and
energy used and saves money. Recycling helps to reduce the pollution caused by waste. This shall
also foster the cooperation and involvement of each household and establishment in the
protection, preservation and rehabilitation of the environment with the help and initiative from
the government.
Most importantly, this should provide incentives and penalties to strengthen the
enforcement of the ordinance.
b. Environmental Officer - member of the barangay council that shall be duly assigned to
oversee the registration and implementation of the ordinance. He shall also coordinate with the
Municipal Environment and Natural Resources Office (MENRO)
d. Household - a social unit composed of those living together in the same dwelling

e. Junk Shop - a business or an establishment that is engaged in buying and selling old
metal and other materials that can be use for new purposes.
f. MENRO - stands for Municipal Environment and Natural Resources Office, a government
office that takes charge of the management, conservation, preservation and protection of the
environment and natural resources of the municipality. In this ordinance, it shall be the head
implementing body that will monitor every step of the program from registration, monthly
collection, yearly awarding and imposition of penalties.
g. Recyclable wastes - these are recyclable materials or products that can be used again
after they have been treated using a special industrial process.
Section 4: Coverage:
The Ordinance covers all establishments and households within the jurisdiction of San
Miguel, Iloilo.
Section 5: Implementation
The MENRO shall coordinate with the Barangay Council and shall oblige them to designate
an Environmental officer who is one of the barangay council officers. The MENRO should also
coordinate with the partner-junk shop who would participate in the implementation of the
ordinance and will conduct the monthly collection of recyclables in every barangay together with
the designated environment officer.

All households shall be registered through enlisting themselves to the registration sheet
with the Environmental Officer. The registration sheet will be forwarded to the MENRO. The list
should be updated every year in order to ensure that every household will actively participate.
All establishments shall be registered directly with the MENRO. The list shall also be
updated every year.
In each household and establishment, the recyclables should be placed in a white sack
which should be put outside their household or establishment every collection schedule. The
environmental officer and the partner-junk shop shall collect the recyclables every 3rd week of
each month. The MENRO shall provide for the list of the barangay where the collection will be
made each day during the 3rd week of the month.
During the collection, the environmental officer will record the weight in kilograms of the
collected recyclables in each household. This will be tallied at the end of the year for the awarding
of the top 3 households with the most recyclables collected. The establishments who religiously
complied with the ordinance shall also be given a “Basuranihan Award”
The awarding of the top 3 household, Top 3 Basuranihan Barangay, and Basuranihan
Award for the establishments shall be held every December during the Municipal Agro Fair.
There shall be a close monitoring of the activities in adherence to the ordinance which
shall be made by the Municipal Environment and Natural Resources Office. Any environmental
change or hazard attributed to the project implementation shall immediately addressed. There

shall also be data sheet where the yearly volume of the collection will be recorded to assess the
impact and to address points of improvement in case there will be a low participation. The
MENRO together with the participating barangays should take initiatives to encourage and
maximize participation.
The MENRO shall also provide technical assistance to barangays, commercial, industrial
and institutional establishments and other major point sources in the development of internal
monitoring and evaluation systems.
Upon Approval of this Ordinance, the city shall conduct a massive information campaign
in order to educate its residents about the benefits of recycling waste products and the effects
of using too much single use plastics and other non-biodegradable materials to the environment.
Section 8: Incentives
The MENRO will implement a redemption scheme for recyclables. Redeemable price
stubs shall be given for recyclables submitted by every household and establishments. These
price stubs may be redeemed after the recyclables for which they have been issued have been
traded or sold. The MPDC/MENRO shall prepare the mechanics for the redemption scheme.
Awarding should be held every December during the Agro Fair where Top 3 households
with the most number of contributions of recyclables will be given a gift package to be
determined by the MENRO.
Top 3 performing barangay with the most number of participating household and the
most number of total contribution should be recognized by giving a Basuranihan Award.
At the end of the year, the establishment who actively participated based on the records
of the MENRO will be given a 15% tax exemption in accordance with the existing laws and
regulations. They shall also be given a Certificate of Compliance to the Basuranihan Program.

Rendering six (6) hours of voluntary community service and/or one (1) day ESWM seminar;
The City government shall allocate funds for the effective implementation of this
ordinance.
Within thirty (30) days from the approval of this Ordinance, the Mayor may issue the
necessary IRRs for its proper and effective implementation.
All ordinance, issuances, rules and regulation, or parts thereof which are inconsistent with
or contrary to the provisions of this ordinance are hereby repealed, amended or modified
accordingly.
If for any reason, any section or provision of this Ordinance is declared illegal or
unconstitutional, the other sections or provisions hereof which are not affected shall continue to
be in full force or effect.
This ordinance shall take effect fifteen (15) days after its approval and complete
publication in a newspaper of local or general circulation. The full text of this Ordinance shall

likewise be posted in at least two (2) conspicuous places in the City Hall of Iloilo City in compliance
with the posting requirement mandated by the Local Government Code.
