Complaint against Shri Muddassar Bhat

Sub: Apprehension for implication into a false criminal case by the tenant at
second floor, B-15A, Kiran Garden, Matiala Road, New Delhi-110059 and
initiating appropriate legal action for intimidating me and my family.

I am a very senior citizen in age of 80’s and r/o B-15, Kiran Gaden, First floor,
(Rear Portion) Matiala Road, Uttam Nagar, New Delhi-110059. I am a retired
senior bank officer.

The said tenant is Shri Muddasir Nazir Bhat son of Shri Nazir Bhat residing at
present G-83/B-3, Kiran Garden, Uttam Nagar, New Delhi and he is tenant of my
son Shri Anil Kumar Gambhir. My son has let out his office at second floor of B-
15A, Kiran Garden, Matiala Road, Uttam Nagar, New Delhi-110059 to him vide
registered rent agreement dated 15.11.2018. The tenant is originally resident of
SEER HAMDAN,ANANTNAG, KASHMIR.

In Feb’2019, Mr. Muddasir has orally requested me to allow him to

store his old furniture and aluminum frames for a few days in our vacant office
space at first floor of the aforesaid premises. He has also promised me to vacate
as and when I need it. Considering his past cordial relations, I have acceded to his
request on humanitarian grounds. I have allowed him to store his goods for free of
rent. Possession of the said premises has never been parted with. I locked the
premises for safety of his stored goods but I have always kept the keys with me
because I have no attention to part with possession of the said space in any
manner.

Subsequently, Mr. Bhat approached with another request to allow him to

raise ‘aluminum structure’ temporarily to shoot it for web-site in order to attract
corporate bodies to derive business being carried out at second floor. He has also
assured me that he shall remove the said temporary raised structure by the same
evening. So I have trusted him again. But he has taken a long time to dismantle
the said structures explaining that he is on look out for a godown to shift his
belongings there. His dilly-dally tactics have made me worried. I have plainly asked
him to leave my space at the earliest possible. He has become rude and bluntly
refused to vacate the premises. His attention to cheat me has been exposed
widely.

Yesterday late in the evening, the said Mr. Bhat has threatened me of dire
consequences if I do not let out the said space on rent. He shall file police report
also against me and my son for theft of some of his belongings. It is unfortunate
that I have received a threat of theft, that too, in my later stage of age whereas my
entire long service career has never come under clouds. Obviously, I have become
panicky also in my old age.

In apprehension of the threat, I consider my duty to place the true facts

before your good office and request the concerned authorities to initiate legal
action for intimidating me and my family. Further, I trust also that authorities shall
consider his false FIR, if filed against me or my son on theft charges in light of the
facts, stated hereinabove.

Pesent Position.

Mr. Bhat has kept some furniture and aluminum goods in my custody in Feb/Mar2019.
He wanted its delivery on 24.06.2019 and he has issued me two cheques of Rs.40000/- each
towards payment of rent for the premises occupied by him at fist floor.

I have delivered him some of above goods on 24.06.2019 and has kept aluminum
material with me as security. I hold the lien on the those goods till final recovery of the dues. In
case cheques are returned unpaid for any reason, I shall continue holding the lien on the said
material and to proceed legally to recover my amount.

Matter regarding storing goods:

On 16.02.2019, Mr. Muddasir has informed that he intends to shift shortly to a larger
office where he shall expand his business. Simultaneously, he has told me that he has purchased
old furniture and aluminum fittings for furnishing his new office where terms of tenancy are still
under negotiations. He has sought my permission to keep his said goods in my vacant space at
first floor for a few days only.

I was reluctant to accept his request because the said space has been kept purposely
vacant for my son’s business-project to be launched from 1st April, 2019. But Mr. Mudassir has
continued pursuing me with a promise to shift to new office by end of Feb, 2019.
Trusting his words, I have accommodated him on humanitarian grounds and he has
stored his said goods under my lock & key for a few days only. Possession of the premises in any
manner has not been parted with. I have kept the premises locked and its key has always been
in my custody.
On 25.02.2019, he has informed me that tenancy of new office could not mature but he
has found a godown where he will shift his goods. But before shifting, he wants to shoot a
picture of the said space for web-site for which he shall raise ‘temporary structure’ within 4-5
days to give a look of a corporate office. He needed the shoot for web-site attracting MNC to
derive business from them. He has assured me that he will remove the said structures by the
same evening after shoot. I have trusted him again and I have accepted his request.
Mr. Muddassir has taken a long time to complete the structure on execuse of labour-
problem. Shoot was completed by 3Ist March, 2019. He has dismantled it also in next 4-5 days
but has not removed the dismantled material.
My son’s business-project has been unduly delayed for and he has been suffering
financial loss for each day delayed. I became angry over his dilly-dally tactics. He also became
sharp and has bluntly refused to shift.
 On 29.5.2019, he has given threat of making allegations of theft of some of his goods
either by me or my son. I have filed a complaint on line in this regard with SHO, Bindapur Police
Station, Dwarka on 31.05.2019. His intention to grab my space free of rent has widely been
exposed, whereas the said space was reserved for my family business. I have then realized that I
have been cheated.
