DEPOSITION OF WITNESS

I, Victoria Buenaventura Ramos of legal age, native of Sitio Tambis , Buanoy,

Balamban and temporarily residing at Villa Parda , Toledo City, Cebu, after having been
duly sworn to testifies as follows;

1. On March 23, 2009 at about 9:00 o’clock in the evening while I was at the
residence ofregor located at Zone 3, Spillway, Greenland, Concepcion
Pequeña, Naga City and while Bong, Teddy Cayonte and three (3) others
were having a drinking spree thereat, a teenager known only to me as Gerome
purchased Three (3) small “sachet” of suspected marijuana from Bong, worth
One Hundred Pesos (P100.00);

2. I have noticed that the money which was given to Bong by Gerome was
handed by the former to Rose Nava, then Bong get inside the bedroom of
Rose Nava and upon return gave Three (3) sachet of suspected marijuana to
the buyer “ Gerome”.

3. This is not the first time I saw Bong and Rose selling marijuana at there
house, But for several times already in fact, it is not only Bong & Rose, but
also Baby, Jojo, and Archie (Children of Rose) who were all residing at said
house except for Jojo who is residing just several meters away from the
residence of Rose.

4. During those incidents, I had noticed also that their stuff were being kept
inside their rooms and the stuff is being sold openly.

5. On April 09, 2001, I reported the matter to PSINSP ERROL P

GARCHITORENA, Chief, Operations Branch, Naga City Police Station.
Said Police Officer convinced me to help them purchase marijuana from
subject persons.

6. I yielded to his request and after a short briefing on or about 5:30 Pm of April
9, 2001 I bought One (1) sachet of marijuana from Rose Nava worth Fifty
Pesos (P50.00) while PSInsp. Errol Garchitorena was conducting surveillance
on us.

7. Thereafter, I turned over the marijuana to PSInsp Errol Garchitorena for drug
testing.

APPLICATION FOR SEARCH WARRANT

The undersigned PSUPT GENESIUS DELA FUENTE MOLTO Chief of Police of

Daraga Municipal Police Station , and duly Deputized by Philippine Drug Enforcement
Agency (PDEA) as Municipal Drug Enforcement Officer, after having been duly sworn
to in accordance with law hereby depose and say;

1. That RENE GUAN alyas “TIKBOY” and RODERICK MADRILEJOS

alyas “ SKILL BOY ”who may be found at a shanty/makeshift carenderia
extension at vicinity Baylon Compound, Arellano Extnsn, Daraga, Albay are
in possession and engaged in selling and distribution of
METHYLAMPHETAMINE HYDROCHLORIDE commonly known as
SHABU and CANNABIS (Marijuana) .

2. That said RENE GUAN alyas “TIKBOY” and RODERICK MADRILEJOS

alyas “ SKILL BOY ” have no authority to possess, sell and distribute such
prohibited drugs and that same are being kept and concealed inside the
premises as specifically indicated in the sketch prepared and certified to by
the witnesses.

3. That a SEARCH WARRANT should be issued to enable any authority and/or

agent of the law to take possession and bring to this Honorable Court the
following described properties, to wit :

………….. Methyamphetamine Hydrochloride (SHABU)

………….. Cannabis (MARIJUANA leaves and seeds and or
fruiting tops)

WHEREFORE, the undersigned pray the Honorable Court to issue a search warrant
authorizing him and his agent to search the above – name persons and the residence and its
immediate vicinities at said address and to seize and bring to this Honorable Court the article
above described to be dealt with as the law directs.

TO ANY OFFICER OF THE LAW:

G R E E T I N G S:

It appearing to the satisfaction of the undersigned after examining the witness

under oath that there is a probable cause to believed that Violation of RA 6495 otherwise
known as the Dangerous Drug Act of 1972, As amended, have been committed by the
respondent Rose Nava aka Rose Vargas, Baby Doe and Bong Doe and that a sizeable
quantity of marijuana leaves, seeds and fruiting tops packed in a plastic packets are being
kept by them either in their person and/or in the house located at Zone 3 Spillway,
Greenland, Concepcion Pequeña Naga City. You are hereby commanded to make an
immediate search, any time of the day or night, on the person of Rose Nava aka Rose
Vargas, baby Doe and Bong Doe and the premises above described and seize, take
position of the above – mentioned articles and to bring the said article to the undersigned
to be dealt with as the law direct.

The Search Warrant is valid for Ten (10) days from date of issue.
