Application

Dear Mr. Eisenberg:

On behalf of One Miami Biscayne Bay/Arts District Hotel, LLC, (the “Applicant”), we
respectfully submit this letter of intent in connection with the enclosed Application for UDRB
design review of the proposed redevelopment of the property located at 511 NE 15*“ Street,
(Folio No. 01-3231-009-0010) (the “Property”). The Property is 0.27 acres and has frontages on
NE 15m Street and North Bayshore Drive. The Future Land Use designation of the Property is
Restricted Commercial and its zoning designation is T6-36B-O. The proposed development of
the Property includes constructing a 3l~story hotel with 269 lodging units, related amenities
(including 28,261 square feet of meeting rooms, ballrooms and restaurant space), and 16,131
square feet of leased office space (the “Project”).

To relieve the practical difficulties of complying with the strict requirements of the
Miami 21 Zoning Code (“Miami 21” or the “Code”), the Applicant is applying for the following
waivers :

a. Reduction in rear and side setbacks above the 8th floor. Pursuant to Section
5.6.1.h of the Code, side and rear setbacks above the eighth floor may be reduced from thirty
(30) feet to twenty (20) feet by waiver for lots having one dimension one hundred feet or less.
The Applicant is proposing reducing the side and rear setbacks above the eighth floor to twenty
feet. The dimensions of this Property, which are 100 feet by 115.41 feet, are precisely the
condition anticipated by the drafters of the Code when they provided for this waiver. Without
this waiver, it would otherwise be very difficult to develop this Property in an efficient manner.

b. Reduction in parking for properties within 1/2 mile of TOD. Article 4, Table
4 of Miami 21 requires one parking spaces for every two lodging units, plus one additional
visitor parking space for every fifteen lodging units. It also requires 1 parking space for every
800 square feet of office space as well as 3 parking spaces for every 1,000 square feet of
commercial space. With the shared parking reduction, the Project is required 164 parking spaces,
