On May 31, 2019, the San Juan County Clerk/Auditor on behalf of San Juan County responded to your request; on June 20, 2019, you filed a timely appeal of that response per U.C.A. 636(2)(401) via email Your appeal states: “I really hope that based on what Commissioner Maryboy, and Mr. Boos said in the news articles about myself that there are more documents that will back their claims.” | interpret this to mean that you are asserting that the records provided to you were missing some responsive records. As the Chief Administrative Officer of this governmental entity for the purposes of GRAMA- related matters, | made inquiries regarding the process by which records were identified, collected, and classified regarding your request. Upon review, | am satisfied that the County: 1. Properly evaluated emails sent to you at kpehrson@sanjuancounty.org to discern if any of those emails were potentially responsive records to your request; 2. Engaged in reasonable efforts to retrieve and review potentially responsive records in the form of correspondence (including text messages) from Commissioner Maryboy; 3. Engaged in reasonable efforts to obtain any reports made to Walter Bird by Commissioner Maryboy about you; and 4, Engaged in reasonable efforts to review any potentially responsive records in the form of correspondence (including text messages) between Commissioners Maryboy and Grayeyes. No additional records that would be potentially responsive to your original request have been identified at this time. Therefore, | affirm the response provided to you by the Clerk/Auditor. Section 63G-2-402, to the State Records Committee or district court. if you appeal to the State Records Committee, you do not lose or waive the right to seek judicial review of the decision of the State Records Committee. ‘According to U.C.A. Section 63G-2-403: (1)(a) A records committee appellant appeals to the State Records Committee by filing 2 notice of appeal with the executive secretary of the State Records Committee no later than 30 days after the date of issuance of the decision being appealed. (b) Notwithstanding Subsection (2)(a), a requester may file a notice of appeal with the executive secretary of the State Records Committee no later than 45 days after the day on which the record request is made if: (i) the circumstances described in Subsection 63G-2-401(1)(b) occur; and (il) the chief administrative officer fails to make a decision under Section 63G-2-401.
