June 20, 2019 David Everitt San Juan County Administrator PO BOX9, Monticello UT 84535, GRAMA REQUEST APPEAL Dear Mr. Everitt, | received John David Nielson’s response to my GRAMA request dated May 31, 2019. This is my formal response in requesting an appeal to his findings. | have attached my original GRAMA request, however | will go through what | am requesting from you. | really hope that based on what Commissioner Maryboy, and Mr. Boos said in the news articles about myself that there are more documents that will back their claims, | am entitled to those documents and | will be appealing this GRAMA request to the State Archives if | need too. In no way are these documents attorney client privilege, they are public documents. Here is what | have requested and received nothing from John David Nielson that answers my request: 1)Based on quotes from the Salt Lake Tribune article dated May 1%, 2019 (I've attached it), Commissioner Maryboy is quoted that he has been “emailing me , and | didn't do what | was being told” ‘a, I would like all emails from Kenneth.maryboy.13@gmail.com or kmaryboy@sanjuancounty.org to kpehrson@sanjuancounty.org that would have told me what to do? 2) Based on the same news article Steven Boos is quoted that he “echoed Maryboy's assessment that Pehrson had engaged in insubordination. a. I would like all text messages, emails, letters, etc. that Kenneth Maryboy sent to Mr. 800s talking about me being insubordination? He has two cell phones: (435-558-5115) and the county phone 435-459-9281. | am subject to any talk about my insubordination from these two phones, or the two email accounts stated above. b. Mr. Boos is also quoted as saying that “Mr. Maryboy sent me a number of memos asking Mr. Pehrson to provide updates (on the assignments, these reports were not provided.” | would lke all Memos that he is stating that Commissioner Maryboy sent me, | am ‘guessing to kpehrson@sanjuancounty.org from his two emails stated above, 3) Ina press release from Commissioner Maryboy and James Adakai (see attachment), Mr. Adakai states, “Mr. Pehrson had not been willing to take direction from the new County Commission and execute its priorities, and his abrupt resignation laws weeks was not earth-shaking news.”a. I would like all emails, text messages, letters, etc. from Commissioner Maryboy to Mr. ‘Adakai, from the emails stated above and the cell phones stated above to Mr. Adakai talking about my behavior and has my name in it. 4) In the same Press Release, Commissioner Maryboy is quoted, " | had to repeatedly ask Pehrson to update the Commission regarding progress he'd made towards complying with approved County resolutions, including providing a County organizational chart, a policies and procedures ‘manual, and updates on ongoing County projects, to no avail,” a, I would like all emails, text messages, letters, etc. from Kenneth Maryboy to myself, asking me about these items stated in #4. | would assume they came from the emails, stated above or the cell phones stated above. 5) Commissioner Maryboy goes on to say, “if Pehrson had not resigned we would have taken disciplinary action. a. I would like all reports given to Walter Bird (San Juan County HR Director) on any complaints, disciplinary actions, emails, letters, texts, etc. from Kenneth Maryboy stating that | was being disciplined or was insubordinate, b. I would like all phone calls, emails, texts letters, etc. between Kenneth Maryboy and Commissioner Grayeyes, stating | needed to be disciplined, or | was insubordinate, etc Commissioner Grayeyes phone number is 928-614-1281. His county email addresses are «williegrayeyes@yahoo.com or williegraveyes@sanjuancounty.org 6). I would like a signed copy of the resolution that was passed illegally at the commission meeting on May 7 that had to do with the emergency hire of my replacement and which has my name init stating | did not do things for the commissioners. | did receive #6, however it brings us more items that | would like to request that are in this Resolution: A) Resolution 2019-03 It says | was supposed to compile documents concerning the conveyance of the Bluff Transfer Station. a. I would like a Copy of the Resolution with the date that it was approved. ( | would read the resolution on the date the commissioners wanted that and compare it to the date that it was actually passed) (Also this conveyance was approved by previous commissioners and the only document would have been the deed of trust, there were no financial documents to provide the commissioners, so very unclear what Mr. 800s was even asking for there) 'b. I would also like San Juan County's legal review of this resolution which was prepared by Mr. Laws, and given to San Juan County Commissioners. B) Resolution 2019-05 “send a copy of the resolution 2019-05 to the Secretary of the Interior and interested government agencies. a, would like a copy of this passed resolution. b. want a copy of San Juan County's legal review on this resolution which was prepared by Mr. Laws and given to San Juan County Commissioners. (Very confident that this resolution was being reviewed by Mr. Laws and there was nothing I could have done as the Administrator).Q ) &) Fy) Thanks Resolution 2019-07 Live Streaming of County Commission . | would like a copy of the approved Live stream resolution and also the date when San Juan County started to live stream commission meeting. | am pretty confident we started live streaming before the resolution was even passed. Resolution 2019-09 prepare a County Organizational Chart a. I would like a Copy of the approved Resolution, b. I would like the date when | had Natalie Freestone prepare the updated hard copy of the entire County organizational chart and the date when I handed each commissioner a hard copy at a Commission Meeting. Again | am pretty confident that it was prepared and given to them before the Resolution was even approved. It states that Whereas Mr. Pehrson did not complete most of the assigned tasks, and when asked by the Commission Chairman, Kenneth Maryboy, to provide a status report on his, progress in completing assigned tasks, he failed to provide a report. a. would like all documents, emails, letters, texts, etc...of any communication that Mr. Maryboy asked me to give him a status report and | failed to report it???? On April 26, 2019 Chairman Maryboy request that Mr. Pehrson prepare a transi memorandum listing his current projects, the statues of those projects and the County Staff assigned to work on them, however Mr. Pehrson declined, in writing , to provide a transition memorandum, a.
