Introduction including overview of area inspected and activities taking place

The Health and Safety inspection was carried out by me on 9th October 2018
between 9:30 am to 11:30 am at area of work under LIMS constructions. The site is
approximately covered of 3 acre. The scope of the inspection is to highlight area of concern
of serious accidents and near misses in past month.

During time of inspection around 400 workers including engineer, supervisor


and other managerial staff were seen inside the work site. The several activities were
observed in construction site like excavation procedure, transportation of bricks and other
materials, carpentry works, machinery operation, workers at height, welding operation and
drilling operation. The workers are using equipments like hammer, chisel, electric disc cutter,
cement mixer and ladder as part of their work and lifting equipments like crane, forklift were
also observed.

Inspection has been conducted based on visual inspection, interviewing the


workforce and checking various records like investigation report of previous accident that
had happen in the workplace, whether the high risk activity are going on under PTW system,
SSOW document to overview the Health and Safety culture of the organisation.

Executive Summary

The main objective of this inspection was to identify major hazards that
result in incidents in a work site for past month. During inspection following job were being
undertaken excavation work , drilling operation, welding activity, carpentry works, concrete
work, transportation of materials, and other machinery operation.
The inspection clearly indicates that there are many hazards which are
not taken seriously by management.
1) VEHICLE HAZARD: The vehicles travelling close to excavation region at high speed.
Due to lack of barricade in place , lack of supervision, no proper warning signage the
vehicle may fall into excavation region causing serious injury or even fatality to
workers.
2) WORKING AT HEIGHT: A person carrying out welding operation at approximately
5m height in an improper platform, the person may fall which result in serious injury
like bone fracture or even fatality.
3) ELECTRICITY HAZARD: The workers carrying out maintenance activity on a faulty
electrical equipment, as a result electric shock or shock burn may occur to electrician
which leads to serious injuries or even fatality.
4) FLAMMABLE CHEMICALS HAZARD: The flammable chemical substance stored
with other combustible materials near to work place were machinery operation is
going on, as a result sudden explosion may occur which leads to fatality.
5) MACHINERY HAZARD: A man working on a bench top grinder with unprotected
guard, which result in serious injury like cuts, amputation, and entanglement.
As per ILO C167 Health and Safety in Construction Convention 1988 and
Indian Factory Act 1948, implementation of control measures to reduce accidents in
work place have been recommended. The management have the moral responsibility
to take care of their workers under SSOW, give training and supervision to protect
people from serious injury as far as reasonably practicable. The management should
comply with legal laws to ensure that they don’t suffer from financial loss and to show
a positive health and safety culture.

Main findings of the inspection

1.OBSERVATION 1 (Vehicles moving around a excavation region at high speed):

Many vehicles are moving around an excavation area at high speed where no barricade in
place. The area is under a supervision of inspector, but he is not accessing the condition.
The workers were also busy in their on activity. The vehicles following an east route for
reaching the work site. The vehicles may be trapped in excavation region or there is a
possibility of skidding which result in serious injury or even fatality to people working in that
region. It may also lead to damage to underground buried service during the excavation
work causing explosion and flooding.

Legal Breaches are:


 Motor Vehicle Act 1988.
 Article 16, C167- Safety and Health in Construction Convention, 1988(No.167)
 Article 19, C167- Safety and Health in Construction Convention, 1988(No.167)
According to ILO convention 167 Article 16, all the vehicles should be maintained in good
working condition. Traffic management should be organised and controlled as to secure their
safe operation. Speed limit should be given by management in workplace.
According to ILO Convention 167 Article 19, there should be a proper barricade in place
where excavation is going on. The risk should be avoided to workers arising from possible
under ground dangers such as circulation of fluids or presence of gases, by undertaking
appropriate investigation to locate them.

If the management failed to comply with this law, then they will face financial loss, legal
issues, and moreover workers morale will be lost. The loss of worker morale which impacts
productivity and quality. The financial loss that occurs to company due to accident and
property damage. The legal issues is to be faced like enforcement action that result in fines
and imprisonment or even both. It is recommended that management should give training
and warn driver to reduce speed near excavation region. Arrange a speed breaker and
hump to reduce speed, appoint a banks man for giving proper signal to driver. Provide a
prohibition signal board for vehicle .

The estimated cost for providing a speed breaker and hump is approximately Rs 40000,
otherwise management will face financial loss of Rs 2000

2.OBSERVATION 7 (A person working at height in a improper platform ):

The worker at approximately 5m height carrying out welding activity in an improper platform.
The person is not noticed by anyone as he is working alone. At the ground level concrete
works have been going on. The person may fall due to any adverse environmental
conditions like wind , health condition or due to unawareness. As a result he will be seriously
injured or even fatality occurs. The workers at ground level can also be effected by fall from
height.

Legal Breaches are:


 Indian Factory Act 1948, Article 32, section 4
 Article 18 ,C 167- Safety and Health in Construction Convention 1988(No.167)
According to Indian Factory Act , when any person have to work at height from where he is
likely to fall, provision shall be made, so far as reasonably practicable, by fencing or
otherwise, to ensure safety of person.
According to ILO Convention 167 Article 18, it is necessary to guard against danger and
preventive measures to be taken falling of person or object.

If the organisation failed to comply with the law, then they will face financial loss,
enforcement action. The workers trust towards management will be lost. The financial loss
due to fall from height or property damage. The legal issues that result in criminal offence,
civil claim, imprisonment and fine.

It is recommended that organisation should provide proper working platform like scaffold with
SWL, guard rails and toe board. The working at height should be undergone under PTW
system .The management should also provide adequate PPE like fall arrest equipment and
safety net to reduce consequence of fall.

The estimated cost for providing a scaffold as temporary working platform is Rs 60000,
otherwise the company will have a financial loss of Rs 300000.

3.OBSERVATION 9 (Maintenance activity on faulty electrical equipment):

The workers carrying out maintenance activity on faulty electrical equipment which cause
electric shock and burns from contact with live parts and result in serious injury or even
fatality can occur when in contact with high voltage source. The workers were rushing to do
their job due to pressure from the supervisor. ELCB is not provided to incoming power
circuits to main electrical panel. The electrical equipment is not of double insulation.

The Legal Breaches are:


 Article 26, C167- Safety and Health in Construction Convention 1988(No.167)
 Indian Factory Act 1948 , Article 24 ,section 4

According to ILO Convention 167 Article 26, all the electrical equipment and installations
shall be constructed, installed, and maintained by a competent person, and so used to guard
against danger. The laying and maintenance of electrical cables and apparatus on
construction site to be governed by standard applied at national level.
In the Indian Factory Act 1948, Article 24 states that in every construction site there should
be suitable devices for cutting of power in case of emergencies.

If the management failed to comply with the law, then they will face economic loss, legal
issues and moreover there will be high staff turnover. So it is recommended that
management should install ELCB and the electrical cable wire should be of double
insulation. The management should give training while accessing electrical equipment.
Proper PPE should be given to workers like gloves, goggles while working with electrical
equipment.

The estimated cost for providing ELCB is Rs15000, if management failed to provide then
they will have a financial loss of Rs 200000.

4.OBSERVATION 10 (Flammable chemical substance stored near to workplace):

The flammable chemical substance stored together with other combustible materials near to
which the workers are doing machinery operation. Also observed lack of ventilation in the
room where these flammables are stored. The storage room was not given any signage or
warning. The flammable substance of different types are stored in single room. The room is
not provided with fire extinguisher near to it. As a result sudden explosion may occur or
chemical exposure to skin can cause skin cancer and lung cancer.

The Legal Breaches are:


 Article 2, C170- Chemical Convention,1990(No.170)
 Article 27,C167- Safety and Health in Construction Convention,1988(No.167)
 The Indian Factory Act 1948, Article 37,section 4
According to Article 2, C170 states the how the flammable chemicals may get exposed
through storage and handling, transportation and disposal of chemicals and their control
measures.
According to Article 27, C167 states that the flammable chemicals which are explosive in
nature shall not be stored, transported, or handled except under condition prescribed by
national laws or regulation.
According to Indian Factory Act Article37, states exclusion or effective enclosure of all
possible sources of ignition.

If the management violates the law then they will face financial loss as a result of fire and
explosion. The worker will not feel safe, and they move to other organisations. The company
also face enforcement action that will result in fines, imprisonment or both.

It is recommended that hazardous flammable chemical substances not to be stored at high


temperature. It should not be stored with other materials. Always the storage area should be
with proper ventilation. There should be separate store room to keep different flammable
chemical substance. These are the ways in which the management can improve standards
of H and S.

The estimated cost for the store room with proper ventilation to separate different
flammables is 150000, if not provided by the company can lead to financial loss of Rs
500000.

5.OBSERVATION 6 (Bench top grinder with unprotected guard):

A man is working on a Bench top grinder, which is used to grind down sharp edges and
remove burrs from processed metals. Beside him different operations are going on. The
person was wearing loose clothe with inadequate PPE. The Bench top grinder is not
protected by guard, which can lead to contact with rotating wheel, drawing into the trap
between tool rest and wheel, also parts may get ejected from machine. As the person is
wearing loose clothes entanglement may occur which result in serious injury like cuts
amputation may occur. Also non mechanical hazard like noise, ergonomics, vibration,
electricity may occur.

The Legal Breaches are:


 Article 17,C167 – Safety and Health in Construction Convention,1988(No.167)
 The Indian Factory Act 1948, Article 21, section 4
According to Article 17,C167 states that the machinery or equipment should be maintained
in good working condition, to be operated by workers who had undergone training.
According to Indian Factory Act 1948, Article 21, states every dangerous part of machine
shall be securely fenced by safe guard.

If the management failed to comply with the law , severe actions would be faced like legal
issues that is enforcement notice that result in civil claim, criminal offence, fines and
imprisonment or eve both. The financial loss like compensation pay out to worker,
hospitalisation cost, first aid treatment arises. The loss of staff morale as they realise that
employer is not providing safe place to work or SSOW.

It is recommended that the company should provide fixed enclosing guards around motor
and abrasive wheel. Also LEV should be installed to control dust. Routine maintenance
should be be done to ensure safe working condition, also ensure that competent person
should be given the right to work

The estimated cost for providing fixed guard and LEV is approximately 40000, if
management failed to provide they will economic loss of 200000.

Conclusions:

I sincerely thank the management of LIMS CONSTRUCTIONS for giving me an opportunity


to inspect the ongoing construction site. The inspection was part of my project and scope of
the project is to find out major hazard that lead to fatality for past month. During inspection
several good practises were observed that is welfare facilities like sanitary convenience ,
wash room, accommodation for clothing, place to eat and rest were in good hygiene
condition. An employer consulting with the worker regarding the work procedure also helps

The activities on the construction site were of more high risk factor and some low risk factor.
The company is violating several safety laws and regulations that are stated in The Indian
Factory Act ,1948 and ILO- C167-Safety and Health in Construction Convention,1988.

The major findings that has been observed in the construction site were:
 The vehicles moving at high speed close to excavation area which is not barricaded.
The vehicle may get trapped in the area or due to over speed the vehicle may skid
and workers who are working in that excavation region will be seriously injured or
even fatality occurs. It may also cause damage to buried service cable resulting in
explosion or flooding.

The control measures that could be taken by management to control this incidence is
first of all the excavated are should be barricaded, drivers should undergo a training
session, speed breaker and hump should be installed by management to reduce over
speed, speed limit to be set by organisation, proper warning signage should be there
near to high risk work.

 A person carrying out welding activity at approximately 5m height in an improper


platform. As a result person may fall or object may fall resulting in bone fracture or
even fatality.

The control measures to be taken are the worker should be provided a scaffold as
temporary working platform with SWL. The work at height should be done with PTW.
The management should provide adequate PPE like fall arrest equipment and safety
net to reduce consequence of fall.

 The workers carrying out maintenance activity on faulty electrical equipment. The
workers may get electric shock from high voltage source.

ELCB must be installed and double insulation to be provided, Also competent person
should be allowed to work, IITS to be provided to workers who were newly appointed
are the control measures to be taken by management.

 The flammable chemical substances stored together with other combustible materials
near to work place. As a result explosion may occur or even chemical exposure to
skin may lead to skin cancer.

There should be separate storage area for flammable materials and to be far away
from work place. Proper warning signage to be placed near to flammables. There
should be proper lighting and ventilation in storage area. Only authorised person
should have right to go to storage place. These are measures to be taken by the
management.

 A man is working on a Bench top grinder with unprotected guard, which can lead to
cuts, amputation, and entanglement.

The control measure to be by management is to provide a fixed guard between motor


and abrasive wheel, LEV to be installed to collect dust, provide adequate PPE like
goggles , gloves, aprons, and hard hat. Proper training and supervision should be
given to workers doing machinery operation.

The five critical issues may lead the organisation to suffer from decreasing of
production rate, high insurance premium, uninsured cost and reduce morale of
workers. So by implementing corrective measures stated in recommendation table it
will help the company to reduce accidents in work site. It also help to increase the
productivity and reduce staff turnover. The recommendation to be taken within 4
months time period. It is also advised to review the report in upcoming HSE
management meeting, so that we can ensure a positive health and safety culture in
the organisation.
