appoint the Members, officers and employees of the Commission

Authority shall conduct annually a single admissions test on a date approved by the Council

A person, having obtained an undergraduate medical or dental qualification issued by a
university in Pakistan or an undergraduate medical or dental qualification issued by a foreign
institution recognized by the Commission, shall be granted a Provisional License to undertake
their house job within fourteen days of having duly passed and qualified the National
Licensing Exam
National Licensing Exam
Any medical or dental practitioner who has obtained a license to practice in a country or
(NLE)
qualified from a foreign institution not recognized by the Commission and in addition does not
hold a postgraduate qualification which is recognized by the Council, shall be required to
qualify the National Licensing Exam for grant of a license to practice in Pakistan
that students graduating before March 2020 shall be exempted from taking the National
Licensing Exam prior to issuance of a Provisional License subject to they being required to
take the National Licensing Exam for grant of a Full License after completion of their one year
house job
Authority shall at least twice a year conduct the NEB exams to assess and oversee the
assessment of the knowledge, clinical skills and professional attributes of students who have
partially completed a medical and dental program in a foreign institution and are seeking
transfer to and admission in a medical or dental college in Pakistan
National Equivalence
Any student who has been enrolled in a medical or dental institution or college outside
Board (NEB) Examinations
Pakistan and has completed more than two years of the program may seek transfer and
admission to a medical or dental college in Pakistan subject to qualifying the NEB exam
Student shall be required to take the NEB exam within twelve months of having left his
program of study outside Pakistan
Admissions
Admission to medical or dental programs conducted by public colleges shall be regulated as per the policy of the Provincial
Governments strictly on merit
Admission to a private college shall be in accordance with the criteria and requirements stipulated by the private college at
least one year in advance of admissions including any additional entrance test as may be conducted by a private college
subject to any conditions imposed by the relevant university.
Discretion of the Provincial Governments or the private colleges, as per their declared policy to give weightage to the marks
obtained by a student in the MDCAT

Standards of Medical and Dental Education


Universities shall ensure that all medical and dental colleges at the time of seeking affiliation fulfill and thereafter consistently
maintain the accreditation standards including the maximum students in each year permitted as per the accreditation
standards formulated by the Board
Universities shall ensure that all affiliated or constituent colleges conduct programs of study for grant of undergraduate
medical or dental degrees as per the curriculum and scope of undergraduate medical education prescribed by the Board
Universities shall ensure that all affiliated or constituent colleges within 30 days of completing their admissions each year
provide to the Authority particulars of the students enrolled and further provide any change in the status of the student
Universities shall within ten days of a student having successfully completed the program of study and passed their final
exams inform the Authority verifying the results to enable the student to be registered for taking the National Licensing
Exam.
Standard and structure of faculty shall be regulated as prescribed by HEC or each university in respect of affiliated colleges
or any other law as maybe applicable to a public teaching institution.
All medical and dental colleges shall, at least three months prior to initiating the annual admissions process, publicy declare
the fixed tution and all ancilliary fee structure on an annual basis for the entire program of study in which the students are
seeking enrollment and which fee structure shall not be enhanced during the students period of enrollment at the college.
No medical or dental college shall seek, demand or receive from a student or a students family, directly or indirectly, any
donation or other payment prior to or at the time of admission or thereafter during the period of the students continuing
enrollment at the college whether as consideration for grant of admission or otherwise.
House Job
Every person having obtained a Provisional License shall be required to undergo and successfully complete a mandatory
one year house job, internship or foundation year at an institution recognized by the Commission or an equivalent of a house
job outside Pakistan as may be recognized by the Commission.
Every medical or dental college in Pakistan shall be responsible to provide a paid house job, either at its own affiliated
teaching hospital or any other recognized teaching hospital for each of its graduates who qualify the NLE and acquire a
Provisional License.
Medical or dental college shall ensure the stipend or salary paid is not less than the highest stipend or salary paid by a
public teaching hospital in the province to similarly placed graduates.
A house job, internship or foundation year shall consist of full time and structured training as specified by the Board and
approved by the Council.
The teaching hospital shall issue on the conclusion of the house job a certificate confirming that the Provisional License
holder has satisfactorily completed the mandatory house job modules for grant of Full License.

Recognition of hospitals or institutions for house job or internship or foundation year training
Authority shall upon inspection and assessment recommend to the Council for grant of recognition to any hospitals or
institutions in Pakistan which train for house job or internship or foundation year.
The Council shall recognize any foreign teaching hospital or institution recognized by the regulatory authority of such country
for purposes of imparting house job, internship, foundation year or clinical traning by whatever name called.

Inspection
Authority shall appoint inspectors in accordance with terms and qualifications prescribed by the Council to inspect facilities
for training available at the medical or dental institutions for grant of recognition to provide house job, internship or
foundation year training or post-graduate training.
An institution recognized for training by the College of Physicians and Surgeons of Pakistan shall be recognized by the
Council for purposes of post-graduate training.
Authority shall forward a copy of such report to the medical or dental institution concerned for any response prior to placing
the report along with its recommendation before the Council.
Authority may conduct inspections of recognized facilities on a periodical basis, with or without prior notice to the institution
provided that every institutution shall be re-inspected at least once in every five years.
Licensing

Provisional License Upon passing National Licensing Exam and until completion of House Job

Authority shall grant a Full License to practice basic medicine or dentistry as a General Practitioner
to a person who subsequent to qualifiying the National License Exam has completed their
mandatory one year house job or foundation year or internship satisfactorily or has successfully
completed a house job, internship or foundation year equivalent to a house job at a foreign teaching
hospital or institution recognized by the Commission.
Full License
Authority shall register a recognized post graduate, alterative or additional qualification on the
license of a medical or dental practitioner where such qualification permits the medical or dental
practitioner to represent and practice such speciality in consonance to such qualification.
No medical or dental practitioner shall be permitted to represent in Pakistan as having acquired or
seek to practice a speciality unless the same is duly registered on their license by the Authority.
Authority shall grant to a person licensed in a foreign country and in training in a foreign institution, a
Temporary Licence for a fixed period of time to enable the person to take an elective training in a
Temporary License recognized institution in Pakistan which has accepted the person for training.
Authority shall grant to a person licensed in a foreign country a Temporary Licence for a fixed period
of time to enable the person to provide training or teach in a recognized institution in Pakistan.
Every licensed practitioner shall be responsible to maintain their license as valid. A practitioner shall
not be permitted to practice in the absence of a valid license issued by the Authority.
Validity
Every licensed medical or dental practitioner shall be required to revalidate their license every five
years in the manner and on terms prescribed by the Board and the Council.
Every licensed practitioner shall be bound by the Code of Ethics promulgated by the Authority.
No registered licensee shall use or publish any title, description or symbol indicating or intended to
lead persons to infer that he possesses any additional professional qualification unless the same
has been duly recognized and registered on their license by the Commission.
Terms & Scope of A general practitioner may treat all common medical or dental ailments and shall not practice in
Practice fields or specialties, as recognized by the Commission for which formal training is required. He or
she may also provide life saving treatment until specialist services can be obtained or a safe referral
can be ensured. No practitioner shall represent themselves as a specialist or practice as a
specialist, wthout having appropriate qualifications, recognized by the Commission and registered
on their full license.
RECOGNITIONS

diplomas given by the College of Physicians and Surgeons of Pakistan.

The Council may where necessary seek professional advice or the opinion of the
relevant Faculty of the College of Physicians and Surgeons, or of a university, to
assess a recommendation for approval of a post graduate, additional or alterative
qualification. and in addition thereto the opinion of the foreign authority of the
country where such foreign institution is located to assess a recommendation for
Process approval of a post graduate, additional or alterative qualification.
The Authority shall assess for purposes of recommendation any foreign institution
either on the application of such foreign institution or upon an application by a
person having acquired a recognized qualification from a previously unrecognized
foreign institution. The Authority shall conduct and complete its assessment within
three months of an application being made.
DISCIPLINARY

Proceedings The Authority shall on the complaint of any person or authority or of its own motion on information
received, initiate disciplinary proceedings against any Full License holder or any recognized institution
in respect of medical negligence, misconduct or violation of any obligation or any rules or regulations
or directions of the Commission.
A show cause notice shall be issued within fifteen days of receipt of the complaint to the person
stating the allegations and providing a period of at least 30 days to respond and a right to be heard
before the Disciplinary Committee.
The Council shall form a Disciplinary Committee consisting of three members of the Council of which
one shall be the member having legal qualifications to hear all disciplinary matters.
The Authority shall select at least one licensed practioner as an expert with a minimum fifteen year
standing in the speciality to which the complaint relates to assist the Disciplinary Committee at the
hearing. The written opinion of the expert shall be appended with the decision of the Disciplinary
Committee and shall form part of the record.
The Disciplinary Committee shall hear and decide each complaint within ninety days of the issuance
of the show cause notice. The Disciplinary Committee shall impose penalties as prescribed by
regulations framed by the Council specifying penalties commensurate with each category of offence.
Penalties & Fine The Council in compliance to directions of the Medical Tribunal or upon a finding pursuant to a
disciplinary hearing or upon an inquiry and hearing conducted by the Authority or the Council itself,
may temporarily suspend or permanently cancel the license of a practitioner for having violated any
obligation imposed upon the licensee or for medical or professional negligence or misconduct.
The license of a practitioner which has expired or who has not successfully revalidated within the time
prescribed shall be deemed to be suspended until such time as it is revalidated in the prescribed
manner.
All offences carrying imprisionment as a penalty shall be non-cognizable and triable by the Medical
Tribunal.
All penalties imposed by the Disciplinary Committee shall be paid to the Authority’s account. All
penalties imposed by the Medical Tribunal shall be deposited in equal amount with the Authority and
the Medical Tribunal.
The Authority may apply to the Medical Tribunal to recover an amount imposed as penalty and the
Medical Tribunal may direct the arrest and confinement of defaulter until the penalty is paid in full.
PENALTIES
Operates or runs or establishes or endorses any institution or imprisonment for a term upto five years, or
advertises admissions in an institution for imparting training fine upto fifty million rupees and shall also be liable to closure
and education in medicine or dentistry of such institution.
Runs or establishes or endorses any institution and admits imprisonment for a term upto five years, or
students for imparting education in medicine or dentistry or fine not be less than sum total of the tuition fee for the whole
admits students over and above the allowed number duration of study and shall also be liable to closure of such
institution.
Falsely gets registered with the Authority as a registered imprisonment for a term upto five years, or
medical or dental practitioner without possessing recognized fine upto ten million rupees.

Whoever falsely pretends to be registered as a medical imprisonment for a term upto three years, or
practitioner or dentist and uses with his name any title or fine upto ten million rupees

nomenclature or designation without legal basis, irrespective
of whether any person is actually deceived by such presence
or representation or not
Whoever aids or abets any person to falsely register with the imprisonment for a term upto two years, or
Council as a registered medical practitioner without having fine upto ten million rupees
recognized medical or dental qualifications
Whoever contravenes any other provision of this law ifine upto five million rupees.

Appeals to the Medical Tribunal


Any person aggrieved by any order or direction of the Commission, including the Council, Authority or Disciplinary
Committee may prefer an appeal only before the Medical Tribunal formed under the Medical Tribunal Act 2019, within thirty
days of the date of communication of the impugned order or direction.
REPEAL & SAVINGS
Pakistan Medical and Dental Council Ordinance, 1962 (Act XXXII of 1962) herein after reflected as
repealing Ordinance herein after referred as repealed Ordinance
Repeal
All regulations framed and promulgated pursuant to the Pakistan Medical and Dental Council Ordinance,
1962 (Act XXXII of 1962) or the Pakistan Medical and Dental Council Ordinance, 2019 stand repealed
Schedules, All Schedules as maintained and recorded under the repealed Pakistan Medical and Dental Council
Recognition of Ordinance, 1962 (Act XXXII of 1962) shall be deemed to have merged into the record of the
Qualifications & Commission as required to be maintained pursuant to this Ordinance subject to the Council at their
Institutions discretion re assessing the entries therein pursuant to the criteria laid down under this Ordinance.
Notwithstanding the repeal of the Pakistan Medical and Dental Council Ordinance, 1962 (Act XXXII of
1962) or anything contrary contained herein, all decisions, disciplinary action taken by the Council, Ad-
hoc Council, Executive Committee or any other Committee or authority of the Pakistan Medical and
Savings
Dental Council pursuant to the Pakistan Medical and Dental Council Ordinance, 1962 (Act XXXII of
1962) and the Pakistan Medical and Dental Council Ordinance, 2019 shall be deemed to have been
validly made until altered, repealed or modified by the Council constituted under this Ordinance.
The Pakistan Medical and Dental Council as formed pursuant to the repealed Ordinance shall stand
dissolved
All assets, rights, moverable and immoveable properties, records, cash, bank accounts, deposits etc., of
the Pakistan Medical and Dental Council under the repealed Ordinance shall be transferred to the
Commission and shall be deemed to be the assets, rights, properties, records, cash, bank accounts,
deposits etc., of the Commission.
Dissolution &
All assets, liabilities, payables and recievables of the Pakistan Medical and Dental Council under the
Transfer
repealed Ordinance shall be deemed to be the assets, liabilities, payables and recievables of the
Commission.
All registration, recognition etc., granted by the Council under the repealed Ordinance shall be deemed
to be the registration, recognition granted by Commission subject to the provisions of this Ordinance or
the same being within the power of the Commission to recognize and register pursuant to this
Ordinance.
Federal Government shall provide officers on deputation not exceeding 90 days to assist in the
Transitory operations of the Commission until Members and necessary employees are appointed.
Period Council may appoint persons on temporary short term contract for a period not exceeding 90 days to
assist in the operations of the Commission subsequent to its establishment
