I take this opportunity to convey my sincere thanks and gratitude to all those who have
directly or indirectly helped and contributed towards the completion of this project.

First and foremost, I would like to thank Mr. Prakhar Saxena for his constant guidance
and support throughout this project. During the project, I realized that the degree of
relevance of the learning being imparted in the class is very high. The learning enabled
me to get a better understanding of the nitty-gritty of the subject which I studied.

I would also like to thank my batch mates for the discussions that I had with them. All
these have resulted in the enrichment of my knowledge and their inputs have helped me
to incorporate relevant issues into my project. Last but not the least I would like to thank
God and my parents for their Co-operation and help.
Introduction

Pleadings are the statement of facts in writing drawn up and filed in a Court by each party
to am case stating therein what his contention shall be at the trial and giving all such
details as his opponent will need to know in order to prepare his case in answer. In India
there are only two pleading in a suit as defined under Order 6, rule 1 of the Code of Civil
Procedure, it says that pleading means “Plaint or Written Statement”. This definition is
not very clear in itself. The plaint and written statement are defined in the following
clauses:

(a)Plaint: A statement of claims, called the “plaint” in which the plaintiff sets out his
cause of action with all necessary particulars; and Written Statement: A statement of
defences, called the “written statement” which the defendant deals with every material
fact alleged by the Plaintiff in the plaint and also sets any new facts which tells in his
favour, adding such objection as he wishes to take to the claim.

The plaintiff respectfully states as follows:

Materials Fact:

1. That the respondent infringed plaintiff”s copyright by publishing an article


originally written by plaintiff in own name.The copy of the proof is attached with
this plaint.
2. The newspaper in which the respondent published the article on 2 july 2015 on
page number 12 is the Muzaffarnagar times.
3. That the Plaintiff originally published the article in the weekly update magazine
on 25th june, 2015 and respondent without plintiff”s permission published the
same in his own name.
Cause of Action:
4.That the Respondent on 3rd july,2015 refused accept the fact that he did not
originally write the article.

Valuation:

(5) The suit is valued for the purpose of jurisdiction and court-feet at Rs.30000/-

(6) Both the parties reside in Muzaffarnagar, also the newspaper and magazine in
case are published in Muzaffarnagar area only which is within this court”s
territorial jurisdiction.
