for assessing impairment of waters based on the existing wild rice-related standard. Consequently, the 2020 303(d) Impaire
Waters List does not include any waters assessed as impaired for the sulfate wild rice standard. The MPCA continues to con

Minnesota's Draft 2020 Impaired Waters List includes: the 303(d) TMDL List, the Inventory of all impaired waters, and the list of waters included
in the Statewide Mercury TMDL (Appendix A).
The Clean Water Act Section 303(d) TMDL List is required by EPA. It is a list of impaired waters for which TMDL studies are required, as determined
by the MPCA's Guidance Manual for Assessing the Quality of Minnesota Surface Waters for Determination of Impairment: 305(b) Report and
303(d) List.
The absence of a water body from the Impaired Waters List does not necessarily mean it is meeting its designated uses. It may be that the lake or
stream has either not been sampled or there are not enough data to make an impairment determination.
Impaired waters for which a TMDL study is required by Section 303(d) of the Clean Water Act, also known as the
303(d) List. EPA requires states to submit this list every two years (by April 1st of even-numbered years). To see
2020 TMDL List: NEW impairments siadded to the TMDL List, choose 2020 in the "Year added to List" filter box.
All identified impaired waters; subsets include the TMDL List, waters for which a TMDL study has been approved by
2020 Inventory Impaired EPA but remain impaired, and waters that are impaired but a TMDL study is not required. To see ALL NEW
Waters: impairments, choose 2020 in the "Year added to List" header filter.
Previously listed waters now determined, through new and reliable data, to meet water quality standards. These
are all delistings since 2002, with newly delisted waters at the top of the list ("Delist year" = 2020). Delistings may
Delisted: occur as a result of corrective actions or unknown reasons.
All changes and corrections to the Impaired Waters List since April 4, 2018. Common entries are reach splits, TMDL
approvals, and list corrections to Category 2 or 3. Corrections are determinations that a water is not impaired but
which are not considered delistings. Corrections can occur when new water quality standards are adopted and the
Changes and Corrections to original listing data now show support, the original assessment methodology was not appropriate, or the original
List: listing data were found to be invalid.
Impaired waters lying wholly within federally recognized Indian reservations other than the Mille Lacs reservation.

This body of water is partially within a federally recognized Indian reservation and does not serve as a
border between a federally recognized Indian reservation and Minnesota land. The state and tribe
have worked cooperatively on this water quality assessment and agree that the water should be
included on the State’s impaired waters list. For the purposes of the 303(d) list, the assessment of the
portion of the water body within the reservation is advisory to EPA only because EPA has stated that it
does not approve the State’s impaired waters listings for waters within the boundaries of an Indian
reservation. Note that the MPCA includes parcels held in trust (tribal trust lands) in the definition of
Partial Indian reservation.
This assessment list was prepared under authority in state law to determine whether waters within the
state are impaired. For purposes of the 303(d) list, these assessments are advisory to EPA only
because these water bodies are located wholly within a federally recognized Indian reservation and
EPA has stated that it does not approve the State’s impaired waters listings for waters that are within
the boundaries of an Indian reservation. Note that the MPCA includes parcels held in trust (tribal trust
Wholly lands) in the definition of Indian reservation.
This body of water is either partially or wholly within the disputed boundaries of the Mille Lacs
Reservation. The State of Minnesota and the federal government disagree on the boundaries of the
Mille Lacs Reservation. As a result, for purposes of the 303(d) list only, the assessment of this water
body is advisory to EPA only because EPA has stated that it does not approve the State’s impaired
waters listings for waters within the boundaries of an Indian reservation. By identifying this water as
within the disputed Mille Lacs Reservation and placing it on the 303(d) list, the State does not
concede that this water is within the Mille Lacs Reservation nor that the MPCA lacks jurisdiction to list
Mille Lacs this water as impaired under 303(d).
4B Impaired but a TMDL study is not required because water quality standards are expected to be met in the near future.
4C Impaired but a TMDL study is not required because the impairment is not caused by a pollutant.
Impaired but a TMDL study is not required because the impairment is due to natural conditions with insignificant anthropogenic
influence. To be considered insignificant, the elimination of the anthropogenic influence would not lead to the attainment of
water quality standards and it would not be included in formal pollution reduction goal-setting activities. Category 4D indicates
4D a site-specific water quality standard based on local natural conditions has yet to be determined.
Impaired but existing data strongly suggests a TMDL study is not required because impairment is not caused by a pollutant or is
due to natural conditions with only insignificant anthropogenic influence; a final determination of Category 4C or 4D will be
4E made in the next assessment cycle pending confirmation from additional information.
