Sereno’s arguments:

1. The Chief justice may only be ousted through impeachment; Section 2 Article 11
2. Judge of the lower court exercising disciplinary power over the supreme court justice
contradicts Section 11, Article 8 of the 1987 constitution which states that the Supreme Court
has disciplinary and administrative power over all courts and its personnel thereof; If a member
of the supreme court can be ousted through quo warranto initiated by OSG, congress check
through impeachment would be rendered inutile
3. Time-barred: for quo warranto must be filed within one (1) year from the "cause of ouster" and
not from the "discovery" of the disqualification.
4. Public officers without pay or those who do not receive compensation are not required to file
SALN.
