COMPLIANCE

RESPONDENT PORFERIO AZCUNA III, through undersigned Counsel, unto

this Honorable Court, most respectfully files this Compliance, and further
avers that:

1) On 13 July 2017, Counsel received the Order of this Honorable

Court dated 6 July 2017 directing Counsel to explain his failure to
appear on the hearing scheduled on said date (6 July 2017).

2) Counsel had no intention to be absent on said hearing date.

However, on 3 July 2017, Counsel received from the Plaintiff's
Counsel, Atty. Evangeline Carrasco, the Urgent Motion (To Postpone
Hearing) dated 30 June 2017, praying that the scheduled hearing of
the case on 6 July 2017 be reset on the “latter part of August
2017.”
Moreover, Counsel on said day (6 July 2016) suffered from stomach
ache and stayed home the whole day and rested.
 3) Counsel had no intention to be absent, or defy or violate any order
or resolution of this Honorable Court, including the setting of
hearing schedules. Counsel asked for understanding for said
absence for the reasons above-cited, in the interest of justice and
equity.
