SUMMARY, CONCLUSIONS, AND RECOMMENDATIONS

The chapter represents the findings gathered, the conclusions drawn and the

researcher’s recommendation

Summary of findings

1. Benefits of the “Tapat ko, Linis ko” ordinance with regards to the beautification

of the City of Manila

The environment is not an issue, it is a “value.” Industrialized societies often

perceived the environment as a free good an expendable, renewable resource. The worst

offenders considered the environment a resource with no value in itself. As the capital

city the Make-over may bring back the genuine trust of other foreign country in putting

investments in the growing city, thus the beautification contributes to give people in

society a healthy and clean city.

2. House Bill No. 4978 when will be a help in the present issues concerning the

Street-Vendors

The House Bill regulation of sidewalk vending means to put a stop to the frequent

commotion between the vendors and law enforcement officers including members of the
Metropolitan Manila Development Authority (MMDA) about the issues concerning the

cleanliness and disturbance to traffic congestion of the Street Vendors in many area in

the city.

3. Ordinance No. 8572 in relation to the Street-Vendors and the City

Amid the harsh policies, street vendors devise ways to cope with poverty and their

livelihood. This helps the Street Vendors be always reminded the importance of

maintaning the cleanliness of the city despite the everyday transaction between business

and customers within the city.

The Ordinance No. 8572 can be gain said not a harsh ordinance as this promote a

continuous improvement for the cleanliness of the city, in relation to the street vendors

this only requires the said vendors to observe and maintain proper waste disposal and

environmental cleanliness.

Conclusions

Based on the findings, the proponent concludes the following:

1. City Ordinance No. 8572 and its valid implementation for the Make-over of the

Capital City.

As provided in Sec 4 (2), Article VIII of the 1987 Philippine Constitution,


“All cases involving the constitutionality of a treaty, international or executive

agreement, or law, which shall be heard by the Supreme Court en banc, and all other

cases which under the rules of court are required to be heard en banc, including

those involving the constitutionality, application, or operation of presidential decrees,

proclamations, orders, instructions, ordinances, and other regulations, shall be

decided with the concurrence of a majority of the members who actually took part in

the deliberations on the issued in the case and voted thereon.”

In urban planning decisions, the needs of street vendors and their customers are

often dismissed as irrelevant to a modern city's growth. Street vendors are often

evicted by force when their traditional vending sites overlap with sites for proposed

development.

2. Local Ordinnace No. 8572 distinguishes from House Bill No. 4978

Ordinance No. 8572 in the City of Manila or otherwise known as the “Tapat ko,

Linis ko” Ordinance deals with the mandatory cleanliness of the frontage as well as the

immediate surrounding of the people. The House Bill No. 4978 was Introduced by

Honorable Eduardo Nonato N. Joson in protection of the rights of the street vendors on

where to ply their wares and for other purposes concerning the Side-walk Vendors.

3. Local Ordinnace No. 8572 and House Bill No. 4978 as harmonized
It is a rule that similar or conflicting statutes must be harmonized first. Both can be

so helpful in the beautification of the city of Manila. Both can give guidelines to the

authorities in

Recommendation

1. It is recommended, that the Ordinance and House Bill should be first harmonize

before choosing which one prevails over the other.

2. It is further recommended, that such proposed bill will protect the rights of sidewalk

vendors designating a place for them to ply their wares and for other purposes.

3. It is hereby recommended, that parameters must be set-upby the designated

government authorities to provide clear guidelines for the Street-Vendors, specially when

they were force evacuate their areas where they ply their wares due to waste disposal and

cleanliness problem

4. It is recommended that such newly approved ordinance will make sure that residential

and commercial establishment will exercise the maintenance of cleanliness and

orderliness until their immediate syrrounding.

5. Further, it is recommended as well to adopt the advocacy of one environmentalist

celebrity where she promotes to the people in community to be conscious in disposing

their garbages properly, even while on jog.
