The process for awarding $58 million ofBP oil spill fines for a beachfront hotel and conference
center at Gulf State Park was flawed and failed to consider alternative projects, an attorney with
an environmental advocacy group argued before a federal judge Tuesday.
But attorneys representing the U.S. Department of Justice and the state of Alabama, along with a
representative of the Gulf Shores-based project, said they were in the legal right to do what they
did in 2014, when the project was initially approved.
Both sides argued their cases before U.S. District Judge Charles Butler, whose decision could
have a wide-ranging impact on more than 60 projects approved from an initial settlement
agreement with BP totaling $1 billion.
The fmes were part of an early pot of money that BP made available to coastal states following
the 2010 Deepwater Horizon disaster. The spill poured 134 million gallons of oil into the Gulf of
Mexico.
"If this court fmds that alternatives should've been considered that were not negotiated with BP,
it invalidates the entire early restoration process," said Jane Calamusa, an attorney for Gunter
Guy, commissioner of the Alabama Department of Conservation and Natural Resources.
"It would jeopardize the early restoration projects. We have a total of 64 projects and $852
million that would be up in the air."
Representatives with the New Orleans-based Gulf Restoration Network said that Butler's
decision won't leave the other 64 projects in limbo.
Among other coastal Alabama projects being funded with BP fines are a $5 million shoreline
project in Bon Secour Bay and $3.2 million project to create oyster reefs.
"The law says you have to look at alternative ways to do things," said Robert Wiygul, attorney
with the restoration network. "That's not what happened with this project."

He said the alternatives that should be examined include the restoration of wetlands and the
development of recreational opportunities such as snorkeling reefs.
The Gulf Restoration Network, founded in 1995, has argued that the hotel and conference center
is a misuse of money that is supposed to restore natural resources.
Cooper Shattuck, executive director with the Gulf State Park enhancement effort, said the project
selection process - spearheaded by a group of federal and state trustees - was within the
framework that the government negotiated with BP.
The 350-room hotel and conference center would be built on the site of an old lodge that was
destroyed by Hurricane Ivan in 2004.
The entire project, estimated to cost $85 million, also provides for such things as dune
restoration, a new research and education center and trail improvements in the park.
Butler told both sides that he will rule in the case sometime soon.
The judge, at times, appeared to grill the government attorneys on whether the Gulf State Park
project was properly vetted. Among the questions he raised was whether it was appropriate for
the government to cite 2001 tourism estimates and make a claim that that the completed project
could lure 120,000 visitors a day to Gulf Shores.
The attorneys used those estimates to demonstrate a need for the conference center and hotel as
the Alabama beach economy recovers from the spill and rebuilds itself as a tourism magnet.
"That (study) was done 15 years ago today," Butler said. "Are you really telling me this is a
legitimate, reasonable basis to say that problem still exists? We all know that in the past 15
years, Gulf Shores has again had another explosion. Y ou'd have to have an additional analysis to
support a contention to say there is a need to replace visitors."
Shattuck said the 2001 figures was only one basis for evaluating the project. "We had teams of
economists and environmental engineers pouring over all these projects to study, evaluate and
analyze them," he said.

MOBILE, AL (WALA) - The state of Alabama wants to build a new hotel and conference center
at Gulf State Park in Gulf Shores, and officials want to use BP restoration money to do it. An
environmental group calls the project a "shocking misuse" of restoration dollars, and they're
asking the judge to halt it, or at least slow it down.
The dispute over $58 million in BP restoration money ended up in federal court in Mobile
Tuesday morning.
The state is ready to move forward with a project to build a hotel and conference center at Gulf
State Park.
"Weare about to begin construction of the new trails and the rehabilitation of the trails that exist.
We're about to begin dune restoration and we're about to begin with the foundations of the actual
lodge and conference center," Cooper Shattuck said.
The old conference center was destroyed by Hurricane Ivan in 2004. The governor and state
lawmakers want to use restoration money from the 2010 BP oil spill to pay for the project.
But, David Underhill is an Alabama taxpayer who objects to the proposed use of restoration
dollars.
"To restore a convention center that wasn't there doesn't restore anything that was lost, and
instead it takes part of the public beach away from the public," Underhill said.
The environmental group Gulf Restoration Network filed the federal lawsuit. The group claims
the trustees who approved the project side-stepped the law by not considering anything else.
"That would be the hope that the trustees would take a serious look at other alternatives for how
to spend what's really an enormous amount of money, $58.5 million, and BP gets $117 million in
credit for that," Robert Wiygul said.
When asked what might be some valid ways to spend the money Wiygul responded, "Well
certainly we would want to get actual restoration of habitats, wetlands and things of that nature.
Other recreational facilities, and snorkel reefs."
"What I believe the court will know as he reviews the record is in that context there was nothing
done that was wrong or improperly," Shattuck said.
Following the hour-long hearing, District Court Judge Charles Butler took the case under
advisement. Butler didn't give a specific date, but he said he expects to have a ruling soon.

MONTGOMERY, Ala. (AP) -- A federal judge will hear arguments Tuesday in a lawsuit
challenging Alabama's plans to use a portion of the state's oil spill settlement funds to build a
beachfront hotel and conference center at Gulf State Park.
The environmental advocacy group, Gulf Restoration Network of New Orleans, filed a lawsuit in
2014 arguing that a hotel development is a misuse of funds meant to restore natural resources
after the largest oil spill in U.S. history.
"Building a hotel and convention center is plainly not an action that will restore, rehabilitate,
replace, or acquire the equivalent of injured natural resources or services, and the Federal
Trustees do not even try to explain how building a convention center qualifies as a restoration
project," lawyers for the group wrote in the 2014 complaint.
The lawsuit names as defendants state and federal trustees who approved the proj ect, including
the United States Department of the Interior, Environmental Protection Agency and Alabama's
Department of Conservation.
Alabama is moving forward with plans to use a portion of BP settlement funds to construct a
350-room hotel and conference center that can handle gatherings of up to 1,500 people. The
facility would be built on the site of an old lodge at the park that was destroyed by Hurricane
Ivan in 2004.
The state argued that the project will help bring people back to the coast after recreation use
plummeted during the 2010 oil spill and cleanup.
"When you look at the facts about this project, there is no reason for the judge to stop it," Cooper
Shattuck, executive of the Gulf State Park Enhancement Project, said.
Shattuck said the project meets the requirements of the law and the state is also proposing an
ecologically sensitive design that will have a smaller footprint than the old lodge.
The 2010 Deepwater Horizon rig explosion dumped 134 million gallons of oil into the Gulf of
Mexico. The lawsuit challenges the state's planned use of $58 million in early restoration funds,
a pot of money BP made available for the coastal states, for the project.

Tourism officials in Alabama have long argued that Alabama needed a beach site that could host
large conferences, since Alabama associations often cross state lines into Florida to find venues
large enough for their summer gatherings. Two governors have tried for more than a decade to
replace the lodge destroyed in 2014.
Alabama hopes to have the facility open by the summer of2018, Shattuck said.

The Alabama Joint Transportation Committee met in Mobile on Tuesday to discuss a topic on
everyone's minds: infrastructure and how to pay for it.
Committee chairman, Rep. Mac McCutcheon is advocating for a 12 cent gas tax that wou.ld
make up for inflation since the last gas tax increase in 1992. Since '92, Alabama's population has
increased from 4.1 million to 4.8 million in 2014.
By-and-Iarge, examples of Interstate 10 tunnel traffic and Highway 98 injuries and deaths were
brought up most during the two and a half hour meeting.
Vulcan Inc. CEO Tommy Lee kicked off the meeting with a presentation that showed some of
the obstacles in the way of maintaining roads and bridges in Alabama, and touched on the idea of
a gas tax that could rectify funding shortfalls.
One of the examples that Lee gave was that a Honda in 1994 contributed roughly $184 in taxes
for every 12,000 miles driven. In 2013, that car would contribute $146 for the same amount of
miles due to greater efficiency in modem vehicles.
Lee also cited a the rule that by 2024, all cars must get 54.5 miles to the gallon on average.
He said that was evidence that funding from the existing gas tax, established in 1992, would be
even less adequate if action is not taken.
Following his presentation, 21 speakers were signed up to address the large delegation, and of
that number, most did.
Mobile County Commissioner Connie Hudson spoke first, commending the delegation for
communicating with local citizens and listening to local needs.

"One project that for us has been head and shoulders above the others is the Highway 98
project," said Hudson. "It has been on the books of ALDOT for the better part of 20 years, and in
that period of time only five of 13 phases have been completed. There is approximately a 10 mile
stretch of road that needs to be improved."
"Between 2012 and 2014, the accident picture with injuries has increased 62 percent, it's one of
the most dangerous two-lane roads in the state."
Bill Ward represented the Alabama Association of Truckers to highlight the issues faced by 18-
wheelers.
He spoke at length about the delays truckers face on Highway 98 in the portions that go down to
two lanes as well as the bottleneck in the tunneL
Chainnan of the Build The Bridge coalition addressed the bottleneck, saying that "building
bridge could benefit many areas. No single thing addresses so many issues as this one thing," he
said.
Ward explained that for a trucker, a delay like the tunnel bottleneck means money lost. Ward
said that places like Airbus have to halt production ifthey do not receive their cargo on time,
hurting the economy.
He said that improved infrastructure could help to limit those delays and help prevent accidents
involving truck on the roadways, of which 70 percent are caused by four-wheeled cars.
CEO of Infirmary Health Mark Nix gave some real-world examples of how infrastructure
deficiencies are deadly.
He said that heart attacks and strokes need to be addressed within a limited amount of time, and
congested roads in the growing Daphne/Fairhope area are preventing people from getting the
care they need, especially on Highway 98.
To deal with those issues, $45,000 has been spent on telemetry units being installed in
ambulances because the time it takes to get people to the hospital in Baldwin County is
increasing, he said.
Vice President of the Alabama Section of the American Society of Civil Engineers Kendall
Kilpatrick explained to AL.com that the condition of the roads means dollar bills to every citizen
in the state and why a gas tax would help.

• Finding a long-tenn, sustainable funding source and increasing investment is important. A gas
tax offers a direct way to do that, Kilpatrick said.
Two citizens spoke out against the proposed gas tax of 12 cents a gallon.
One man said that local municipalities creating additional taxes needed to be regulated.
He also said that gas station owners could suffer from a per-gallon hike.
A woman said that she uses an app to find the cheapest gas in the area and will drive out of her
way to get gas there to save money.
Senator Gerald Dial said that the committee is working on a piece of legislation and that the five
state hearings are helping the committee to learn more about local challenges and how the
citizens of Alabama feel.
He said that any gas tax would involve a portion that comes right back to the local areas to assist
with their infrastructure.
MONTGOMERY - Senate President Pro Tern Del Marsh, R-Anniston, said his legislation
dealing with teachers' salaries and tenure would not tie their perfonnance to their pay.
"That is not in there," Marsh said Tuesday about the bill still being drafted.
He said he hopes to have it ready to be introduced next week when lawmakers return to
Montgomery for the 2016 session. But after its introduction, the bill likely could change as it
works its way through the Statehouse.
Marsh said his goal in the legislation is to pay beginning teachers the highest salary in the
Southeast, and increase the pay of long-tenn teachers, but to also be accountable to parents and
taxpayers.
He said a new version of his bill will include a different pay scale based on needs. For example,
if a system in rural Alabama lacks science teachers, "We want to pay them to go there," he said.

He also said he didn't want to pit teachers against each other. A new version of the bill could
include bonuses for systems where teachers work together to achieve certain goals.
According to a December draft, the nearly 50-page bill states school boards will adopt a new
salary schedule for paying teachers hired after May 1,2017. The "performance salary schedule"
will pay first-year teachers $2,500 more than the lowest-paid first-year teacher on the state's
salary schedule. It also provides for annual raises for high-perfonning teachers.
Under the draft bill, teachers hired before May 1, 2017, can opt for a perfonnance salary
schedule, but forfeit "all rights and protections associated with tenured status."
School choice
Marsh on Tuesday spoke briefly at a school choice rally on the Capitol lawn. He pushed for
charter schools in the state, approved last year, and the 2013 Alabama Accountability Act.
On Tuesday, he said if the demand is there, he in the future will move to raise the $30 million
cap on the Accountability Act's scholarship component. But he didn't think it would happen this
legislative session.
That act gives a tax credit of about $3,500 to families of students leaving the state's worst public
schools. The act also provides for a tax-credit-based scholarship program.
Last year, Marsh successfully sponsored legislation to raise the cap on scholarship-supporting
tax credits from $25 million to $30 million. That tax credit comes from the state's Education
Trust Fund, which supports public schools.
Increasing the cap means more students are served under the act, Marsh said.
"lfthe demand is there, I absolutely will (move to raise it)," he said.
Gov. Robert Bentley also spoke at the rally. He said one of his goals for the next three years is to
expand the state's voluntary pre-kindergarten program to reach all families who want to
participate.
Later, he said he'd like to see any education accountability measures to focus primarily on failing
schools.
"I think we need to put a focus on helping children in failing schools," Bentley said.
Rep. Terri Collins, R-Decatur, attended the rally. She chairs the House Education Policy
Committee. She said she isn't aware of any specific school choice legislation expected this
session, but lawmakers want to make sure legislation already passed is being implemented
correctly.

MONTGOMERY, Ala. - Alabama Senator Larry Stutts (R-Sheffield) says Alabama's new
"zero-based budgeting" method is forcing state agencies to "provide proof, line-by-line,
supporting their budget requests."
To this point, the State of Alabama, similar to the federal government, has used a form of
"baseline budgeting." This means that an agency's budget appropriation for this year serves as
the "baseline" - or starting point - for its appropriation next year, and it goes up from there.
Zero-based budgeting, a frequent rallying cry for conservatives on both the state and federal
levels, means agencies will start their budgets at $0, thereby forcing them to justify each dollar of
their funding requests year after year.
"For decades, agencies have come before the legislature and used the previous year's budget as a
starting point," Senator Stutts explained. '''Last year, our budget was $5 million, but this year we
need $5.3 million because of X, Y, and Z,' an agency head might say. But obviously, if the
previous year's budget is the baseline, agencies will always request additional tax dollars and
voila! The growth of government is never halted or reversed."
According to Senator Stutts, agency heads are now required to provide as justification for their
requests:
1. A detailed description of the agency which includes number of employees and contractors, and
its funding sources (state, local, federal, etc ... as well as earmarked funds);
2. A breakdown of each program or service provided by the agency, including its source(s) of
funding and a summary of citizens served;
3. A line-item breakdown of operational costs to run each office or location; salaries, benefits,
contracts, and travel;
4. A list of the agency's financial assets (including real estate) as well as their debts/liabilities;
and
5. Both a funding reduction plan and a cost-savings/efficiency plan.
The new budgeting method was imposed by House and Senate General Fund Budget Chairmen
Steve Clouse (R-Ozark) and Trip Pittman (R-Montrose).
"We have directed the Legislative Fiscal Office to request and obtain detailed budget-related
information from certain agencies that is in addition to the data typically required each year,"
they explained prior to pre-session budget hearings. "The information requested will be based on

data that the agency should already have on hand or have access to, and will be used by our
committee members and other legislative members during the preliminary budget hearings and
during the legislative session in the development of the state budgets."
In a followup email to House and Senate members, chairmen Clouse and Pittman further
explained their intensions.
"This budget cycle will look and feel different from previous years, given the detailed
information we will require and the zero-based budgeting method we will utilize," they wrote.
"In the past, agencies have simply requested the same amount of money they received the prior
year, plus any additional funding they thought they might need. From this point forward,
agencies will start from zero and provide a line-item, department-by-department breakdown of
their budget in order to justify their total request."
Senator Stutts added on Tuesday that moving to zero-based budgeting is an important step
toward eliminating waste in state government.
"Zero-based budgeting isn't meant to produce 'gotcha' moments of political theater," he said.
"But the tendency of government agencies is to seek growth and self-preservation. The
Legislature has a responsibility to the people of Alabama to root out waste and push state
agencies to operate more efficiently. Moving to a zero-based budgeting system is an important
step toward that goal."
2016 is shaping up to be another tumultuous year in Montgomery, coming off the divisive 2015
legislative sessions that fractured Republican lawmakers over tax increases, reforms and cuts.

A ribbon-cutting ceremony heralded the opening of the four-mile, $1 50-million connector that
links Vaughn RoadlHighway 110 to Interstate 85 in the Town of Pike Road.
It's a historic day that many state and city officials thought they might never see. Discussions for
the project date back to the 1980s, and initial construction on the overpass began 52 months ago.
Gov. Robert Bentley, along with county, city, federal and legislative representatives lauded the
collaboration used between government officials to get this far, despite the shortage in funding.
Transportation is that important, Bentley said.
liN ext to our military and our security, transportation is the second most important thing we can
do for our nation," Bentley said.
After news of the completion was released Monday, citizens of Montgomery County took to
Twitter and other social networks to express concerns about the safety of the structure, its height
and the lack of lighting.
Tony Harris, media relations for the Alabama Department of Transportation, addressed their
concerns.
"The Outer Loop roadway itself and the interchanges are built to federal design standards, so
safety is factored into the process and those have proven safe over time," Harris said.
Although the design is much like those seen in Birmingham and other major cities, safety starts
with the driver, Harris added.
"The key to safe roadways start with safe driver. We set speed limits and it will be important for
people to be mindful of that. We don't have enough law enforcement to police every person
every time," Harris said.
There are no lights on the Outer Loop now, but Harris said there is a light project scheduled to
begin later this year.
Although, funding for the additional phases of the Outer Loop is lacking, which would extend
the route to Highway 231 and eventually to 1-65, Bentley is committed to continuing what was
started, he said.
"We're proud of how this will help people of southern Montgomery County, It will help Pike
Road and this is just the beginning. There are long years down the road before we fmish,"
Bentley said. "We have to start somewhere and this is a great start."
The connector should help congestion around Chantilly Parkway and Waugh and Mitylene exits,
and allow more than 900 homes in the Town of Pike Road and east Montgomery direct access to
1-85 heading both south or north.

Ease of access and convenience is an important characteristic for the area, according to Pike
Road mayor, Gordon Stone.
"This will help the quality of life here," Stone said. "Over 900 homes will now have access to an
instant route to downtown Montgomery, Auburn, to Atlanta and other places they are traveling
either for work or pleasure."
It also allows easier access for businesses and traffic from out of state, leading to commerce,
Montgomery District 5 Commissioner Andrew Hall said.
"This is the first link in a chain that will be the Outer Loop that holds the key to growth, future
businesses coming here and prosperity in Montgomery County," Hall said.
Alabama legislators Reed Ingram and Thad McClammy were in attendance and made special
notes of appreciation to former Montgomery Mayor, Emory Folmar, who spearheaded the idea
of an Outer Loop.
When completed, the $500 million, 20-mile-Iong highway will connect 1-85 to 1-65 and provide
a commercial route to Mobile, something current Montgomery Mayor Todd Strange is hopeful
for.
tIlt takes hard work and we need to find the revenue," Strange said. "This cannot be the end. We
have to keep this dream alive and keep pushing forward."

A proposed bill would forbid questions about criminal histories onjob applications while
allowing employers to make those inquiries later in the hiring process.
Senate Minority Leader Quinton Ross, D-Montgomery, told the Alabama Prison Reform Task
Force Tuesday his proposal would be "identical" to legislation filed in the 2015 regular session.
The legislation died in committee.

Employers would be able to ask applicants questions about previous convictions if they made a
conditional job offer. There would be an exemption for convictions related to the position
sought.
At least 19 states have enacted a version of the law, known as "Ban the Box."
Ross told the Task Force that while employers would still be able to decide who to hire,
removing the criminal history question from an application would give a former inmate a better
shot at a job.
"What we're looking to do in Alabama is just provide a fair chance, a fair chance policy for
individuals caught in our penal system to have a job, or at least have the chance at having a job,"
Ross said.
The legislation would also remove criminal history inquiries for applications for state licenses.
"We don't want to prevent people from becoming a barber or a cosmetologist just because
they've been caught in the penal system," Ross said.
Reaction on the committee ranged from enthusiasm to qualified support. Sen. Cam Ward, R-
Alabaster, the chairman of the Task Force, sounded supportive of the licensure changes. But he
asked Ross about comments from employers, who he said were more concerned about inmates
convicted of white collar crimes than those convicted of other offenses, such as wire fraud or
embezzlement.
"I don't want that person back in here because they'll come back into my business and steal a
bunch of money again," he said.
Ross said he believed the exemption for convictions related to the job would cover that scenario.
Sen. Vivian Davis Figures, D-Mobile, said removing the question from the application would
allow applicants "to explain themselves" when it came to past history.
"There are people who committed crimes in their teenage years or young adult years, and then
years later it's still there," she said.
Ross also plans to file legislation that would give tax credits to employers who hire former
inmates. An employer would receive an income tax credit of$l,OOO for every inmate employed
for seven months or more. The employer could take the credit for up to four years per employee.
The Prison Reform Task Force, formed in 2014 to take steps to address the overcrowding crisis
in the state's prison system, plans to make mental health its next focus. Ward said in an interview

before the meeting that up to 55 percent of the prison population faces some mental health issue,
and spoke of moves to better coordinate care with the Alabama Department of Mental Health.
"There is some resource building that will occur," said Jim Perdue, the commissioner of the
department, adding that "this will also mean that there will be some changes in the law."
The Task Force also heard from Ebony Howard, a managing attorney with the Southern Poverty
Law Center who works on juvenile justice issues. Howard urged the committee to work to
separate juveniles charged as adults from general prison populations. She said most committed
crimes like theft and burglary.
Those are "crimes we do not want kids to engage in," she said, but added putting juveniles into
the adult system created problems. Howard said those juveniles could be targets for older
inmates, and upon release - after an average sentence of three to five years - could come out
with other problems. She also urged the committee to give those juveniles "opportunities ... to
achieve redemption."
The Alabama Legislature last year passed sweeping legislation to address the state's prison
ov·ercrowding. Ward noted the legislation, based on Task Force recommendations, goes into
effect at the end of the week.
District Attorney Brandon Falls said slot machines are illegal throughout Alabama but some
gaming operators think because of recent tum of events they could get away with electronic
bingo or other types of electronic gambling in Jefferson County.
The sheriffs office got reports of the 20 machines operating at 1421 Forestdale Boulevard in
Forestdale. No one was arrested from the weekend bust.
District Attorney Falls said confusion has erupted with Governor Robert Bentley saying the
Attorney General's office will not take the lead in closing down illegal gambling, leaving the
matter up to local prosecutors and the sheriffs office.
At this time, only Macon and Greene counties have passed constitutional amendments to allow
for electronic gambling machines. Jefferson County has not.

Falls said he heard some planned to open, so two weeks ago he put the word out that he would
bust them if they opened.
"If you are looking at opening a business in Jefferson County with gambling being the resource
or even bingo, electronic bingo, as a revenue source, you really need to be looking at other states
and just moving it on down the road." Falls said.
Falls said once he put out his message out on Jan. 15 not to open in Jefferson County, he heard of
another Forestdale business which said it would not open.
Falls is hoping more will get the message after this weekend.
Alabama joined 24 other states Tuesday in petitioning the u.s. Supreme Court to halt
implementation of the Environmental Protection Agency's Clean Power Plan while legal
challenges to the law move forward.
Alabama was among the states that filed suit challenging the CPP on the day it was published in
the Federal Register, but an appeals court this week denied the states' request for a stay to block
implementation of the law until a decision is reached.
The latest filing asks the Supreme Court to do what the appeals court would not.
"Once again, President Obama has attempted to radically expand the power of the federal
government by adopting policies through executive action that Congress has refused to enact,"
Alabama Attorney General Luther Strange said in a news release. "But the scope of President
Obama'sjob-killing Clean Power Plan is unprecedented. If this new EPA rule is allowed to go
into effect, it will shutter coal-fired power plants around the country, resulting in higher
electricity costs and fewer jobs."
The Clean Power Plan aims to decrease overall carbon emissions from power plants nationwide
by 32 percent from 2005 levels by 2030. It's seen as a cornerstone of President Barack Obama's
efforts to combat climate change.
States are required to submit state implementation plans to reach compliance with their
individual emissions targets by Sept. 6, 2016, or at least apply for extensions by that date.

The petitioners argued in their court filing that complying with the rule now would force them
"to take irreversible actions-amending state laws and regulations, making irrecoverable
expenditures, and undertaking planning and investment decisions, including retiring plants,"
steps that could not be undone if the rule is later invalidated.
Strange said the Court "should act to immediately stay this rule until the lower courts can address
the serious concerns the states have raised about its legality."
At present, Alabama has not begun working on its state implementation plan.
"We're optimistic about a stay. We don't see any sense in working on it now until there's a ruling
on that," Gore told Bloomberg earlier this month.
Barring a judicial stay, states that have not submitted a plan for compliance by Sept. 6 risk
having a federal plan implemented instead. Gore told Bloomberg he feels that the state still has
enough time to develop a plan before that deadline.
West Virginia and Texas led the group of mostly Republican states that asked Chief Justice John
Roberts to immediately bar the Environmental Protection Agency from enforcing the Clean
Power Plan. Roberts can consider the application on his own or refer it to the full court.
The move came after an appeals court in Washington last week denied a similar request, handing
a significant procedural victory to the Obama administration.
The federal plan aims to stave off the worst predicted impacts of climate change by reducing
carbon dioxide emissions at existing power plants by about one-third by 2030. The plan also
encourages more development of alternative energy sources such as wind and solar by further
ratcheting down any emissions allowed from new coal-fired power.

Arguments before the U.S. Court of Appeals for the District of Columbia Circuit are set to begin
June 2. Under the Clean Air Act, certain challenges to new EPA rules skip the federal district
court and go directly to the appeals court.
West Virginia Attorney General Patrick Morrisey warned that it could take six months or more
to decide the case at the appellate level, perhaps stretching into 2017.
"Without Supreme Court intervention, West Virginia and other states will suffer irreparable harm
as job creators and state agencies spend untold resources to comply with a rule that is likely to be
struck down as illegal, tI Morrisey said Tuesday. "Real people are hurting in West Virginia and
it's my job to fight for them. tI
Like West Virginia and Texas, many of the states opposing the plan are dependent on economic
activity tied to such fossil fuels as coal, oil and gas.
Implementation of the rules is considered essential to the United States meeting emissions-
reduction targets in a global climate agreement signed in Paris last month. The Obama
administration and environmental groups also say the plan will spur new clean-energy jobs.
Three moms, three children suffering from various forms of epilepsy, three different stories
trying to share one message:
In Alabama, that potential law has been dubbed Leni's Law and state Rep. Mike Ball, R-
Huntsville, is the bill's sponsor. Sen. Paul Sanford, R-Huntsville, will carry the bill in the Senate.
On Monday, the three moms addressed the Madison County legislative delegation at its annual
public forum. Their singular message came from three different vantage points:
-One mom said her child has never had a drop of CBD oil because she was not accepted into the
Carly's Law study at UAB.
-One mom said her child has flourished in receiving the CBD oil in the VAB.
-One mom said her child had to withdraw from the UAB study, not because ofthe CBD oil but
because of complications from pharmaceutical medications.
Possession of the marijuana oil is illegal in Alabama unless the recipient is protected by Carly's
Law.

"Parents need to be able to not worry about whether they are going to jail to try to save our
children," said Jodi Mitchell, whose son Robert was forced to leave the DAB study. "There is
nothing in this world worse than watching them suffer. We need help. We need y'alls help.
"There is no reason I should have to consider becoming a criminal to help my child because I
live in the wrong ZIP code."
Kari Forsyth told legislators that her daughter, Chesney, was not accepted into the DAB study.
The family last month visited with Young family in Oregon - where they had relocated from
Wetumpka so that their daughter, Leni, could have access to CBD oil.
Leni's improvement while taking the CBD oil is what Ball said drove him to sponsor the bill.
The bill is called Leni's Law and "the people I've talked to about it seem very receptive to it."
"I've seen a dramatic improvement made with Leni," Forsyth said, accompanied by Chesney.
"She can look you in the eyes, she is starting to babble. She has a voice."
Forsyth also told lawmakers she is awaiting approval for a medical marijuana card from Oregon
for Chesney.
"If I was to give her the oil now, I would be considered a criminal," she said. "I'm not a criminal.
I might speed occasionally but I'm not a criminal.
"Leni and many other kids and people are your proof it works. Please stand with us parents and
help us giving the kids of Alabama their best quality of life. "
Ball and Sanford teamed in 2014 to pass Carly's Law without dissent in the legislature and it was
signed into law by Gov. Robert Bentley. Despite the initial celebration that accompanied the law,
Sanford said the law did not meet its intentions - citing the restrictions applied to the study group
at DAB by the Federal Drug Administration.
"I want to personally apologize to y'all for not getting the bill to where it could help your
daughter," Sanford said. "Carly's Law ended up not what we wanted it to be but it was the best
we could do at the time.
"I think you will see Rep. Ball and myself fight to get government out of the way so you can help
your children."
Isla Swanson represents the potential for medical marijuana oil, her mother, Jessica, said.
Isla would have up to eight grand mal seizures (loss of consciousness, violent muscle
contractions) a day despite taking dozens of pharmaceutical medications, a special diet and
surgery for a vagal nerve stimulator.

Now with access to CBD oil, Jessica said her daughter has been seizure-free for more than six
months and her pharmaceutical medications have been reduced by 82 percent.
"She is now learning to play like a typical 3 year old, she interacts with us now and is not
(oblivious) to the world around her due to seizure interference and high pharmaceutical
medicines," Jessica said.
"With that said, Isla shouldn't be part of just a handful of children in a small study to reap those
benefits. Those that are able to obtain CBD oil, a medicine, shouldn't have to fear prosecution for
trying to save their children's lives."

MONTGOMERY, AL (WSFA) - If two conservative groups have their way, a member of Gov.
Robert Bentley's own party may give a rebuttal following his annual State of the State address
set for Feb. 2.
The Alabama Tea Party Conservative Coalition and the Common Sense Campaign are pushing
outspoken State Auditor Jim Zeigler to respond to Bentley's speech.
"We believe that the Governor has abandoned many of the conservative values that brought him
to power and as such, tax paying. (SIC) Anti-establishment conservatives have a right to hear a
rebuttal from one of their own to both the Governor and the Democrats who who will have their
own response," wrote Dr. Lou Campomenosi, the President of CSC, in a letter provided to the
media by Ziegler's office.
Ziegler has publicly stated his opposition to numerous positions of the Bentley administration,
including proposals for hefty tax increases during the 2015 legislative session, removal of
Confederate flags from the capitol complex, spending BP settlement money to repair a coastal
governor's mansion, and removal of the Wallace gubernatorial portraits from the Capitol rotunda.
The auditor says he'll make a decision later in the week on whether he'll write a rebuttal.

RALEIGH, N.C. - A federal appeals court will consider whether county commissioners in
North Carolina violated the Constitution by delivering Christian prayers at their meetings and
inviting audience members to join.
The case marks the first time a federal appeals court has considered how local councils conduct
prayers since a 2014 U.S. Supreme Court ruling upheld a New York town's use of predominantly
Christian invocations at its meetings.
A three-judge panel of the 4th Circuit Court of Appeals is scheduled on Wednesday to hear
Rowan County's effort to overturn a federal judge's ruling that local officials ran afoul of
constitutional requirements separating church and state.
There is a key difference between the two cases: Rowan County commissioners delivered the
prayers themselves, while the Town Board in Greece, New York, invited local clergy or
laypeople to do so, according to a previous ruling by a federal judge in North Carolina.
The plaintiffs in the lawsuit filed in North Carolina claim the elected officials' delivery of the
prayers was coercive, while the defendants argue that it's not unconstitutional for lawmakers to
lead prayers.
The original lawsuit, filed by the American Civil Liberties Union on behalf of three residents,
said nearly all prayers that opened Rowan County Commission meetings between 2007 and 2013
were Christian. Prayers typically ended with phrases such as "in the name of Jesus" or "in the
know ledge of our Lord and Savior Jesus Christ," their lawsuit said.
The plaintiffs, who are not Christians, said the prayers made them feel excluded and sent the
message that the board favored a particular religion. They said they felt pressured to stand and
participate because the commission and most of the audience would do so.
The board had no written policy on prayer, but county commissioners said in court documents
that they were following a long-standing tradition and took turns delivering the prayer. They said
citizens could leave the room or arrive after the prayer without affecting their ability to
participate in the meetings.
The ACLU wrote the commission in February 2012 saying the prayers violated the Constitution.
A federal court issued a preliminary injunction in 2013 halting the practice, and the judge made
his decision permanent in May, nearly a year after the Supreme Court ruling.
Calling Rowan County's practice "unconstitutionally coercive," U.S. District Judge James Beaty
Jr. noted "that Commissioners themselves are the sole prayer-writers and prayer-givers,"
distinguishing the case from the one decided by the Supreme Court.
In recent months, the commission has had a chaplain deliver the opening prayer.

A lawyer for the National Center for Life and Liberty, which is representing Rowan County, said
the county's practice has never been coercive.
"People can leave the room if they don't want to hear the prayer," Barbara Weller said.
Chris Brook, a lawyer for the ACLU, said the case marks the first time a federal appeals court
has considered legislative prayer since the 2014 Supreme Court case.
"It's so important that citizens are able to engage with their government and with their elected
officials without being coerced to adopt their religious beliefs," Brook said.
The appeals court ruling could affect how legislative prayer is handled across the states that
make up the 4th Circuit: Maryland, North Carolina, South Carolina, Virginia and West Virginia.
The appeals court in Richmond is expected to issue a written ruling sometime after this week's
hearing. The Supreme Court ruling had already prompted some local boards to review or modify
their prayer practices.
"Whatever ruling they hand down will certainly be watched closely by local governing boards
and other Southern states," said Michael Bitzer, a professor of political science at Catawba
College in Rowan County.
William Marshall, a law professor at the University of North Carolina, said the Supreme Court
ruling left a number of questions open, such as what effect sectarian prayers may have on those
who appear before local commissions.
"The reason why the court is dealing with this issue and why it was appealed is that there are a
lot of ambiguities in what the law is," he said.
