the HEIRS-DECLARANT of the late RAISIMA LORESTO-TATUD, and;

ESTILITA LORESTO, of legal age, widow of the late NICANOR LORESTO,

Filipino;

JIMMAR GAYATGAY YANONG, of legal age, married, Filipino, son of the late
MARLYN LORESTO GAYATGAY-YANONG;

TERESA LORESTO GAYATGAY-SUMBANG, of legal age, married, Filipino;

SERGIO LORESTO GAYATGAY, of legal age, married, Filipino;

SEVERINO LORESTO GAYATGAY, JR., of legal age, married, Filipino;

GUIDION LORESTO GAYATGAY, of legal age, single, Fil;ipino;

VENUS LORESTO GAYATGAY-ALOSNOS, of legal age, married, Filipino;

VIRGENIA LORESTO GAYATGAY-OLSSON, of legal age, married, Filipino;

All of whom are residing in Bulata, Cauayan, Negros Occidental, hereinafter referred to as
the HEIRS-DECLARANT of the late PROCOPIO LORESTO;

WITNESSETH

That the above-names parties, are the surviving heirs and children of the late
Spouses PROCORPIO LORESTO married to LUCINA GAYONA, RICARDO LORESTO
and Spouses REYSIMA/RAISIMA LORESTO married to CASIMIRO CATOTO/TATUD,
all died at Cauayan, Negros Occidental and left without a will;

That the deceased, at the time of their deaths, has left a parcel of land, registered in
their names, known as Lot 2967-B covered with TCT No. T-65470, situated at the
Municipality of Cauayan, Negros Occidental, consisting an area of Five Thousand Six
Hundred Twelve (5, 612) square meters, more or less;

That to the best of our knowledge and information, the deceased left no outstanding
debts or obligation in favor of any person or entity nor any LAST WILL or
TESTAMENTS;

That pursuant to the Sec. 1, Rule 74 of the revised Rules of Court of the Philippines,
and the parties hereto being all of legal ages and with full civil capacity to contract, hereby
by these presents agreed to divide as they do hereby DIVIDE and ADJUDICATE, among
themselves the above-described property;

That by these presents, we hereby agree, declare and partition, among ourselves
that above-described parcel of land with the following share for their heirs, as follows:
Heirs of the late RAISIMA LORESTO TATUD, are DIONISIO LORESTO TATUD,
NELSON LORESTO TATUD, EDISON LORESTO TATUD, JOSE LORESTO TATUD,
CASIMERO LORESTO TATUD, JR., ANNABEL LORESTO TATUD-TUMPAG, and
ANELYN LORESTO TATUD-CAINGLET, three-fourth (3/4) SHARE;

Heirs of the late PROCOPIO LORESTO, namely ESTELITA LORESTO, one-

eight (1/8) SHARE, JIMMAR GAYATGAY YANONG, TERESA LORESTO
GAYATGAY-SUMBANG, SERGIO LORESTO GAYATGAY, SEVERINO LORESTO
GAYATGAY, JR., GUIDION LORESTO GAYATGAY, VENUS LORESTO
GAYATGAY-ALOSNOS, and VIRGENIA LORESTO GAYATGAY-OLSSON, one-eight
(1/8) SHARE.
