Te call was ispatched within seconds and critical updates ofthe suspect's description, vehicle information, and direction of travel ‘were provided as they were received. All deputies in District 1 were engaged in the incident and District 3 Deputies ‘were designated to handle their calls for service. District 2 Deputies were also advised to BOLO forthe vehicle. ‘Shortly after the call was dispatched, the suspect's vehicle was observed heading north on I-75 towards Lee County {and a vehicle pursuit was initiated. Communications notified the Lee County Sheriff's Office of the pursuit heading towards ther jurisdiction and Lee County quickly dispatched their units; withthe communication centers patching the dios to multiple channels. As the suspect's vehicle exited I-75, CCSO deputies were able to successfully perform a PIT maneuver and held both the diver and the front passenger at gunpoint while the LCSO deputies pursued the two ‘ear passengers who had fled on foot into a nearby wooded area. The vehicle was submerged and overtumed in the 10’ canal, with the vitim stil inside, underwater and lunconscious. Observing that he was not breathing and had no pulse, you brought him to land and began CPR. Through collective lifesaving measures, the victim regained a pulse and began 1 breathe. Four subjects in a red pickup entered the store and stole several botles of liquor. One of the subjects, as he fed to the truck, was tackiod and detained by the owner and customers until deputies arrived on scene. The other three involved subjects fled the scene inthe red truck. Within one hour these three subjects commitied an armed robbery, ‘attempted robbery, aggravated assault, burglary to a conveyance, and a grand theft. They also fled the scene in a 2015 DISTINGUISHED PUBLIC SERVICE AWARDS Corporal Robert Lewis's hard work, dedication and loyalty to the Sheriff's Office have earned him the reputation of being a go getter and an effective deputy. Corporal Lewis does not stop until the job gets completed. His superior performance of his duties this year has earned him the nomination “Safety Officer for the year”. Corporal Lewis is a member of the DUI Task force and during this year Corporal Lewis has had 49 DUI arrests, 15 drug arrests, 24 driving with no river license arrests, 27 other arrests, given 454 citations, given 1,236 warnings, and conducted 66 vehicle crashes. These statistics are amazing and it shows how hard Corporal Lewis works during his shifts. The following are some examples of Corporal Lewis's outstanding police work here in Collier County. On September 12, 2014 Corporal Lewis was conducting a traffic stop on a vehicle for making an illegal U-turn. During this stop, Corporal Lewis detected the odor of marijuana emitting from the vehicle. During a search of the vehicle the suspect indicated there was ‘marijuana in the trunk. 95.9 grams were located in a backpack within the trunk of this vehicle. ‘The subject admitted the marijuana was his. He was subsequently placed under arrest for Possession of marijuana. Additionally that same night Corporal Lewis conducted another vehicle stop which resulted in another drug arrest due to the subject possessing 30 grams of ‘marijuana, On April 15", 2015 a driver of a red vehicle was seen driving at a high rate of speed. The driver disregarded a stop sign and the vehicle collided with a guard rail causing the vehicle to flip and land in the canal upside down. When Corporal Lewis arrived on scene and without hesitation he doffed his ‘gear and jumped into the water to rescue the entrapped driver. Corporal Lewis disregarded his own safety and successfully rescued the entrapped driver from the submerged vehicle. On April 10", 2015 an armed robbery just occurred at a Circle-K store. The Circle-K clerk reported that two masked subjects entered the store and one of the subjects was armed with a firearm and he demanded the clerk to surrender her vehicle keys as well as the keys to the store. Afterwards the subjects got into a tan vehicle and fled the scene. At that time Corporal Lewis was in the vicinity and he immediately observed a tan vehicle. Corporal Lewis got behind the vehicle and followed the vehicle and on I-75 Corporal Lewis attempted to perform an investigatory stop on the tan vehicle. The tan vehicle pulled over and stopped, and then the vehicle immediately took off and accelerated over 100 miles per hour. At that time Corporal Lewis declared a vehicle pursuit on I-75. The tan vehicle exited I-75 and Corporal Lewis attempted to a PIT maneuver which was unsuccessful; however, the tan vehicle suffered a flat tire from the PIT maneuver. As the tan vehicle continued to flee it made a high speed left turn. ‘The driver lost control of the tan vehicle and it came to a stop facing directly in front of Corporal Lewis’s patrol vehicle. The four occupants of the vehicle were held at gunpoint by Corporal Lewis alone until more units arrived. The two rear passengers fled on foot, but were captured later. When back up units finally arrived Corporal Lewis secured the front seat passenger and driver. Corporal Lewis's alertness and exceptional attention to detail lead to the arrest of four suspects that committed the Armed Robbery at the Circle-K. Additionally, Corporal Lewis received a very honorable award from Mother Against Drunk Driving (MADD) for his outstanding performance in his DUI enforcement for the entire southwest region, Also, he entered his CCSO ghost vehicle in a National police vehicle contest. This nomination of the CCSO ghost vehicle won the National Contest in the Law and Order ‘Magazine for the “Best Ford Police Interceptor Sedan”. During Corporal Lewis’s off hours he attends Barry University and is working diligently towards his Bachelor’s Degree. Dennis Michael Chesley. The Collier County Sheriff's Office agency report number is 2015-01720. The defendant was charged with DUI. This information was learned after Deputy Lewis had a telephone conversation with an Assistant State Attorney (ASA) in the Naples office on December 29, 2015. A brief recitation of the facts follows: The defense attorney called the ASA to inform her of irregularities with the discovery materials that the SAO had received from your agency and, in turn, disclosed to the defense, These materials included a single breath test affidavit which indicated a BAC level above a .08. However, the defense attorney accessed the FDLE website and learned that the defendant actually blew into two (2) intoxilyzer instruments on the day of his arrest. The ASA checked the case and could find no evidence that another intoxilyzer instrument was utilized. We did not receive a second breath test affidavit nor was there any indication in the case report that two intoxilyzers were used. ‘The ASA then called Deputy Lewis to discuss the allegationis made by the defense attorney and asked for ‘an explanation as to why we were not given the breath test affidavit from the other intoxilyzer. During their conversation, Deputy Lewis indicated that he was aware of the issue but that he had ‘intentionally Jeft that out {the other breath test affidavit] so that I could avoid a situation like this,” Deputy Lewis ‘ further indicated that he does DU! investigations so frequently that he could not remember the problem with the intoxilyzer but felt the problem was probably an RFI issue (radio frequency interference) Additionally, the ASA searched the CCSO laserfiche system and found that no documents relating to the use of the other intoxilyzer had been made part of the agency case file. Afterwards, it was determined through the defense attorney and the FDLE website that the problem was not RFI but that there was a “purge fail” indicator with the undisclosed intoxilyizer, This information was potentially exculpatory, subject to Brady disclosure requirements, and intentionally withheld by Deputy Lewis. The Honorable Kevin Rambosk January 7, 2016 Page Two Based upon this information, my office filed a Notice of Nolle Prosse. This incident, coupled with the incident from last summer with the jurors in the Collier County Court House Complex garage, leads me to conclude that Deputy Robbie Lewis ean no longer be utilized, under any circumstances, as a witness for the prosecution, The intentional withholding of evidence in a criminal case implicates my office and the legal and ethical obligations of each individual Assistant State Attorney. ‘One of the bedrock concepts of due process is that the police and prosecutors are sworn to seek justice, not merely convictions. The United States Supreme Court has made it clear that prosecutors are ethically required to disclose any evidence which might tend to exonerate or exculpate those being prosecuted.
