Enriquez vs CA

FACTS:

Petitioner Sebastian Enriquez got married to Respondent Adalia Enriquez on 1957 and eventually
separated on 1970. Cresencio Enriquez is the son of the spouses Sebastian and Adalia Enriquez who the
title of the question lot named after him. Respondent Adalia Enriquez filed a petition to be the co owner
of the property in question, a lot of 160 square meters with apartment building located at Makati City.
Cresencio Enriquez borrowed money in Philippine National Bank and GSIS for the construction of the
building using the lot as collateral. Adalia Enriquez claimed that Sebastian Enriquez borrowed from her
before the marriage to buy the lot in question. ESSO Phil. Inc. Lease the said lot, in December 7, 1970
the deed of exchange executed by Cresencio and ESSO Phil. Inc.

ISSUE:

Whether or not adalia may be a co-owner of the property in question.

HELD:

Yes, the money to buy the lot is a conjugal partnership of Adalia and Sebastian Enriquez. The court
affirmed that the property in question belongs to the conjugal partnership of Adalia and Sebastian
Enriquez.
