AFFIDAVIT
I, Gildaze C. Jomolod, of legal age, married, residing at No. 129 Narra St. Brgy.
Amihan, Project 3 Quezon City, after having sworn to in accordance with law
hereby depose and state that:
1. That on April 13, 2018 around 1:40 in the afternoon, I was in Zen Institute
medical spa together with my cousin, Bismarck de Guzman. We used my
Hyundai Elantra car with Plate Number MT 5147 which was driven by
Bismarck. Bismarck was at that time having a cautery treatment, when the
guard asked me to tell Bismarck to transfer my parked vehicle. I then went
to the treatment room where my cousin was having a cautery treatment.

2. As he was in the middle of his cautery treatment, he asked me to transfer

the vehicle myself. At that time, I only have a student license. I drove the car
and turned on the warning hazard. Thereafter, there was a loud crash from
my behind and it occurred to me that I had a collision with a grab driver who
was at that time unloading a passenger.

3. The Grab driver then shouted at me and stated that “babayadan mo ang kita
ko sa Grab per day habang nasa kasa ang sasakyan ko, hindi sa akin yan.”
I pleaded with the driver stating that the matter should be referred and
reported to the police. He then stated “akina lisensya mo”. I was holding at
that time a student license. He then said “student ka pala eh anong number
mo itetext kita kase babyahe pa ako”

4. I gave my number to the Grab driver. The guard on ground then said to him
that he was the one at fault so he should fix the situation. But the Grab driver
insisted otherwise and said that he will just text me. He left without waiting
for the arrival of the police.

5. My cousin then said that the matter should not be delve upon as the same
was a minor collision and in fact the Grab driver was the one at fault.
However, upon checking with the guard log sheet he failed to report the
collision incident and the guard on duty had already resigned from service.

6. Herein attached as Annex “A” are photos of the collision and a photo
showing the Driver License of a certain Necasio Cabahug, who was the
Grab Driver of a Toyota Vios with Plate Number YO2678.

7. Based on the position of the vehicles, in the attached photo, it is apparent

that the vehicle driven by the Grab driver, identified as Necasio Cabahug,
crashed to the left rear portion of my vehicle and should therefore be made
to pay the damages attributable to the said incident.
