III. FACTS OF THE CASE

6. At about 12:30 PM of August 15, 2019, married couple Aldrin Broniola, 27


years old, and Crisel Ann Broniola, 27 years old, residents of 003 Saint
Augustine Street, Janssenville Subdivision, Brgy. San Juan, Cainta Rizal,
seek police assistance upon discovery of a robbery done in their house
while they were away, by an unidentified suspect/s taking away one (1)
laptop amounting to Php 20,000, one 1 (one) piggy bank containing Php
5,000 and cash amounting to Php 8,000. Upon receipt of report, PNP
personnel of Cainta MPS immediately proceeded to the place of the incident
to conduct investigation.
7. Upon follow-up and further investigation conducted by the same officer,
SPO2 Joshua Ventolina, he reviewed two CCTV cameras positioned on the
house opposite of the place of incident, and another inside of the house of
incident itself. At about 1:30 AM the former recorded one (1) middle aged
man, stopping in front of the gate of the said house carrying a backpack,
inthat backpack he took out a plier and proceeded to destroy the padlock of
the gate, therefore granting the suspect initial access, he then tried to pick
the front door lock for about 10 minutes, but eventually gave up after
multiple failed attempts and proceeded to smash a window on the side of
the house leading to the bathroom. The latter then showed the suspect
roaming around the house, going from one room to the other, at one point
he notices the camera, and proceeding to cover it with a cloth, unbeknownst
to him that his identity has already been revealed.
8. In the statement of a witness identified as Khein Tiffany Pagado y Giltendez,
28 years old, married, Psychiatric Doctor at Metro Psych Facility, revealed
that at about 2:30 AM while she was on her way home from work, upon
reaching the place of incident she saw the suspect (middle age) leaving the
aforesaid place while carrying unknown items and run towards the opposing
side of the street. She further identified the suspect with certainty, as Mc
Laurence Medina, who is a resident of the same subdivision.

IV. DISCUSSION

9. In this instant case under investigation, the complaining party, Aldrin


Broiniola and Crisel Ann Tadia y Broniola, filed a lawsuit against Mc
Laurence Navarro y Medina, 30 years old, resident of 212 Saint Mark Street,
Janssenville Subdivision, Brgy, San Juan, Cainta, Rizal, based on the
statement made by the witness, Khein Tiffany Pagado y Giltendez, where
she personally saw the suspect go out of the house carrying the supposed
stolen items, a laptop worth Php 20,000, a piggy bank containing Php 5,000,
and cash worth Php 8,000. Supporting the evidence is a recorded tape of
the suspect breaking into and roaming around the house, also having an
attempt to conceal his identity by covering the CCTV camera located inside
the living quarters of the house.

V. CONCLUSION

10. After a careful perusal surrounding this particular incident, the witness
testament and recordings of the CCTV cameras positioned along and inside
the perimeter, provided enough evidence to determine the suspect and
request for a warrant of arrest. Medina was then on brought into custody for
proper questioning.

VI. RECOMMENDATION
11. Wherefore in view of the foregoing, this office hereby recommends that a
Case for Robbery be filed against Mc Laurence Navarro y Medina, 30 years
old, resident of 212 Saint Mark Street, Janssenville Subdivision, Brgy, San
Juan, Cainta, Rizal.
