1. The Hon'ble Supreme Court of India has pronounced judgement on 18.02.2016 in Civil
Appeal No.4142/2004 with C.A.No.4147/2004 filed by Sri D. Vishnu Murthy against the
Hon'ble A.P. High Court Orders dt.21.11.2003 n W.P.No.17497, 18319, 18681 & 19041
of 1999. In the judgement, it is ordered to reverse the seniority fixed earlier based on
the orders of Hon'ble High Court of Andhra Pradesh and rework the benefits to be
granted to the appellants in accordance with the law.

2. Government vide Memo 3rd cited constituted a Committee to finalize the seniority from
the Assistant Executive Engineer Cadre and recommended that the seniority may be
prepared based on merit marks and the Engineer-in-Chief (Admn.) may follow the same
for all batches and publish the final seniority lists in accordance with the Hon’ble
Supreme Court orders dated 16.07.2008 in Civil Appeal No. 4455 of 2008 (Arising out of
SLP (C) No. 9895/2006.

3. Further, the Hon’ble High Court orders dated 29.01.2018in W.P. No. 41639/2017 have
ordered as follows:

“Learned Government Pleader appearing on behalf of the State of Telangana, on


instructions, submits that the whole process will be completed and list will be furnished
to Government of Andhra Pradesh on or before 08.02.2018.

Learned Government Pleader appearing on behalf of the State of Andhra Pradesh


has assured this Court that within four months from the receipt of the list from the
State of Telangana, the seniority list of Deputy Executive Engineers and above cadres of
zones V and VI, will be finalized.

In view of the aforesaid statements made by the learned Government Pleaders


appearing on behalf of the States of Telangana and Andhra Pradesh, we, hereby,
dispose of the present petition. Needless to state that, if any of the States fail to
comply the directions of this Court, the same would amount to contempt of Court.

As a sequel, miscellaneous petitions, if any, pending in the petition, stand


closed.”

4. Further, Government memo 7th cited, has requested to examine the proposal sent by
the Special Chief Secretary to Government (FAC), I&CAD Department, Telangana,
Secretariat in detail, and prepare the integrated final seniority list of AEEs, AEs and
Technical Officers of zone V and VI for taking up promotions for all cadres up to
01.06.2014 as per Rules, duly keeping the orders of High Court for Andhra Pradesh and
Telangana States in view within the time prescribed to avoid further legal complications
in the matter.

5. Accordingly, in pursuance to the Hon’ble Supreme Court orders dated 18.02.2016


in Civil Appeal No. 4142/2014 with C.A.No.4147/2004, 16.07.2008 in Civil Appeal No.
4455 of 2008 (Arising out of SLP (C) No. 9895/2006 and 27.09.2016 in CA No.
9821/2014 filed by Sri R. Venkata Ramudu and others and Hon’ble High Court orders
dated 29.01.2018, the provisional seniority list of Assistant Executive Engineers from
1985 PSC to 2007 has been prepared as per the instructions of the Government and
recommendations of the five member committee.
6. The provisional seniority list of Assistant Executive Engineers from 1985 PSC to 2007
PSC including A/T Assistant Executive Engineers now prepared is in supersession to the
final seniority list communicated vide this Office Circular dt.18.10.2012. The provisional
seniority list is available on the web site www.irrigationap.cgg.gov.in.

7. All the concerned Engineers of zone V and Zone VI (working and retired) are requested
to submit their objections if any regarding the provisional seniority on or before
02.05.2018 directly to this Office or through email ID encawap@gmail.com.

8. In case, no objections are received within the stipulated time, it will be construed that
there are no objections and the list will be finalized. No separate seniority list will be
communicated to each individual.

Errummanzil, Hyderabad with a request to circulate the seniority list among the Engineers (in
service and retired) of Zone-V and VI and presently working in their Department.

Copy submitted to the Special Chief Secretary to Government, I&CAD Department, Telangana
State, T.S. Secretariat, Hyderabad for favour information.

Copy to DEE (Computer) O/o ENC (Admn.) for placing the circular memo in the web-site.
