Toxic and Hazardous Waste Management Act (RA 6969)

a. Who are the technical professionals expected to be involved in the implementation of

the specific law.

• The DENR is the primary government agency responsible for the implementation and
enforcement of this Act, with the support of other government organizations, local
government units, non -government organizations and the private sector.

b. How can this specific law help in addressing environmental issues?

• It provides for the regulation of all chemical substances that may pose threat to public
health and the environment through import, manufacture, sale, use, distribution, and
disposal as well as the regulation of all hazardous wastes from generation, transport,
storage, re-use/recycling, treatment and disposal

• Registration of the following is required to ensure that industrial economic growth is

achieved in an environmentally sound manner to effectively manage hazardous wastes
in order to minimize human and environmental impacts cause by industrial activities:

o Hazardous wastes generators

o Hazardous wastes treater

o Hazardous wastes transporter

c. What gaps could be seen in the implementation of such law.

• The gaps identified by stakeholders highlighted that the challenges are not from lack
of regulation but instead stem from issues related to enforcement, lack of
infrastructure for compliance, and complications associated with multiple government
ministries being involved in hazardous waste management and oversight. In order to
effectively enforce the existing regulations, the infrastructure must be strengthened.
This is achieved by addressing needs in industry, government, and technical capacity.
Industry must be consistently monitored, permitting requirements must be met and
enforced and then spot checks must be employed to ensure compliance, best practices
must be taught and guidance provided for small-scale businesses for how to come into
compliance. Government monitoring procedures must be formalized into a training
curriculum for regulators at national, regency, and provincial levels.
