BAC RESOLUTION NO. 18-01-203A s. 2018

RESOLUTION RECOMMENDING THE MODE OF PROCUREMENT

FOR PURCHASE REQUEST NO. 18-01-783, DATED January 26, 2018

WHEREAS, Purchase Request No. 18-01-783, dated January 26, 2018 was approved for the Purchase of
300 pieces Vest with print for use during the Mayon Operations, with an approved budget for the contract
of ONE HUNDRED FIFTY THOUSAND PESOS (Php150,000.00);

WHEREAS, on January 16, 2018, the Province of Albay has issued Resolution No. 00670-2018 declaring the
Province of Albay under the State of Calamity due to on-going Mayon Volcano eruption;

WHEREAS, the Unit Head of the Public Health Preparedness & Response Unit (PHPRU) of this office wrote
a letter to the Head of Procuring Entity (HOPE) requesting for emergency purchase of said vest to be
distributed to health workers in response to Mayon eruption;

WHEREAS, the HOPE endorsed to the Bids and Awards Committee the said communication, requesting to
consider the same as urgent;

WHEREAS, Section 53 – NEGOTIATED PROCUREMENT, subsection (b) Emergency Cases of RA 9184

cannotes: “In case of imminent danger to life or property during a state of calamity, or when time is of
the essence arising from natural or man-made calamities or other causes where immediate action is
necessary to prevent damage to or loss of life or property or to restore vital public services, infrastructure
facilities and other public utilities”;

WHEREAS, subject provision justifies the conduct of NEGOTIATED PROCUREMENT/EMERGENCY CASES for
the purchase of 300 pieces Vest with print;

NOW, THEREFORE, the BAC RESOLVES, as it hereby RESOLVED to recommend to the Head of the Procuring
Entity that the procurement of the above-mentioned goods be procured under the “Negotiated
Procurement (Emergency Cases)”;
