Lee, 50000 Kuala Lumpur (hereinafter referred to as "the Union") of the other part. ARTICLE 2 - SCOPE OF AGREEMENT 1. This Agreement shall be binding on the employees of the Banks variously described in each Bank in the Column of the Job Title against each Bank and hereafter classified as Officer II or Internal Officer in the Column of Classification against each Job Title appearing in Appendix A’ of this Agreement. The Bank shall furnish every officer bound by this Agreement with one copy of this Agreement. If the Bank translates this Agreement to Bahasa Malaysia and if there is any conflict between the versions, the English version shall prevail ARTICLE 3 - EFFECTIVE DATE AND DURATION This Agreement shall be deemed to have come into effect on 01 January 2018 and shall continue to remain in force until 31 December 2020 and thereafter, until superseded by a new Agreement/Award pursuant to Article 4(4) hereunder. ARTICLE 4 - MODIFICATION AND TERMINATION a) (2) (4) During the period of this Agreement, neither the Association nor the Union shall seek to alter, modify, annul or add to any of its provisions in any way whatsoever, except by an award or agreement between the parties. ‘Should any new legislation supersede, vary, repeal or add to any of the provisions of this Agreement, then the relevant provisions of this Agreement shall be amended accordingly. However, if the benefits contained in this Agreement are more favourable, they will continue to apply, if so permitted by law. Any variation of this Agreement between the parties shall be jointly deposited by the parties with the Registrar of the Industrial Court within thirty (30) days from the date on which the agreement has been entered into, provided that the variation agreement shall not take effect until cognizance has been taken by the Industrial Court. Any such variation agreement of which the Industrial Court has taken cognizance shall be binding on the parties from such date and for such period as may be specified therein, but no such period shall commence earlier than the effective date of this Agreement. Either party may serve on the other six (6) months’ notice in writing, together with proposals to negotiate a new agreement, but no such notice shall be given before 01 July 2020. Negotiation shall commence not later than thirty (30) days from the date of receipt of such notice and proposals. This Agreement may be terminated by either party giving to the other written notice but no such notice may be served earlier than 01 July 2020. In the event that the Agreement is terminated in accordance with this Clause, the provisions of this ‘Agreement shall, so long as the Bank is in operation and the Union is there to represent the officers employed therein, continue to be in force until and unless superseded by anew collective agreement or by an Award of the Industrial Court. ARTICLE 5 - SETTLEMENT OF DISPUTES. a) (2) Implementation or Interpretation of Agreement A Standing Committee consisting of not more than four (4) representatives from member Banks of the Association and one representative from the Association, and five (5) members or four (4) members and one (1) representative from the Union shall be established. All questions and disputes connected with the implementation or interpretation of this Agreement shall be dealt with by the Standing Committee. If itis still not resolved, the dispute shall be referred to the industrial Court for a decision Grievance Procedure The procedure to be followed in processing any complaint or grievance concerning an individual officer shall be as follows: (a) (o) Complaint or Grievance at Office Level (Step 1) If an officer has a complaint or grievance, he may present it in the "Grievance Information Form" as set out in Appendix 'B’, within ten (10) working days from the date of occurrence to his immediate superior, failing which the grievance shall be rendered invalid. For this purpose, he may, if he so wishes, be accompanied by a member of the Office Committee in the Bank established under Article 9, PROVIDED THAT if the complaint or grievance is of a common nature involving more than one officer, then one “Grievance Information Form” setting out the details of such common complaint/grievance signed by the affected officers, may be presented to their immediate superior. Settlement of Dispute at Office Level (Step 2) If the complaint or grievance is not resolved within a period of ten (10) working days after it has been brought up, a dispute may be deemed to have arisen. The officer concerned shall submit the complaint or grievance to his immediate Manager within ten (10) working days after the dispute has arisen. On receipt of the written complaint, the Manager shall bring it up for discussion at a formal meeting between the Bank and Office Committee, with the presence of the officer concerned, with a view to reaching settlement, Settlement of Dispute at Head Office Level (Step 3) If no settlement is reached at Office Level within ten (10) working days after being presented to the Manager, the grievance shall be submitted in writing to the Administration/Human Resources/ Industrial Relations Manager who shall arrange a formal meeting between the Bank and the Union with a view to reaching settlement. Notwithstanding the Clauses (2) (a) and (b) of this Article, if the nature of complaint or grievance is such that it is best to be discussed at Head Office Level for expeditious resolution, then the manager at Office Level shall escalate the matter straight to the Head Office Level. (3) (a) (e) Settlement of Dispute at MCBA/ABOM Standing Committee Level (Step 4) If no settlement is reached at the Head Office Level within ten (10) working days after being presented to the Administration/Human Resources! Industrial Relations Manager, the grievance shall be presented in writing to the Malayan ‘Commercial Banks’ Association by either the Union or the Bank concerned. On receipt of the complaint, MCBA shall arrange a meeting of the Standing Committee to discuss the matter with a view to effecting a settlement. The Standing Committee shall consist of not more than four (4) representatives from member Banks of the Association and one (1) representative from the Association, and five (5) members or four (4) members and one (1) representative from the Union. The Association shall include a representative from the Bank concerned. However, by mutual consent, either one party or both parties may bypass the Standing Committee by referring the dispute to relevant departments of the Ministry of Human Resources. Settlement of Dispute at Government Level (Step 5) If the dispute remains unresolved within fourteen (14) working days after being presented to the MCBA/ABOM Standing Committee, either one party or both parties may jointly report the dispute to the Director General of Industrial Relations for conciliation Rights of Parties Pending Settlement of Dispute ‘An officer who is required to carry out an instruction by the Bank shall comply with such instruction. The officer who complies with any such instruction of the Bank, which is. the subject matter of the complaint or grievance, shall be deemed to do so under protest until the dispute is settled PARTII EMPLOYER-UNION RELATIONS ARTICLE 6 - RECOGNITION OF THE BANK The Union shall recognize the right of the Bank to operate and manage its business in all respects, subject to the provisions of any law for the time being in force and the provisions of this Agreement. ARTICLE 7 - RECOGNITION OF THE UNION ‘The Association and the Bank shall recognize the Union as the sole negotiating body in respect of Officer Il and Internal Officer (hereinafter referred to collectively as "Officers"), subject to the provisions of any law for the time being in force and the provisions of this ‘Agreement. ARTICLE 8 - LEAVE ON TRADE UNION BUSINESS: a) (2) (3) An officer intending to carry out his duties or to exercise his rights as an officer of a trade union shall apply in writing to the Bank for leave of absence stating the duration of and the purposes for which such leave is applied for and the Bank shall grant the application for leave if the duration of the leave applied for is for a period that is no longer than what is reasonably required for the purposes stated in the application: PROVIDED THAT an officer shall not be entitled to leave with pay for the duration of his absence if the purposes for which he is absent from work are not to represent the members of his trade union in relation to industrial matters concerning his employer. The Bank, as far as possible, will grant full pay leave for a period not exceeding six months to its officers for attending trade union courses, conferences, workshops, forums, symposiums, and seminars, provided the number of officers attending is not. more than one from each Bank Branch subject to a maximum of five (5) from each Bank for each course, conference, workshop, forum, symposium, and seminar. For the purpose of Clause (1), "officer of a trade union" means "officer" as defined under the Trade Unions Act, 1959, ARTICLE 9 - OFFICE COMMITTEE. (1) (2) 3) 4) (8) 6) Office Committees, hereinafter referred to as "Committee", comprising representatives of officers in each Branch of a Bank may be formed for the purpose of fostering and maintaining good relations between Management and officers. In cases where the Main Office and Head Office are housed in the same building, there may be one (1) Office Committee for both the Main Office and Head Office or two (2) Office Committees, one each for the Main Office and Head Office. Not more than five (5) officers at the Head Office level and not more than three (3) at Bank Branch level shall be in the Committee. Meetings between the Committee and the Management may be arranged at times which are mutually acceptable. The functions of the Committee shall be:- (2) To promote measures for securing and preserving amity and good relations between officers and Management. (v) To comment upon matters of common concer, including safety and health; and (c) To reconcile differences of opinion on matters under (a) and (b) above. ‘Two (2) members of the Office Committee at the Head Office and one (1) member of the Office Committee at the Bank Branch shall represent the officers in the respective Safety and Health Committees established under the Occupational Safety and Health Act, 1994. Notwithstanding Clauses (1) and (4), the Committee shall not make any claims outside the provisions of this Agreement nor shall the Committee perform the functions of the Union as a negotiating body. 10 ARTICLE 10 - NOTICE BOARDS ‘The Union may, with the prior approval of the Bank, use the Bank's notice boards that are installed on the premises for transmitting information to officers. " PART Ill TERMS AND CONDITIONS OF EMPLOYMENT ARTICLE 11 - PROBATION AND CONFIRMATION (1)(@) New Recruits (2) (4) (b) The normal period of probation for an officer newly appointed as an Officer Il or Internal Officer (hereinafter referred to as "the probationer’) shall not be less than six months but shall not exceed nine months. Upon satisfactory completion of the period of probation, the Bank shall, as soon thereafter, notify in writing to the probationer that he is being confirmed in the service. In the absence of such a notice, a probationer shall be deemed to be confirmed in the service on completion of nine months period of probation from date of first appointment to the rank unless otherwise notified. The probationary employment is subject to termination without assigning any reasons therefor by either side giving 24 hours' notice in writing to the other. However the Bank may, at its sole discretion, confirm the probationer at any time during the six months’ probationary period. Internal Promotion Subject to the existing practice in a Bank, the normal period of probation for a serving employee first appointed as an Internal Officer or Officer 1! shall not be less than three. months but shall not exceed four months. Upon satisfactory completion of the period of probation, the Bank shall, as soon thereafter, notify in writing to the probationer that he is being confirmed in his new rank. In the absence of such a notice, the probationer shall be deemed to be confirmed in his new rank on completion of four months period of probation from date of first appointment. ‘A probationer shall be paid a monthly basic salary and commence at a salary on the Internal Officer or Officer Il basic salary scale as may be applicable to him, depending on qualifications, experience, and appointment as may be determined at the sole discretion of the Bank. Upon confirmation of a probationer, his service with the Bank shall be deemed to have commenced from the date he first joined the Bank. Upon confirmation, an officer shall not be entitled to any immediate increase in salary and shall continue to draw his commencing salary until he qualifies to receive his first. increment which shall not be earlier than six (6) months but not later than twelve (12) months from date of first appointment to the salary scale in accordance with Article 17. 2 ARTICLE 12 - TRANSFER (1) (2) (4) Transfers of officers between departments within a Branch and transfers between Branches of the Bank within the same city or town may be made by the Bank at any time at its sole discretion. Where it is necessary to transfer an officer to another city or town, other than with the consent of the officer, such transfer will not be carried out without the Bank giving sympathetic consideration to cases where undue hardship will be caused: PROVIDED THAT where the Bank is satisfied that undue hardship will be caused, then the transfer of the officer concerned shall not be carried out without the officer being given a reasonable period of time to organize his affairs. The period of time allowed in such cases shall not exceed three months from the date of first notification of the transfer. Transfer Expenses (@) Officers who are transferred at the Bank's request, including officers who respond to the call of transfer, will be eligible for transfer benefits package (TBP) if the transfer is to a station which is more than 50 km from the officer's current station. (b) The transfer benefits package shall include the following: () The Bank will bear the cost of moving the officer’s personal effects including the spouse and children. Officers shall be given eighteen (18) months’ period to exercise his claims. (i) Accommodation in a Bank's appointed hotel for a specified number of days for the purpose of settling in (iii) Subsistence Allowance for the officer and spouse and children for a specified number of days during the settling in period (jv) A Monthly Housing Allowance of RM690-09 RM700.00 per month for officers who are married and RM500.09 RM600.00 per month for officers who are single, provided the officer has not been granted a staff housing loan to purchase a property at the new station. This Housing Allowance will cease when the officer is transferred back to his original station, (vy) Reasonable notice of transfer be given. (vi) Transport expenses to Officer and spouse to visit new location on one ‘occasion to look for a house. (vii) Unrecorded Leave of not more than 3 days to attend to matters related to transfer. (viii) One time transfer allowance to offset related transfer expenses. (©) Notwithstanding the Clause under Article 12(3), where Banks are already providing better benefits, such benefits shall continue to be given. The transfer of an officer or where consent is withheld shall not adversely affect the officer's promotion prospects. 13 ARTICLE 13 - PROMOTION a (2) (3)(a) (b) () Where a vacancy occurs in a next higher grade, the Bank may consider promotion from amongst serving officers. However, this shall not restrict the right of the Bank to recruit from outside at its sole discretion. The Bank shall inform officers by notification by way of office circular posted via electronic media or otherwise of any vacancy in the next higher grade. An internal Officer who is promoted to Officer Il shall receive a salary adjustment of not less than RM226 RM240.00. This shall exclude the normal increment for the year if it is due. An Officer Il who is promoted to a higher grade shall receive a salary adjustment of not less than RM286_RM306.00. This excludes the normal increment for the year, if due. This Clause takes effect only for promotions effected from date of signing of this Agreement. 14 ARTICLE 14 — DISCIPLINE a) (2) @) The Bank may take disciplinary action in the event of misconduct, indiscipline, or inefficiency, as follows: Serious Misconduct, Indiscipline, or Inefficiency Depending on the seriousness of the misconduct, indiscipline, or inefficiency, the Bank may either:- (2) give the officer a written warning; or (b) suspend the officer without pay for a period not exceeding 7 working days; or (©) defer increment for a period not exceeding six months; or (d) stop increment for which the officer is eligible not exceeding two years; or (©) downgrade the officer ; or. () terminate the services of the officer by giving one month's notice or pay in lieu; or (9) dismiss the officer summarily in the event of criminal breach of trust, or other serious offence. Inquiry (a) Before any disciplinary action is taken, the officer concerned shall have an opportunity to be heard orally or in writing. Where the officer desires to be heard orally, he may, if he so wishes, be accompanied by a member of the Office Committee who shall assist him at the inquiry. Inquiry Notes of a Domestic Inquiry shall be given to the officer concerned. However, if the officer refuses to sign the Inquiry Notes, then it need not be given. The Bank's decision shall be notified to the officer in writing (b) Where an inquiry is held other than in the base branch place of work of the officer, transport and other expenses as a consequence of the inquiry including witnesses, Union Representative and the officer concem shall be borne by the Bank. However, if such arrangement is at the request of the officer, then this provision shall not apply. When action is taken by the Bank against an officer under this Article, the officer cannot invoke the Grievance Procedure under Article 5(2). 15 ARTICLE 15 - TERMINATION OF EMPLOYMENT (1) (2) Other than in cases of termination arising out of or related to misconduct or in the case of probationers who are new recruits, in a normal case, either the Bank or confirmed officer may, at any time, give one (1) month’s notice to the other to terminate employment. Such notice shall be in writing and the length of such notice be the same for either side. However, either the Bank or the officer may, at any time, terminate employment without notice by paying the other an indemnity equivalent to the period of notice or, if notice has already been served, by paying an indemnity equivalent to the unexpired period of notice. 16 ARTICLE 16 — RATES OF PAY (1) With effect from 4 January 2018, all Officers I|-and Internal Officers, shall be paid in accordance with the salary scale as set out in Appendix C herein annexed. (2) Salary Conversion The mode of conversion for officers shall be on a point-to-point basis in accordance with the CONVERSION TABLE as set out in Appendix D herein annexed 7 ARTICLE 17 - ANNUAL INCREMENT (1) (2) (3) (4) A confirmed officer shall be entitled to receive an annual increment on the incremental date until he reaches the maximum of his salary scale unless his increment has been deferred or stopped. The incremental date of confirmed officers first appointed or promoted to the salary scale on or after 1st January but not later than 30th June shall be 1st January of each subsequent year. The incremental date of confirmed officers first appointed or promoted to the salary scale on or after 1st July but not later than 31st December shall be 1st July of each subsequent year. For the purpose of this Clause, "salary scale" means the basic salary scale of Officer Il or the basic salary scale of Internal Officer as the case may be. Thus, where an ‘employee was first appointed to the Bank as a General Clerical/Special Grade Clerical Scale on 1st January (incremental date 1st January) and subsequently promoted to Intemal Officer on 1st July, his new incremental date will be 1st July, and if he is subsequently promoted to Officer Il on 1st January, his new incremental date thereafter shall be 1st January. 18 ARTICLE 18 - PERFORMANCE BONUS. a (2) (3) Bonus will be determined at the discretion of the Bank taking into consideration the Performance of the Bank and the performance of the officer. The performance of an officer will be assessed using an open Performance Appraisal System. Where an officer is not satisfied with the job objectives, targets and or performance rating and bonus payout, he may invoke the Grievance Procedure under Article 5(2) of this Collective Agreement. An officer who has retired is eligible to be considered for prorated bonus provided he has served at least 6 months during the financial year in which bonus is declared. 19 ARTICLE 19 - ALLOWANCES. a) (3) (4) Work on Rest Days (Article 22) (a) An officer who is required to work on a Rest Day shall be paid RM90.00 RM100.00 for the first 37% hours of work and RM460.00 RM180.00 for any work. in excess of 3% hours but not exceeding 7 hours of work. (b) An officer who is required to work overtime on a Rest Day shall be paid in accordance with the Employment Act, 1955 calculated on the basis of the first hour or part thereof and thereafter on haif-hourly (14) basis. However, an officer whose monthly salary is more than RM2,000.00 shall have his overtime rates computed at RM2,000.00. PROVIDED THAT the requirement to work on Rest Day shall not apply to "Week-End officer. whose monthly salary is more than RM2,000.00 shall-have-his-overtime Fates computed at RM2,000.00. (2) An officer who is required to work on a Public Holiday shall be paid RM154.00 for the first 3% hours of work and RM200.00 for any work in excess of 3/2 hours but not exceeding 7 hours of work. (b) An officer who is required to work Outside the Normal Hours of Work on a Public Holiday shall be paid in accordance with the provisions of the Employment Act, 1955 calculated on the basis of the first hour or part thereof. However, an officer whose monthly salary is more than RM2,000.00 shail have his overtime rates computed at RM2,000.00. Overtime An officer whose monthly salary is RM2,000.00 or less and who is required to perform work in excess of his Normal Hours of Work shall be paid an Overtime Allowance in accordance with the provisions of the Employment Act, 1955. However, an officer whose monthly salary is more than RM2,000.00 shall have his overtime rates ‘computed at RM2,000.00. PROVIDED THAT the ceiling of RM2,000.00 in Clauses (1), (2), (3) above and Article 22A(2\(b) shall be revised if amendments are made to the Employment Act, 1955 to ‘expand the scope of this Act to officers whose monthly salary exceed RM2,000.00. Shift Work [Article 21(6)] (a) An officer or officers required to perform Shift Work shall be paid a Shift Allowance, as follows:- () — Two-shift cycle ~ RM240.00 per month (ii) Three-shift cycle == -_ RM260.00 per month. 20 6) (7) (b) Relieving officers are entitled to a payment of shift allowance on a pro-rated basis. The amount of payment is RM10.00 per day for 2-shift cycle and RM11.00 per day for 3-shift cycle. Overtime Meal Allowance (a) (b) An officer who is required to perform work for two (2) hours or more after the Normal Hours of Work shall be paid an Overtime Meal Allowance of RM15.00 RM18.00 per occasion. ‘An officer who is required to perform work in excess of six (6) hours on the additional rest day in the month shall be paid an Overtime Meal Allowance of RM45.00 RM18.00 per occasion. Call Back (a) (b) During leave, an officer may be called back for duty with his consent. The officer shall then be compensated as follows:- () Reimbursement of travelling expenses to and from location of leave at time of Call Back at Outstation Duty rates; (i) An allowance for food and lodging equivalent to Outstation Duty Allowance for the period he is on duty during leave; and (iii) Restoration of leave entitlement for the number of days he is on duty during leave, including travelling time. For the purpose of this Clause, an officer is deemed to be on outstation duty from the moment he consents to Call Back until the duty is completed. He may then either resume his leave or apply to treat the remainder of his leave as, being accumulated for future entitlement. Outstation Duty ‘An officer who is required to work in any Branch other than in the Branch or place where he normally works shall be entitled to an allowance, subject to the conditions specified hereunder- (a) (b) Duty Involving Travel Up To 15 Kilometres For duty in Semenanjung Malaysia involving travel up to a distance of within 15 Kilometres from normal place of work, an officer shall not be entitled to any payment other than the payment of transport, if applicable. Duty Involving Travel Beyond 15 Kilometres And Not Requiring Overnight Stay () For duty in Semenanjung Malaysia involving travel beyond 15 kilometres from normal place of work and not requiring overnight stay — RM22.00 per day. (ii) For the purpose of this paragraph, "Duty" means work that involves a duration of 4 hours or more, inclusive of travelling time from and to the normal place of work. 24 (co) (a) (e) @ (9) (h) Duty Involving Travel Beyond 15 Stay jlometres And Requiring Overnight For duty in Semenanjung Malaysia involving travel beyond 15 kilometres from normal place of work and requiring overnight stay - free hotel accommodation at a Bank-appointed hotel plus RM70-00 RM76.00 per day, excluding the day of return to normal place of work or a lump sum of RMH40.00 RM150.00 per day, excluding the day of return to normal place of work. Duty in Sabah and Sarawak For duty in Sabah and Sarawak, free hotel accommodation at a Bank- appointed hotel plus RM8S-09 RM91,00 per day, excluding the day of return to normal place of work or a lump sum of RM470.00 RM182.00 per day, excluding the day of return to normal place of work. Day of Return to Normal Place of Work ‘An officer who is returning to his normal place of work after an outstation duty under paragraphs (c) and (d) above shall, in addition to payment for transport, only be paid the following:- () if he returns to normal place of work before 6.00 p.m. - half the subsistence allowance described in (c) or (d) above as appropriate. The allowance payable will be RM35.00 RM38.00 or RM43.00 RM46.00 respectively. (i) if he returns to normal place of work after 6.00 p.m. - one full day subsistence allowance described in (c) or (d) above as appropriate. The allowance payable will be RM70.00 RM75.00 or RM85-00 RM91.00 respectively. Laundry Expenses Where an officer is entitled to hotel accommodation, laundry expenses will be paid by the Bank for two (2) nights and above at actual receipts. Transport The Bank shall provide transport to an officer who is required to travel in the course of his duty or reimburse him with the actual transport expenses incurred by the officer or, if the officer is required to use his own car, reimburse the officer at the rate of 9¢-sen RM1.00 per kilometre plus parking and toll charges. In each case where the officer is required to travel for the performance of his, duty, the Bank shall at its own discretion, determine the mode of transport to be used by the officer for the travel. ‘An officer who is required to perform relief work within the same Branch Office premises shall not be entitled to any payment under this Clause. 22 (8) (9) (10) (ty Inconvenience Allowance The Bank may require an officer to commence work at Odd Hours according to operational needs. An officer who is required to commence work at Odd Hours shall be eligible for Inconvenience Allowance as follows:~ (2) Anofficer who commences work at anytime between 10.00 pm to 1.00 am shall be paid RM35.00 per day. (b) — Anofficer who commences work at anytime between 1.00 am to 6.00 am shall be paid RM48.00 per day. (c) This will not apply to officers on Shift Work and NACCS. NACCS (KLACH/REACHISPICK) Allowance Officers who are required to perform work on account of the above System shall be paid an allowance as follows:- (2) Officers required to perform work at or before 6.00 a.m. - RM45.00 per day. (b) After 6.00 a.m. but before 7.30 a.m. - RM33.00 per day. FOR THE PURPOSE of this Article - (2) Ordinary Rate of Pay shall be calculated as follows:- Monthly Rate of Pay 26 (b) Hourly Rate of Pay shall be calculated as follows:- Monthly Rate of Pay x 12 39x 52 (©) Monthly Rate of Pay means "WAGES" as defined in Section 2 of the Employment Act, 1955. Where Banks are already providing better benefits, such benefits shall continue to be given. 23 ARTICLE 20 - ADVANCES a) (2) (3) Housing Loan Each officer, regardless whether he is married to another in the same Bank, is eligible toa housing loan as follows:- (a) Amount - a minimum of 96 months’ basic salary or RM350-000.00 RM400,000.00 whichever is lower for each officer, and (b) The above loan shall be granted subject to such other terms and conditions as the Bank may impose. Notwithstanding the above, Banks providing superior terms shall continue to do so. Vehicle Loan Officers are eligible to vehicle loans in accordance with existing terms in each Bank. ‘Sundry Loan Officers are eligible to sundry loans in accordance with existing terms in each Bank. 24 ARTICLE 21 - HOURS OF WORK a) (2) (3) (4) Normal Hours of Work The Normal Hours of Work for an officer shall be thirty-nine (39) hours a week. In these particular weeks, there shall be five (5) full working days, i.e., the first four (4) days of which shall consist of eight hours (8 hours) of work (excluding a break of one (1) hour for meal), one (1) day shall consist of seven (7) hours of work (excluding a break of one (1) hour for meal). The commencing and ending points of Normal Hours of Work of an officer or officers shall be as determined by the Bank from time to time according to operational needs. It is recognized that as and when necessary, according to operational needs of the Bank, an officer may be required to work in excess of the Normal Hours of Work prescribed in Clause (1) above. Such excess work is defined as "Work Outside Normal Hours of Work’. For the purpose of this Clause, "Work Outside Normal Hours of Work" means work performed at the prior request of the Bank, in excess of eight hours (8 hours), or seven (7) hours as the case may be on the five (5) full working days and shall be a continuous period commencing either before or after the Normal Hours of Work. The Normal Hours of Work, unless otherwise determined by the Bank and notified to an officer, shall be:- (a) _ In States where the Rest Day is a Sunday () Weekdays - Monday to Thursday From 8.45 a.m. to 5.45 p.m. with a lunch break of one (1) hour to be staggered between 12 noon to 2.00 p.m. (i) Weekday - Friday From 8.45 a.m. to 4.45 p.m. with a lunch break of one (1) hour to be staggered between 12 noon to 2.00 p.m. (b) In States where the Rest Day is a Friday () Weekdays - Sunday to Wednesday From 8.45 a.m. to 5.45 p.m. with a lunch break of one (1) hour to be staggered between 12 noon to 2.00 p.m. (i) Weekday - Thursday From 8.45 a.m. to 4.45 p.m. with a lunch break of one (1) hour to be staggered between 12 noon to 2.00 p.m. 25 (6) (6) (7) (8) Work Outside Normal Hours of Work on Weekdays ‘An officer who is required to work outside the Normal Hours of Work on a Weekday shall be paid overtime at one and a half (1 %) times his hourly rate of pay, calculated on the basis of the first hour or part thereof and thereafter on half-hourly (1/2) basis). However, an officer whose monthly salary is more than RM2,000.00 shall have his overtime rate computed at RM2,000.00 Shift work The Bank may, according to operational needs, introduce Shift Work as and when necessary, to be performed by an officer or officers. In order to ensure continuity of operations, all shift officers shall remain on duty until relieved by either the succeeding shift officer or until permitted to leave by the Officer-In-Charge. For the purpose of Clause (6) above, “Shift Work” means work which by reason of its nature requires to be carried on continuously or continually, as the case may be, by two or more shifts, and “Day” for the purpose for Shift Work means a continuous period of twenty-four hours beginning at any point of time. 5%-Day Week The Bank may in consultation with the Union introduce 5%Day Week for certain officers. However the average hours of work per week over any period of three weeks shall be 39 hours per week. 26 ARTICLE 22 - REST DAY Every officer shall be allowed in each week a Rest Day. Such a Rest Day (other than for those performing Shift Work), unless altered by prior notice, shall be Sunday or Friday of the week as applicable to each State. 27 ARTICLE 22A - ADDITIONAL REST DAYS ON SATURDAYS OF EACH MONTH (1) Every officer shall be allowed an additional rest day on every Saturdays of each month. (2) Payment for Work Done on the Additional Rest Days in the Month (a) An officer who is required to work on the additional rest days in the month shall be paid RM90.00 RM100.00 for the first 3% hours of work and RM160.00 RM180.00 for any work in excess of 3% hours but not exceeding 7 hours of work, (b) An officer who is required to work overtime on an additional rest day shall be paid in accordance with the Employment Act, 1955 calculated on the basis of the first hour or part thereof and thereafter on half-hourly ('4) basis. However, an officer whose monthly salary is more than RM2,000.00 shall have his overtime rates computed at RM2,000.00. PROVIDE THAT no officer shall be required to commence work later than 11.00 a.m. 28 ARTICLE 23- PUBLIC HOLIDAYS Every officer shall be entitled to a paid Holiday on all gazetted Federal and State Public Holidays applicable to the State or Federal Territory in which he is stationed. 29 ARTICLE 24 - ANNUAL LEAVE a) (2\(a) (2)(b) 3) (4) (5) (6) Entitlement of Annual Leave The Bank shall grant their officers paid Annual Leave calculated as follows:- Calendar Year (Continuous Service with the Bank) (a) 1*to 5” calendar year (inclusive) - 19 working days (b) 6th to 15th calendar year (inclusive) - 25 working days () 16th calendar year onwards - 30 working days, Notwithstanding Clause (1), the annual leave provided by Bank Islam Malaysia Berhad shall continue to be given Leave entitlement for any incomplete calendar year of service shall be calculated proportionately, provided that no new officer shall be eligible to any Annual Leave before completing his first 12 months of service with the Bank. For the purpose of calculation, any fraction of a day of Annual Leave which is less than ‘one-half (/4) of a day shall be disregarded and where the fraction of a day is one-half (4) or more, it shall be deemed to be one (1) day. Where an officer who is on paid Annual Leave becomes entitled to Sick Leave or Maternity Leave, the officer shall be granted the Sick Leave or Maternity Leave, as the case may be, and the Annual Leave shall be deemed to have not been taken in respect of the days for which Sick Leave or Maternity Leave is so granted. The Bank shall arrange or re-arrange each year a leave programme for their officers, in accordance with operational needs of the Bank. PROVIDED THAT seven (7) days of Annual Leave entitlement is excluded from the Leave Roster for the purposes of attending to contingencies which do not qualify for leave under Article 28. PROVIDED FURTHER THAT officers shall not be permitted to accumulate any Annual Leave except with the prior written approval of the Bank, provided that Annual Leave already accumulated up to the date of this Agreement shall not be forfeited. Banks may grant leave on a half-day basis. For the purpose of this Article, an officer who is on Leave Without Pay or Leave due to Prolonged Iliness [Article 26(5)] shall not be entitled to earn Annual Leave during the period of such Leave. 30 ARTICLE 25 — MATERNITY LEAVE (1) (2) (3) 4) 6) (6) a) Every female officer shall be entitled to paid Maternity Leave for a period of ninety (90) consecutive days in respect of each confinement. Maternity Leave shall not commence earlier than a period of thirty days immediately Preceding the confinement or later than the day immediately following her confinement:- PROVIDED THAT where a Bank's doctor or the registered medical practitioner certifies that the female officer as a result of her advanced state of pregnancy may not be able to perform her duties satisfactorily, the officer may be required to commence her Maternity Leave at any time during a period of fourteen days preceding the date of her confinement as determined in advance by the Bank's doctor or the registered medical practitioner. Where a female officer abstains from work to commence her Maternity Leave on a date earlier than the period of thirty days immediately preceding her confinement, such abstention shall not be treated as Maternity Leave but as Sick Leave under Article 26. Notwithstanding the provisions of Clause (1), a female officer shall not be entitled to any paid Matemity Leave if, at any time of her confinement, she has five or more surviving children. For the purpose of this Clause, "children" means all natural children imrespective of age. ‘A female officer shall, within a period of ninety (90) days immediately preceding her expected confinement, notify the Bank of it and the date from which she intends to commence her Maternity Leave. Child Care Subsidy (a) _ Every officer with children of seven (7) years and below shall be reimbursed child care subsidy of up to a maximum of RM840-00 RM960.00 per annum. (b) The reimbursement shall be paid monthly on a pro-rated basis. (©) Banks currently providing better terms than stipulated in this clause shall continue to provide the same. Delivery Charges Banks will reimburse a female officer an amount not exceeding RM800.00 RMS00.00 for normal delivery or RM#.000.00 RM1,200.00 for delivery involving caesarean operation per confinement in respect of two (2) confinements. Where Banks are currently paying delivery charges, such practice will continue. a4 ARTICLE 26 - SICK LEAVE (1) (2) (3) (4) (6) An officer shall be entitled to Sick Leave with full pay on the certificate of recommendation of the Bank's doctor or appropriate Government Hospital Authority and registered dental surgeon up to the period and condition indicated below:~ In respect of an officer who is in service from 1st January to 31st December of a year- (a) Not exceeding in the aggregate 30 days for that year, non-cumulative, if no hospitalization is necessary; or (b) 60 days for that year, non-cumulative, if hospitalisation is necessary, provided that ifthe officer is hospitalised for less than 30 days in that year, his entitlement to paid Sick Leave for the year shall not exceed the aggregate of 30 days plus the number of days on which he is hospitalised, ‘Where an officer is certified by the Bank's doctor or Government Hospital Authority to be ill enough to be hospitalised but is not hospitalised for any reason whatsoever, the officer shall be deemed to have been hospitalised for the purpose of this Article. The Bank may, at its own discretion, grant Sick Leave with or without pay in excess of the number of days provided in Clause (1) of this Article only in cases where the Bank's doctor or where, there is no appointed Bank's doctor, the Government Hospital Authority certifies in writing that the illness or injury sustained by the officer is serious enough to incapacitate him from the performance of his duties in the Bank For the purpose of this Article, an officer who is on Unpaid Leave or on Prolonged Illness Leave as provided in Clause (5) shall be deemed to have not been in service for the period the officer is on such leave. Prolonged Iliness (2) Anofficer who is certified by the Bank's doctor or an appropriate Government Hospital Authority to be mentally unsound, or suffering from illness requiring prolonged treatment, such as tuberculosis, cancer, leukemia, cerebral thrombosis or injury arising from an accident shall, upon confirmation of such illness or injury by the Bank's doctor, be granted up to a maximum of six months’ leave on full pay, a further six consecutive months’ leave on half-pay and a further twelve consecutive months’ leave without pay: PROVIDED THAT no paid leave will be granted unless the officer undergoes the course of treatment recommended by the Bank's doctor, or the appropriate Government Hospital Authority. (b) Upon full recovery within the two-year period, the officer may resume duty on production of a fit certificate from the appropriate medical authority. (c) In the event the officer who resumed duty under Clause (b) above suffers a relapse within six (6) months from the time the officer resumed duty, then the relapse shall not be treated as a new case, but as a continuation of the first case. Consequently, the leave that has already been consumed in the first instance by the officer shall be set off against his entitlement under Clause (a) and the officer shall only be granted the balance of the unutilised leave, if any, under the Clause. 32 (8) fan officers still certified as unfit after the two-year period of Prolonged Iliness Leave, the officer may be retired on medical grounds with full benefits. Disabi The Bank will, at its discretion, consider providing alternative employment to an officer who suffers physical disablement on such terms as may be agreed between the officer concerned and the Bank. It is to be clearly understood that such consideration will be given solely on compassionate grounds on the merits of each individual case. Registered Medical Practitioner means medical practitioner registered under the Malayan Medical Act, 1971 or the Dental Act, 1971 33 ARTICLE 27 - MEDICAL BENEFITS a) (2) (3) (4) ‘The Bank shall provide the following medical benefits and services to its officers:~ (2) Medical consultations, including treatment by the Bank's doctor or by a Specialist on the recommendation of the Bank's doctor, (b) Medicines prescribed by the Bank's doctor or by a Specialist who is recommended by the Bank's doctor; (c) All diagnostic tests recommended by the Bank's doctor or by a Specialist who is recommended by the Bank's doctor. Officers will also be eligible for immunisation from the Bank's doctor, (6) Medical examination, every two (2) years, at Bank-appointed hospitals for officers 40 years of age and above (e) Officers may undergo eye examination by any ophthalmologist, optometrist, or registered optician of their choice as and when problems develop. The cost of such eye examination shall be borne by the Bank (The Bank shall pay for the cost of dental treatment including filing, and scaling from any registered dental practitioner and spectacles/contact lenses from any registered optician subject to a maximum combined limit of RM600.00 RM600.00 per annum, non-cumulative. The Bank shall pay for the cost of extraction, In cases of emergency, officers are permitted to receive out-patient medical attention or treatment from any registered medical practitioner and the cost will be paid by the Bank. Any subsequent treatment should be had from the Bank's doctor. PROVIDED THAT if an officer is hospitalised for emergency treatment in a private hospital, the liability of the Bank shall be limited to equivalent First Class rates in a Government Hospital. In each claim under this paragraph, other than in cases where the officer is hospitalised, an officer is required to explain in writing the nature of the emergency for the Bank to be satisfied as to its liability. An officer who falls ill and obtains medical treatment when on a bank sponsored activity overseas is eligible to claim the actual medical expenses incurred Hospitalisation in a Bank-appointed private hospital or where the officer chooses to a First Class Ward in a Government Hospital, including the cost of any specialist treatment or operation provided such hospitalisation and/or treatment or operation is obtainable in Peninsular Malaysia and is recommended by the Bank's doctor. Admission to a Bank-appointed private hospital shall be to a second class ward. In the event where there is no second class ward to a 4-bedded ward or in the event a 4- bedded ward is not available in a 3-bedded ward or 2-bedded ward until a bed in a 4- bedded ward is available. (6) (6) Medical Benefits for Officer's Family (a) (b) Outpatient medical consultations and medicines prescribed by any registered general medical practitioner (including consultation and treatment by a Paediatrician for the children of officers) for the officer's legal spouse, children under the age of 18 years, disabled children above the age of 18 years who are not gainfully employed, and children up to 23 years if attending full time education in a local educational institution subject to a maximum of RM 2,098.69 RM2,300.00 (non-cumulative) per officer's family per calendar year inclusive. An officer may elect to off set a sum not exceeding RM1,000.00 RM1,100.00 per annum to purchase a Hospitalisation and Surgical Insurance for their spouse and children on a reimbursement basis. () Specialist treatment upon referral by a registered general medical practitioner. (i) Hospitalisation in any hospital. The above clause is subject to the following:- (i) Registered general practitioner excludes specialist doctors. In the event that the officer has more than one legal wife, such officer shall nominate one of them only for the purpose of this clause. The above provisions are subject to the following provisos:- (a) (b) (©) (d) (e) Medical facilities shall not include the cost of artificial devices, artificial dental appliances, pregnancy, prenatal or post-natal care, confinement or abortion or miscarriage. The Bank will not provide medical benefits in respect of injuries sustained as a result of participation in wrongful or dangerous activities on the part of an officer. if and when any form of national health service or other type of Govemment sponsored medical benefits is introduced, the question of medical benefits for officers will be re-examined jointly and to the extent that if any newly introduced medical benefits are adequate, the Bank will be absolved from the responsibilty of paying for them. Other than in the case of an emergency [provided for in Clause (2)], where an officer chooses to be treated by a private doctor instead of the Bank's doctor, the Bank will not be liable to pay the charges incurred. Where an officer repeatedly chooses to go to a private medical practitioner (other than a Bank's doctor or Government Hospital), Sick Leave will be granted but on “no-pay" basis and the Bank shall not be liable to pay the charges incurred. 36 @” (8) () Where an officer chooses to be admitted to a private hospital instead of a Government Hospital where the treatment is available, the Bank will only be liable to pay charges at the rate applicable to a First Class ward in a Government Hospital. Where equivalent Government Hospital rates cannot be determined, the Bank will be liable to pay only 60% of the charges billed. Notwithstanding Clauses (1) to (6) of this Article, the existing medical benefits provided by Bank Islam Malaysia Berhad for its officers and his family which are more favourable shall continue to be given. Where Banks are already providing better benefits such benefits shall continue to be given. 36 ARTICLE 28 - SPECIAL LEAVE a) (2) @) (4) (5) Compassionate (2) The Bank shall grant officers paid leave not exceeding a total of 10 working days (non-cumulative) in any one calendar year, under the following circumstances: () Birth of legal child/children per pregnancy - 5 working days; (i) Death of a member of officer's immediate family - 3 working-days; (ii) Serious illness of officer's immediate family - 2 working days; (iv) Disaster such as flood, fire, or robbery that affects the officer's person and or property - 2 working days. Immediate family is defined as officer's spouse, child, parents, brothers, sisters, or grandparents, parents-in-law and grandparents-in-law. (b) Inthe event that the days provided under this Clause is insufficient at any one time, an officer may be granted additional days from his Annual Leave entitlement under Article 24) (c) Banks already providing compassionate leave in excess or on better terms shall continue to provide the same. Marriage The Bank shall grant 10 working days’ Marriage Leave to an officer on the occasion of his or her first marriage. An officer who intends to utilise the Marriage Leave shall apply in writing stating the date on which he intends to commence such leave and furnish the Bank with such information and particulars, or documents as may be necessary or required by the Bank, to support the leave application. Examination The Bank shall grant paid leave up to a maximum of 7 days (non-cumulative) in any ‘one calendar year, to enable officers to sit for examinations relevant to the bankit industry Sports The Bank will, at its discretion, grant leave to enable officers to represent Malaysia or the State or Federal Territory in sports activities. Hajj Leave (a) An officer who has completed 10 years of continuous service shall be eligible to apply for 30 calendar days paid leave to perform the obligatory Hajj Pilgrimage once during his employment with the Bank. 37 () (c) Prior to the introduction of this Article, there may be Banks that have provided paid Haij Leave to their officers. If an officer has already utilized such Hajj Leave, he will not be eligible to apply again for paid Hajj Leave under this Article. However, ifthe paid Hajj Leave taken before was less than 30 calendar days, the officer may apply for Hajj Leave under this Article again provided the total duration, including his previous paid Hajj Leave does not exceed a total of, 30 calendar days. An officer who intends to utilize leave under this Article shall notify the Bank as soon as practicable of his intention and the date from which he intends to commence the leave. Responsibility for providing advance notification to the Bank lies with the officer. 38 ARTICLE 29 - INSURANCE (1) (2) (3) (4) The Bank shall insure every officer on a 24-hour basis to the amount of RM479,000.00 RM200,000.00 in the event of death or total permanent disablement arising from robbery or attempted robbery or accident and in the event of permanent partial disablement arising from the same circumstances. ‘The Bank shall also provide Group Term Life policy to every officer for an amount of RM60,000-00 RM80,000.00 in the event of death and total permanent disability. The terms and conditions are subject to the provisions of the insurance policy and requirements of the insurance company which may include officers undergoing medical examinations. ‘Where Banks are already providing better benefits such benefits shall continue to be given. Notwithstanding Clause (1) and (2) above, Bank Islam Malaysia Berhad shall continue to insure every officer under the Group Family Takaful Scheme. 39 ARTICLE 30 - RETIREMENT BENEFITS: (1) (2) (4) 6) 6) Age of Retirement The date of retirement of an officer shalll be the day on which he attains the age of 60 years. ‘An officer may opt to retire at any time after attaining the age of 50 years for male or 45 years for female. In the absence of a birth certificate, the date of birth shown in the Identity Card of the officer concerned shall be deemed to be the date of birth for the purpose of determining the retirement age. If the Identity Card fails to record the actual month or date of birth, the retirement age shall be assessed to be on 31st December of the year, provided that if the month is shown, the date of retirement shall be the last day of the month. Retirement Benefits The Bank shall contribute each month 16% of the officer's salary for that month to the Employees Provident Fund (EPF). Such contribution shall be deemed to be inclusive of any employer's contribution to the Employees Provident Fund as may be prescribed by law from time to time. For the purpose of Clause (4) above, salary means "wages" as defined by Section 2 of the Employees Provident Fund Act, 1991 Hospitalisation and Surgical Insurance ‘The Bank shall reimburse an officer upon his retirement a sum not exceeding RM 660.00 RM730.00 to purchase Hospitalisation and Surgical Medical Insurance for a period of 3 years. 40 ARTICLE 31 - RETRENCHMENT BENEFITS (1) (2) (@) (4) The Union shall be notified of the Bank's intention to retrench the officers’ service 3 months before the service of notice to the officers and discussion on the subject shall be held during the period without delay. In the event an officer's service is terminated, such officer shall be given two months’ written notice terminating his employment or two months’ salary in lieu thereof. Where the Bank terminates an officer's service on the grounds of redundancy, ie. the officer's service in the Bank is surplus to the Bank's requirements’, the Bank shall make a lump sum payment of retrenchment benefit, the quantum for which is one month's basic salary for each completed year of service or part thereof calculated at the current ordinary rate of pay In carrying out the retrenchment exercise, as far as practicable, the principle of "Last in, First out" shall be adopted. Due consideration may be given to officers who elect to be retrenched. a ARTICLE 32 - EXISTING BENEFITS a) The Bank shall not remove any existing benefits being currently received daily or monthly in cash or kind by their officers which are not covered under the present terms: of this Agreement except that:- (a) _ benefits given in kind for a specific reason, as and when such reason ceases to exist, shall stop being given. (b) allowances paid for the doing of a specific task, as and when such task ceases to be performed by the officer or classes of officers concerned, shall cease to be paid. PROVIDED THAT if it is a benefit given on a personal-to-holder basis, such benefit shall cease upon the holder leaving office. AND PROVIDED FURTHER THAT if it is a subject matter in respect of which there are already provisions in this Agreement, such benefit or payment shall cease upon the coming into force of this Agreement. 42 ARTICLE 33 - IMPLEMENTATION a) (2) (3) (4) Alll arrears of basic salary shall be effective from 1* January 2018 and shall be paid not later than 30 days from the date of signing the Collective Agreement. All other arrears of wages (wages as defined under the Employment Act, 1955) including child care subsidy shall be computed and paid out not later than 60 days from the date of signing the Collective Agreement. Officers who commenced employment on or after 01 January 2018 at a salary below the minimum of the new salary scale of Internal Officer or Officer Il, as the case may be, shall have their salary adjusted to the minimum of the new salary scales respectively with effect from the date of joining, The benefits of the Agreement in respect of (i) wages as defined under the Employment Act 1955 shall be paid and (ii) bonus to all officers who are in service on the date of signing of this Agreement, and to officers who have been promoted, or who have retired, or have been medically boarded out, or who have died whilst in service or who have resigned, on or after 01 January 2018. 43 ARTICLE 34 - TEMPORARY OFFICER The Bank may appoint temporary or part-time officers in abnormal circumstances, such as those arising from cases of abnormal increase in volume of work, sickness, maternity, leave of absence without pay or reorganization, on such terms and conditions as may be determined by the Bank. ARTICLE 35 - NATIONAL SERVICE Any period of National Service undergone by an officer while in the employment of the Bank shall be counted as continuous service with the Bank. 45 ARTICLE 36 - INTERPRETATION (1) Words used in this Agreement to indicate male officers shall also apply to female officers except as the text clearly indicates otherwise. (2) Words in the singular include the plural and words in the plural include the singular, unless the text indicated otherwise. ARTICLE 37 - RETIREMENT LEAVE (1) (2) Officers who have completed at least twenty-five (25) years of continuous service up to the time of retirement shall be eligible for 30 calendar days’ leave to be taken one month before the date of retirement. However, an officer of any religious faith who has qualified for such leave may be granted at the Bank's discretion to utilise the leave at a stretch at any time for a religious pilgrimage to be performed overseas. ‘An Officer who has taken the Hajj Leave under Article 28(5) will only be eligible for the Retirement Leave to be taken one month before the date of retirement. a7 ARTICLE 38 - UNPAID LEAVE An officer who is on approved Unpaid Leave or on Prolonged lliness Leave in accordance with Article 26(5) of this Collective Agreement shall be deemed to have not been in service for the period the officer is on such leave and consequently, the officer shall not be entitled to any benefits under the Collective Agreement, except for medical benefits in the case of prolonged illness, for the duration of the period of such leave. A successful implementation of this system calls for good faith on the part of member Banks of MCBA and the Union. The respective Banks will provide the Union with the relevant information regarding the appraisal system used by the Bank to appraise an officer. The Union will also be provided with information on the total bonus payout in respect of the grades of officers covered by the MCBAVABOM Collective Agreement. Such information shall not include the details of payout for individual officers. This aspect of information sharing will be reviewed when the 2021-2023 Collective Agreement is negotiated. As it will be an open Performance Appraisal System as provided in Article 18 of the MCBA/ABOM Collective Agreement, the final performance rating should be made known to the appraise before the bonus payout.
