INSTRUCTIONS

The following page contains a sample Qualified Written Request (“QWR”) under the federal Real Estate Settlement
Procedures Act (“RESPA”). After opening in Adobe Reader or Acrobat Professional (turn on Highlight Fields option), you
may fill in your clients information and print the letter out.

RESPA is a consumer protection statute. Section 6 of RESPA provides borrowers with certain rights regarding the servicing
of their mortgage and escrow account and the responsibilities of the servicer. Under federal law, servicers have to
acknowledge the letter within 20 working days and respond in 60.

This QWR can be used to obtain from the servicer the loan documents required to perform a forensic audit. Members of
Aequitas are granted permission to use this form QWR in connection with forensic audits performed using Aequitas’ file
review service.

REMEMBER: This letter SHOULD NOT be included with the borrowers Mortgage payment, but should be sent separately to
the servicer’s customer service address.

The borrower SHOULD continue to make the required mortgage and escrow payment until the request is resolved.

Borrowers may bring a private right of action under Section 6, if they suffer damages due to the lender’s servicing of the

This is a “qualified written request” under Section 6 of the Real Estate Settlement Procedures Act
(RESPA).

I am disputing the validity of the current debt you claim that I owe. To independently validate
this debt, I need to conduct a complete exam, audit, review and accounting of my mortgage loan.
In order to conduct this examination and audit, I need to have full and immediate disclosure all
pertinent information regarding my loan, including but not limited to copies of the documents
listed in Exhibit A, attached hereto.

The documents requested and answers to questions are needed by my authorized representatives
and the predatory lending experts retained to insure that my loan complies with all applicable
consumer protections laws.

I also request that you conduct your own investigation and audit of my account since its incep-
tion to “validate” the debt you claim I owe you is accurate to the penny. Please do not rely on
previous servicers or originators assurances or indemnity agreements and refuse to conduct a full
audit and investigation of my account.

Upon receipt of this letter, please refrain from reporting any negative credit information to any
credit reporting agencies until you respond to my “requests.”
