EXTRA-JUDICIAL SETTLEMENT OF ESTATE OF


SPOUSES JESSIE C. SY (DECEASED) AND CRESENCIANA B. SY
WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

We, CRESENCIANA B. SY, of legal age, Filipino citizen, widower, and a


resident of Brgy. Ballogo, Bacnotan, La Union, Philippines;

- And-

MARIA ROWENA SY CAÑEDA, of legal age, Filipino citizen, married to


MANUEL D. CAÑEDA, and a resident of Brgy. Ballogo, Bacnotan, La Union, Philippines;

- And-

MARIA JESSICA SY DELA CRUZ, of legal age, Filipino citizen, married to


MADANTE G. DELA CRUZ, and a resident of Brgy. Ballogo, Bacnotan, La Union,
Philippines;

- And-

JECRIS SY SURIBEN, of legal age, Filipino citizen, married to EDUARDO E.


SURIBEN, and a resident of Brgy. Sipulo, Bacnotan, La Union, Philippines;

WHEREAS, the above-named parties are the only compulsory and legal
forced heirs of the deceased JESSIE C. SY who died on July 24, 2012 in the BACNOTAN,
LA UNION. A copy of death certificate is hereto attached;

WHEREAS, the decedent died intestate, without leaving any Last Will or
Testament and without leaving any debts or accounts whatsoever;

WHEREAS, at the time of the decedent’s death, he and his surviving


spouse left certain real property registered under their names, more particularly
described as follows:

WHEREAS, no personal properties are involved in this extrajudicial


settlement;

WHEREAS, pursuant to Section 1, Rule 74 of the Revised Rules of Court of


the Philippines, the parties herein being all of age and full civil capacity, have agreed
to adjudicate unto themselves the above-mentioned real properties;

WHEREAS, We hereby declare by WAY OF ADJUDICATION all our rights,


interest, and participation in the above-described real properties free from liens and
encumbrances, in favor of;

A. PROPERTY I as mentioned above in favour of MARIA ROWENA SY


CAÑEDA and MARIA JESSICA SY DELA CRUZ whose personal
circumstances are likewise mentioned above in EQUAL SHARE;

B. PROPERTY II as mentioned above in favour of MARIA ROWENA SY


CAÑEDA whose personal circumstances are likewise mentioned
above; and

C. PROPERTY III as mentioned above in favour of JECRIS SY SURIBEN


whose personal circumstances are likewise mentioned above.

BY WAY OF WAIVER OF RIGHTS


WHEREAS, I, CRESENCIANA B. SY, the surviving spouse of the late Jessie C.
Sy, whose personal circumstances are mentioned above, do hereby WAIVE, CEDE,
RELINQUISH, TRANSFER and CONVEY all my rights, interest and participation in the
above-described real properties free from liens and encumbrances, in favor of the
above-mentioned compulsory heirs;

WHEREAS, the herein parties agreed to record this instrument in the office
of the Register of Deeds of the Province of La Union under the provision of Sec. 113 of
PD 1529, otherwise known as the Property Registration Decree of the Philippines;

That the above-described properties are not tenanted by any agricultural


lessee hence not subject to preemption under Sections 11 and 12 of R.A. 3844,
otherwise known as the Land Reform Code of the Philippines, nevertheless to Article
1623 of the Civil Code of the Philippines;

That the parties herein hereby affirm that they have executed this
instrument out of their own free will without force, intimidation or violence upon their
person, in connection with the adjudication of the above-mentioned real properties.
