WHEREAS, it is incumbent upon the Local Government of Bogo to look after the welfare of its
constituency;

WHEREAS, the Sangguniang Bayan of Bogo is mandated to regulate traffic on all streets,
avenues, alleys, sidewalks, and all other public roads;

WHEREAS, such regulations are embodied in existing ordinances which the Sangguniang Bayan
may herein codify;

WHEREAS, the existing traffic ordinances need to be revised and supplemented;

NOW THEREFORE, on motion of Committee on Transportation, Hon. Santiago A. Sevilla, duly


seconded by all Sangguniang Bayan Members present, be it

RESOLVED, as it is hereby resolved, to enact the following:

ORDINANCE NO. 001 - 2005


AN ORDINANCE ENACTING THE TRAFFIC CODE OF BOGO BY INTEGRATING ALL EXISTING AND
PERTINENT ORDINANCES AS FURTHER AMENDED HEREIN

Be it ordained by Sangguniang Bayan of Municipality of Bogo in Session assembled:

CHAPTER 1 DEFINITION OF TERMS


Section 1. Definition of Terms. For purposes of this Code the following terms shall
mean:

a. Tricycle - shall be understood to mean any 2-wheeled motorcycle with a cab


attached thereto operating as common carrier;

b. Owner/Operator - shall refer to the person who either directly owns a tricycle-for-
hire or who rents the same from another person, for the purpose of engaging in
the transport of passengers or cargoes;

c. Driver – shall refer to any person who drives a tricycle-for-hire and is duly
licensed as such by the Land Transportation Office;

d. Crash helmet – is referred to any headgear worn as protection against head


wounds usually worn y professional/amateur cyclists, motorists and mountain
bikes;

e. Motorcycle - Refers to any single motor vehicle with 50cc and above; it also
includes what is known as motorized scooter

f. Hauler/Transport – Any vehicle, truck, or trailer engaged in the transport of


sugarcane;

g. Overhang – Sugarcane tips hanging more than six (6) inches from the wall or
siding of any hauler;

h. Trisikad – A pedal-operated vehicle used either to transport cargoes or as a


common carrier with a maximum seating capacity of two passengers.

i. Poblacion – refers to the following perimeters:


 from Rizal Park up to Dakit junction
 Rizal Park up to Oil Mill at Taytayan
 Rizal Park up to Gairan Nailon Boundary
 Rizal Park up to Molave Street and Odlot Street at Pandan

j. Drag Racing – unlicensed speed competition between two or more vehicles of


any type within the territorial jurisdiction of the Municipality of Bogo.

CHAPTER 2 BOGO TRAFFIC MANAGEMENT OFFICE


Section 2. BTMO. Bogo Traffic Management Office is hereby created whose governing body
shall be composed of five (5) members composing of:

 Municipal Mayor, Chair


 BTMO Manager, Vice-Chair
 Chief Traffic Division of PNP Bogo
 Municipal Engineer
 Chair of Committee on Transportations of Sangguniang Bayan

Section 3. Functions of BTMO. The office shall have the following functions:

a. Coordinate, monitor and evaluate the planning and implementation of traffic


management components undertaken by the various departments of the
municipal government and the agencies;

b. Review and approve all traffic engineering and management schemes prior to
the Municipal Council’s exercise of its traffic administration functions;

c. Recommend the routing of common carriers operating in Bogo in so far as it


forms part of a comprehensive traffic management scheme;

d. Develop and prescribe rules and procedures for internal operation and
management;

e. Submit to the Mayor periodic and special reports relative to traffic management
activities and furnish the Sangguniang Bayan copies of the same;

f. Keep records of information regarding traffic as a consequence of the


enforcement of this ordinance.

g. Perform such others related functions as may be necessary to ensure the


effective planning and implementation of traffic management schemes;

Section 4. The Traffic Manager. There shall be a Traffic Manager to manage the Bogo
Traffic Management Office (BTMO) who shall be under the direct supervision and control of the Office of
the Mayor whose duties and responsibilities are to implement this Code, manage traffic concerns of the
municipality and those as may be determined by the Mayor;

Section 5. Traffic Enforcers. The Municipality shall hire traffic enforcers and other
personnel immediately responsible to the Traffic Manager whose primary duties and responsibilities are
to man the day-to-day traffic movement and operations and such other responsibilities as the Traffic
Manager may impose;
Section 6. Functions of the Enforcers. The enforcers shall have the following functions:

a. Enforce the provisions of the Traffic Code of the Municipality of Bogo and assist
the regular members of the PNP in the enforcement of all the national vehicle
laws applicable to the streets in the Municipality of Bogo;
b. Take the name, address, traffic violator driver’s license number and the
registration and plate numbers of the motor vehicle involved;
c. Issue to the traffic violator, a summon or citation informing him/her of the
charge(s) against him/her and requiring him/her to answer the same at the time
and place designated in the citation within seven (7) days after such violation;
d. To immobilize the vehicle driven or operated by the traffic violator, using
approved gadgets, and to release the same vehicle only upon the authority of the
proper officer of the BTMO;

e. Immediately take the person arrested for violation of any of the traffic laws before
a competent authority, when authorized or directed by law, and ;
f. Perform such other functions as may be directed by the Mayor or his duly
authorized representative, on matters pertaining to traffic management;

Section 7. Qualifications. Qualifications of a Traffic Enforcer shall be as follows:

a. Shall be twenty-one (21) years old or above;


b. Knows how to read and write;
c. Must have undergone the course on Traffic.

Section 8. Funding. The funding of the office shall initially be drawn from the budget of the
Office of the Mayor or from any source not otherwise appropriated for. Thereafter, subject to budget
regulations there shall be appropriated in the annual budget for the Personal Services, Operating
Expenses and Capital Outlay of the office. Provided that fifty percent (50%) of all fines and penalties in
money hereinafter collected by virtue of this ordinance shall accrue as Trust Fund which shall be used for
salaries/ wages/ honorariums/ allowances, incentives, uniforms and the like for the benefit of the traffic
enforcers upon recommendation by the Traffic Manager and approved by the Sangguniang Bayan. The
Traffic Manager shall render a monthly report on such moneys collected to the Mayor and the
Sangguniang Bayan.

CHAPTER 3 FLOW OF TRAFFIC AND PARKING


Section 9. Coverage. The provisions under this chapter cover all types of vehicles either
common carriers, cargo trucks or vans or private conveyances unless otherwise specified;

Section 10. No Parking Zone. Unless provided elsewhere in this code, the Mayor, through the
Traffic Manager, is authorized to designate any area as “No Parking Area” or “Parking Area” provided
that proper signage shall be placed thereon. Henceforth, any violation under such rules and regulations
shall be punishable by a fine as follows:

a. Tricycles-For-Hire - P 50
b. All other vehicles - P 150

Section 11. Parking Fee. Any type of vehicle shall pay a parking fee of Five Pesos (P5.00)
per parking at the designated parking areas.

Section 12. One-Way Traffic. The following are designated as one-way streets:

a. New Public Market entrance (Tindalo Street) and exit (V. Ortega Street);
b. V. Dela Viña Street – from V. Ortega exit to P. Rodriguez Street;
c. Captain Aballe through Pelaez Streets until corner Teodorico Rodriguez Avenue;
d. S. Verallo Street – from Cogon junction to corner Mansueto Street.

Section 13. Violations. Violators of the preceding section shall be penalized with a fine as
follows:
a. Tricycles - P 50.00
b. V-Hires - 50.00

c. Private Vehicles - 100.00


d. Jeepneys - 200.00
e. Buses and Cargo Trucks/Vans - 300.00

Section 14. Entrance Route. All common carriers except Tricycles-For-Hire coming from the
direction of Cebu City upon entering the Poblacion area shall turn right at Molave Street through
Teodorico Rodriguez Avenue until reaching the Public Market;

Section 15. Speed Limit. Within the Poblacion area all types of vehicles shall not exceed a
speed of thirty (30) kilometers per hour as provided under the National Traffic Code.

Section 16. Speed Competition. Any vehicle participating in a drag racing shall be impounded
and the violators shall be penalized with a fine of one thousand pesos (P 1,000.00) or imprisonment of
not more than thirty (30) days or both at the discretion of the court.

Section 17. Wharfage Fee. Upon entrance at the Bogo Wharf, wharfage fee shall be
collected per entrance which fees shall substitute the toll fees under Ordinance No. 16-1992:

a. Utility buses --------------------------------------- P20.00

Section 18. Traffic Signs. At strategic corners or spots, traffic signs of “NO ENTRY”, “ONE-
WAY”, “NO OVERTAKING”, “NO PARKING”, “LOADING AND UNLOADING ONLY” and the like as may
be appropriate shall be posted and notices on traffic rules shall be displayed in billboards or signages or
any device to inform the public of the traffic rules, regulations and ordinances;

Section 19. Removal of Traffic Signs. It is hereby prohibited to obliterate,


destroy, remove, and or deface any traffic sign and or notice as provided in the immediately preceding
section. Any violation shall be fined the amount equivalent to the damage but not less than Five Hundred
Pesos (P500.00);

Section 20. Posting of Traffic Enforcers. The BTMO Manager shall post or assign at least
one traffic enforcer at any strategic point or location to monitor, inform, guide, and apprehend violators of
traffic rules;

Section 21. Center Lines. Center lines shall be drawn at the center along the stretch of any
street or avenue to ensure the smooth flow of traffic as the Traffic Manager may determine;

Section 22. Paulin Street Route. All cargo trucks coming from San Remigio-Medellin side
going to the direction of Dakit shall turn right at Paulin Street and exit at P. Rodriguez Street. All
passenger vehicles shall do likewise unless they opt to enter Verallo Street;

Section 23. New Public Market Parking Fee. The BTMO Manager is empowered to designate
specific places for loading and unloading of passengers or cargoes as well as parking areas at the New
Public Market for any type of vehicles or conveyances provided that the same shall not contravene the
provisions of Ordinance No. 10-2004 and provided further that appropriate signs or notices are posted;
provided further that on such parking areas the following parking fee shall be collected:

a. Panel (cigarette) --------------------- P 20.00


b. Delivery softdrink --------------------- 20.00
c. Delivery truck --------------------- 20.00

Chapter 4 Tricycles-For-Hire

Section 24. Franchise. It shall be unlawful for any person to engage in the business
of transporting or ferrying passengers or cargoes, through the use of a tricycle-for-hire, within the

territorial jurisdiction of this municipality unless the vehicle is registered with the Land Transportation
Office, provided with a franchise by the Municipality of Bogo.

Section 25. Documents and Fees. No owner, operator or proprietor of tricycle-for-hire


shall start the business without first securing the following:

 Mayor’s Permit - P 50.00


 Annual Franchise Fee - P 300.00
 Road Worthiness Clearance
 Police Clearance
 Barangay Clearance
 and other clearances and fees as may be required and imposed by local
ordinances

a. Application of franchise, issuance and release of new franchise and renewal


thereof shall be on the month of January of every year. The last digit of the
registration number shall correspond to a particular week of January when
franchise renewal shall be processed and accommodated as per schedule, to
wit:

Last digit nos. 1,2,3 _________ 1st wk. of Jan. of every year
Last digit nos. 4,5,6 _________ 2nd wk. of Jan. of every year
Last digit nos. 7,8,9 _________ 3rd wk. of Jan. of every year
Last digit nos. 0 _________ 4th wk. of Jan. every year

b. Franchise shall be non-transferable, that is, by way of direct sale from one
franchise holder to another. Use of dummy, rental of franchise, or any manner or
form of transfer is hereby deemed illegal. Violation of this subsection shall cause
for the revocation of the franchise;

c. A grace period of thirty (30) days is given to franchisees at which time the
franchise may be renewed as provided in Section 8a (1). A surcharge/fine of fifty
percent (50%) of the annual franchise fee shall be imposed to franchisee where
renewal is applied for or processed with the said grace period, otherwise,
franchise shall be automatically cancelled after the thirty-day grace period.
Reservation is strictly disallowed;

Section 26. Route Coding. It shall be unlawful to operate a tricycle-for hire along the routes not
specified in the franchise granted by the Sangguniang Bayan designated and coded as follows:

COLOR CODE ROUTE OR LINE OF OPERATION

(GREEN) Binabag, San Antonio, La Paz, Malingin, Anonang Norte,


Anonang Sur, Banban, Guadalupe

(RED) Cayang, Don Pedro, Polambato

(BLUE) Odlot, Marangog, Libertad

(YELLOW) Nailon, Siocon

(WHITE) Poblacion boundaries

Section 27. Color Identification. Tricycles-for-hire plying the designated route as provided
in the immediately preceding section shall respectively be identified with the designated color. All
tricycles-for-hire shall be given until December 30, 2005 to paint their units with the color corresponding to
the routes provided. Thereafter, any unit without the corresponding color shall not be allowed to operate;

Section 28. Route Transfer. Any tricycle-for-hire who opts to change routes maybe allowed
provided Sections 24 and 25 hereof are complied with and upon approval by the Mayor considering the
need for additional tricycle-for-hire at the route applied for.

Section 29. Route Code Violation. Any tricycle or unit operating outside the designated
route shall be fined the following amount:

a. Five Hundred Pesos (P 500.00) for the first offense;


b. Eight Hundred Pesos (P 800.00) for the second offense;

c. One Thousand Pesos (P 1,000.00) for the third offense, and revocation of the
franchise;

Section 30. Franchise Limitation. Until otherwise fixed or revised by an ordinance the
number of tricycles-for-hire authorized to operate within the Municipality of Bogo shall be limited to one
thousand five hundred (1,500) units;

Section 31. Road Worthiness.There shall be required from all tricycle operators a clearance
from the Traffic Division of the Bogo PNP station certifying the tricycle’s road worthiness before the same
be issued a franchise to operate as a common carrier within the territorial jurisdiction of the Municipality of
Bogo;

Section 32. Duty to Inspect. It shall be the primary responsibility and duty of the Traffic
Division of the Bogo PNP Station to conduct the inspection of the tricycles and certify its road worthiness
prior to the filing of the application for franchise to operate as a common carrier. Said certification which
shall include, among other things, the engine/motor numbers and chassis of the tricycle which shall be
attached to the application for franchise to operate a tricycle;

Section 33. Inspection Fee. There shall be collected from the tricycle operators
an inspection fee in the amount of TWENTY PESOS (P20.00) per unit where fifty percent (50%) of said
amount shall inure to the General fund of the Municipal Government and the remaining fifty percent
(50%) as Trust fund to be used exclusively for livelihood projects or other purposes beneficial to the traffic
enforcers;

Section 34. Defective Units. Operators whose tricycle are found operating
without the required road worthiness certificate shall be fined the amount of ONE THOUSAND PESOS (P
1,000.00). Further, operators of tricycles whose vehicles are found with defective safety accessories after
being granted franchise to operate shall be fined the amount of ONE HUNDRED PESOS (P 100.00) per
deficiency;

Section 35. Number of Passengers. Passengers for every tricycle-for-hire shall be limited to
five (5) which already includes the backrider and children five (5) years of age and above. Any violation
hereof is punishable by a fine of Fifty Pesos (P50.00) per passenger;

Section 36. Seminar. It shall be prohibited for any person to drive a tricycle within
the territorial jurisdiction of Bogo unless he/she has undergone a seminar on traffic rules and regulations
conducted or sponsored by the Traffic Division of the Local PNP, Land Transportation Office (LTO) or
non-governmental organization (NGO) in coordination with the Traffic Division of the Local PNP. To
effectively implement the provision and achieve the objectives of this Ordinance, the Traffic Division of the
Local PNP unit is hereby directed to conduct, after the adoption of this Ordinance, regular seminar on
traffic rules and regulations on its own or in coordination with other government agencies and non-
governmental organizations (NGO). Reasonable fees may be collected from participants to cover the cost
of the certificate of attendance and other incidental expenses in holding the seminar, provided however,
that at the end of each seminar a written report shall be submitted to the Sangguniang Bayan which
report shall be included among others, the sponsoring agency, names of participants and cost thereof;

Section 37. Validity of Certificate. The Traffic Division of the Local PNP unit or the
sponsoring agency or institution shall at the end of the seminar issue a Certificate of Certificate of
Attendance to all persons who have satisfactory completed the seminar on traffic rules and regulations.
Each certificate shall be considered prima facie proof of attendance of a seminar and valid for only two (2)
years;

Section 38. Driver’s Identification Card. Every applicant for a tricycle Driver’s
Identification Card shall be accompanied by the original copy of a valid Certificate of

Attendance, otherwise the same shall not be processed and acted upon provided further that the ID card
shall always be displayed inside the unit and made visible to the passengers.

CHAPTER 5 PEDAL-OPERATED-TRICYCLE (TRISIKAD)

Section 39. Classification of Pedal-Operated-Tricycles. Pedal-operated-tricycles locally


called trisikads shall be classified as for HIRE, COMMERCIAL USE and OWNER-DRIVEN.;

Section 40. Registration. No person shall operate a pedal-operated tricycle unless the same is
secured with a permit by registering the same with the Office of the Municipal Treasurer of Bogo, Cebu
with a fee of fifty pesos (P 50).

Section 41. Plate Number. All registered trisikads shall be issued the corresponding plate
numbers at their expense.

Section 42. Registration Period. Registration of pedal-operated tricycles shall be done


annually every January and February provided that newly acquired pedal-operated tricycles shall be
registered 30 days after acquisition, otherwise a surcharge of 30% shall be imposed.

Section 43. No Passenger. All pedal-operated tricycles for commercial or personal use and/or
owner-driven shall not be allowed to engage in carrying passengers for fee.

Section 44. Display of Plate Number. The registration plate number of a pedal-operated
tricycle shall be prominently displayed at the rear portion of the tricycle clearly visible at a distance of 30
meters and the driver or operator shall always carry with him a photocopy of registration paper.

Section 45. Limitation as to Time and Area of Operation. Operation of trisikads shall
observe the following limitations:

a. No trisikad shall operate between 6:00 in the evening to 6:00 in the morning the
following day;
b. No trisikad shall ply and operate in any other area and streets in the Poblacion
proper except at New Public Market. Provided further that Teodorico Rodriguez
Extension (Apitong Street) and Tindalo Street shall be trisikad free;

Section 46. Warning Devices. No person shall operate a pedal-operated tricycle unless the
tricycle is equipped with either a bell, horn, siren or other device capable of giving signal for a distance of
50 meters and reflectors in lieu of tail lights;

Section 47. Violations. Any violation hereof shall penalize the violator with a fine of one
hundred pesos (P100.00) per violation and impounding of the unit.

CHAPTER 6 SUGAR HAULING

Section 48. Statutory Provisions. All vehicles hauling sugarcane should observe the
following:

a. All haulers/transport should have railings, sidings or any reinforcement to protect


and prevent sugarcane from falling;

b. Overhang is not allowed and pile should not be more than twelve (12) feet high
from the ground;

c. In cases where the load has fallen off the truck it shall be the responsibility of the
driver to clear the road immediately otherwise the municipality shall undertake to
remove the fallen load at the expense of the driver and truck operator.

Section 49. Penalties. Any violations of the provisions hereof shall have the following penalties:

1st Offense - Issuance of Citation Receipt


2nd Offense - Issuance of Citation Receipt and a Fine of P300.00
3rd Offense- Issuance of Citation Receipt and a Fine of P500.00
4th Offense- Issuance of Citation Receipt and a Fine of P700.00
5th Offense- Issuance of Citation Receipt and a Fine of P1,000.00 and/or
imprisonment of 1-3 days

Section 50. Liable Individual. Violations hereof are a liability of the driver concerned thus,
penalties shall be imposed upon his person;

CHAPTER 7 CRASH HELMET

Section 51. Coverage. All drivers including riders of motorcycles, motorized scooter and
mountain bikes cruising and plying along any avenue, street, road or right of way within the territorial
jurisdiction of the Municipality of Bogo shall wear a crash helmet;

Section 52. Exemption. Tricycles used as common carriers are not covered by this Chapter;

Section 53. Penal Clause. Any driver and/or rider who violates the provisions under this
Chapter shall be punished by an imprisonment of not more than one (1) month or a fine of fifty pesos (P
50.00) at the discretion of the competent Court;

CHAPTER 8 CLOSURE AND OPENING OF ROADS

Section 54. Temporary Closure. The Municipal Mayor may temporarily close any local street,
road, thoroughfare, or any other public place where shopping stalls, Sunday flea or night markets may be
established where goods, merchandise, foodstuffs, commodities, or articles of commerce may be sold
and dispensed to the general public. Furthermore, barangays bereft of open spaces in which to hold their
fiesta specifically Barangays Lourdes and Carbon may be granted permit by the Mayor provided that:

a. The said temporary closure shall be effective on Vesper and Fall only;
b. The road will only be closed from 6:00 PM – 6:00 AM.

Section 55. Wakes. No municipal street, road, thoroughfare, any other public space or any part
thereof may be used for wake or vigil without prior permit issued by the Mayor provided that such permit
shall have the following conditions:

a. The wake shall be between six o’clock in the evening until six o’clock in the
morning of the following day;

b. The permit shall expire upon interment of the deceased;

c. The permit shall not extend beyond the center line of the street occupied from the
residence concerned;

d. The permit shall not exceed thirty (30) square meters of the road or street
occupied;

Section 56. Funeral March. A funeral march may be allowed only after a Permit from the Office
of the Mayor is secured without any fee provided that:

a. It shall only occupy half of the road or street and shall not go beyond the
centerline.
b. The specific route shall require approval by the BTMO Office.

CHAPTER 9 COMMON PROVISIONS

Section 57. Exclusivity. Passenger vehicles and other common carriers excluding
tricycles shall not be allowed to operate and establish their own loading and unloading stations within the
Municipality boundary other than at the bus terminal pursuant to Ordinance No. 010-2004;

Section 58. Road Repairs. Common carriers and private vehicles shall not be allowed to
undertake any repair along Municipal, Provincial, and National roads.

Section 59. Garage. No Municipal, Provincial, and National roads in the poblacion area shall be
utilized as a garage or storage for knocked down units. For purposes of this section the owner shall have
24 hours within which to remove the unit unless, by necessity, the BTMO, through the Traffic Manager,
provides a shorter period.

Section 60. Towing. At the cost of the owner, any violation of the immediately
preceding section shall cause the towing of the vehicle and the payment of a fine of One Hundred Pesos
(P100.00) impounding fee per day and the unit shall constitute a lien on all the charges against this
section.

Section 61. Traffic Changes. Notwithstanding the provisions under Chapter 3 hereof, the
Municipal Mayor may from time to time make alterations and changes of the flow of the traffic as be may
deemed appropriate without the need of prior approval from the Sangguniang Bayan;

Section 62. Random Check. Traffic enforcers and policemen may flag down or stop any
vehicle under the following circumstances:

a. When there is reasonable ground to suspect that the driver is without a license;
b. When there is reasonable ground to suspect that the driver is under the influence
of intoxicating liquor or dangerous drugs;
c. When there is reasonable ground to suspect that the driver or passenger is a
fugitive of the law;
d. When there is reasonable ground to suspect that the unit is involved in the
commission of crime or in hot pursuit.

Section 63. Adoption of National Traffic Law.For purposes of this ordinance, National Traffic
rules and regulations are hereby adopted and the penalties provided therein shall be imposed without
prejudice to the provisions of this ordinance if the same is applicable;

Section 64. Penal Clause. Unless otherwise penalized elsewhere in this code any violation of
the provisions hereof shall cause the perpetrator to suffer the penalty of fine of not less than Two
Thousand Five Hundred Pesos (P2,500.00) or an imprisonment of not more than six (6) months at the
discretion of the Courts.

Section 65. Repealing Clause. This code repeals, modifies, amends any existing
ordinance inconsistent herewith otherwise the same shall remain in full force and effect.

Section 66. Effectivity. The Code takes effect immediately upon approval hereof.
