13 I, CHERYL ANN MERRILL, the declarant herein, do swear under and in accordance to

14 the laws of the State of California, that the hereto attached and below is true and correct, to the

15 best of my knowledge, with my signature as follows:

16 1) That I am the declarant CHERYL MERIL a/k/a CHERYL ANN MERRILL, and

17 2) That I was the Plaintiff in a civil action Case No. 37-2009-000920490-CU-DF-CTL in

18 the Central County jurisdiction of Superior Court San Diego, California filed on June 19, 2009,

19 and as a Defendant to a Restraining Order filed nearly five months later in the East County of

20 San Diego, Case No. 37-2009-00070295-CU-DF-CTL, and

21 3) That I sent a letter of intent to file a judicial complaint with the presiding judge, the

22 Hon. Judge Kevin A. Enright, which he responded to on May 13, 2010 prior to my filing this

23 complaint (Exhibit A), and

24 4) That I had filed a Motion to Contest Instant Court’s Jurisdiction to move the

25 restraining order case overseen by Judge Longstreth to the Central division in order to

26 consolidate the cases under one judge, that of Judge Charles R. Hayes. My motion request was

 1 later issued a continuance causing me to have to request another continuance from Judge

2 Longstreth at a January 13, 2010 restraining order hearing (Exhibit B), and
3 5) That Judge Longstreth demonstrated strong gender bias having acted as an attorney on

4 behalf of Edmond Wollmann, overlooking his Court summoned me 500 miles to testify in a

5 restraining order hearing over outdated blog articles, while complaining on behalf of

6 Mr. Wollmann he had to travel 17 miles to get to the Central division court hearings from El

7 Cajon, (Exhibit C-4(a))

8 6) Judge Longstreth issued multiple TRO’s against me at continuance hearings in spite

9 of the fact my motion responses strongly disputed Mr. Wollmann’s fraudulent testimony in ex

10 parte and supporting documentation of outdated blog articles. (Exhibit D) Judge Longstreth
11 abused his discretion and violated my First Amendment Rights to formerly post on my blog

12 information about Mr. Wollmann’s criminal history of public nuisance and trespassing and

13 Internet abuses, notification of my stun gun ownership, and information about the death of the

14 Internet and implementation of Internet 2.0.

15 7) Mr. Wollmann did not file any motion to transfer the Central division case to the East

16 County. Mr. Wollmann did not follow proper procedure yet Judge Longstreth acted on his

17 behalf to try and get me to agree to move the case to his Court. (Exhibit C-4(a) and C-7(a))
18 8) When I did not agree to Judge Longstreth’s requests to remove my case to his Court,

19 the Judge threatened me with “future consequences” and requested I withdraw my restraining

20 order injunction and lawsuit all together. (Exhibit C-8(a) - (C-9(a))

21 9) Edmond Wollmann submitted Judge Longstreth’s hearing transcripts to Judge Charles

22 Hayes in a motion that unduly influenced Judge Hayes against me and my case. Judge Hayes

23 was a political supporter of Judge Longstreth in his campaign to retain his appointment by the

24 Governor. Shortly thereafter, Judge Hayes at the central division issued harsh sanctions of

25 $2,400 for my discovery request that was challenged with a Motion to Quash. Judge Hayes also

26 rejected my preliminary injunction motion for a restraining order and the Court lied I didn’t file a

 1 proper proof of service. I knew the Court was lying because I used a registered process server for

2 all my services to Mr. Wollmann who I paid extra money to file directly with the court.

3 10) Later, a secret off calendar hearing was allowed by Judge Hayes a month after the

4 lawsuit was dismissed, awarding Edmond Wollmann’s legal fees due to Judge Lonstreth’s

5 statements. Mr. Wollmann was largely in pro per throughout the process. I had only requested

6 dismissal due to Judge Longstreth’s political intervention and bullying leaving me with no

7 choice. Judge Longstreth literally slaughtered me and caused me to incur a tremendous financial

8 loss with his statements and undue political influences over my lawsuit.

9 11) The day after Mr. Wollmann was awarded legal fees, he sent a typical harassing

10 email by anonymous proxy. Mr. Wollmann’s childish contacts, including demands for money,

11 have continued as recently as June 26, 2010. (Exhibit E)

12 12) Judge Longstreth was later transferred to the Family Court, but his precedent

13 statements influenced the newly assigned Judge Maureen Hallahan, also one of his political

14 supporters listed on his website along with Judge Hayes (Exhibit F), to issue a permanent
15 restraining order against me based on politics. I traveled 500 miles to testify and was not

16 permitted to respond to Mr. Wollmann’s false accusation testimony. My statements contesting

17 forum non-conviens were largely used as my primary testimony at the hearing.

18 13) I ultimately withdrew my request for a reconsidering hearing of the restraining order

19 hearing due to the great expense associated with traveling to San Diego for a day. I maintain

20 there was no evidence of harassment or anything that warranted a restraining order being issued

21 against me other than fabrications and distortions of blog articles that were six months old.
