thereon made by this Hon'ble Court. it was altso stated that.such
permission would be for the limited purpose
of carrying out the
transaction referred to in the retter dated 21.01 .2otg of the
committee and would not be a genenal permission to the
ARCs to

02' 2076 of the Hon'ble Supreme Court of lndia in Subrata thottacharyo V, Securities
and Exchonge Eoard of lndia and other connected matte,'s under the chiirmanship of
Justice (Retd)
fl.M, todha for selling the properties of F,ACL Ltd, and qsing the sale
proceeds to refund the investors who have invested their money in pAtL (the
Ltd.
"Comrnittee"). PACL Ltd. is a company which was running an unreglstered Collective,
Investment Scherne ("ClS") in violation of the SEBI Act and the CIS Regulations made
thereunder.
2. The Hon'ble Supreme Court by way of .its order dated January Og, 20Lg in the said
matter has granted four (4) weeks'time, from the date of the order,tothe Committee
to come up wlth alternate modes for effecting the sale ol'properties of pACL Ltd, In
the said order, the Hon'ble Court has noted that the Committee could erxplore the use
of an Asset Reconstruction Company i"ARC') for effecting the sa{e ol'properties of
PACI Ltd' A copy of the said order of the Hon'ble Suoreme ilourt i.s herewith encloserj
as Annexure- l.
3, Considering this, consultation was held with the top four (a) ARCs on January IT, z11;g
by the members of the Committee to explore the viability of the engagement of ARCs
for the sale of properties on behalf of the Committee. lt emerged from the discussion
with the ARCs that they were apprehensive about their ability to carry out the work
as contemplated by the Committee given their present mandate as set out by their
regulator, the Rbl, However, they did consider that the Section tO (2) of the SARFAES|
Act could be used for engagement of ARCs for carryingout the work of thc Committee
provided the RBI grants the necessary approval as conternplated under the said
section.
