Lease -Deed

This Lease Deed made at Gurgaon on this …….. day of ………………., 2015.

BETWEEN

Mr. ……………………. S/o …………………………….. R/o ……………………………………………………………………………


(hereinafter called the ‘LESSOR’ which expression shall unless excluded by or repugnant to the
context include his/her/their heirs, executors, administrators, representative and assigns) of
the One Part.

AND

Mr. ……………………. S/o …………………………….. R/o ……………………………………………………………………………


(hereinafter called the ‘LESSEE’ which expression shall unless repugnant to the context or
measuring thereof include his/her/their successors and assigns of the other part.

WITNESSETH AS FOLLOWS:

Whereas the Lessor is the owner and in possession of property apartment bearing Flat No-……,
Tower-…., DLF New Town Height, Sector-90 Gurgaon, measuring …….. Sq. Ft. consisting of
Three bedrooms with Three bathrooms, Drawing/Living/ Dining room, kitchen, balconies, one
servant quarter with attached toilet cum bathroom and one car parking (hereinafter referred to
as Premises) along with all other amenities provided by the builder in the said premises,
including, Electricity meter with connections and usage of all common areas in the said
complex etc. called the demise premises. Whereas, the Lessee has approached the Lessor and
is desirous of taking on the premises on rent for the purpose of residence, for a period of eleven
months and the Lessor has agreed to lease out the same premises on rent @ Rs……………/-
(Rupees …………… ……………………… Only), including of maintenance Charges but excluding
the electricity used in Flat by lessee, for the same period.

In consideration of the rent hereinafter reserved and all the covenants and conditions
hereinafter contained to, observed and performed on the part of the LESSEE, the LESSOR does
hereby grant, transfer demise by way of lease the premises, apartment number-…. Tower No.-
….., the said apartment having also been provided with good quality wood work in bed rooms,
wardrobes, in kitchen wood work, electrical fittings, lights & fixtures in working condition,
which the LESSOR is entitled in Law to execute this Deed together with the appurtenant
land/space, the rights to make use of entrances, passages, stair case landings and other
easements, belonging and pertaining to the said premises unto and to the use of the LESSE, a
period of 11 months commencing from 1st August, 2015, renewable by mutual consent only,
by paying unto the LESSOR during the said period, a rent of Rs……………/-(Rupees ……………
……………………… Only) per month, including of maintenance Charges but excluding the
electricity used in Flat by lessee for the same period, subject to the following conditions:-

(I) THE LESEE CONVENANTS WITH THE LESSOR AS FOLLOWS:

(i) That the LESSEE shall pay to the LESSOR the said monthly rent by
draft/cheque/cash in advance, on or before 10th day of each English calendar
month.
(ii) That the Lessee has paid an interest free refundable security deposit of
Rs……………/-(Rupees …………… ……………………… Only)That the Lessor
permits the Lessee to have and hold the said premises hereby Demised
(hereinafter called demised premises) up to the duration of the lease deed for a
term of eleven months only w.e.f 1st August 2015 to 30th June 2016, on this date
of expiry, the possession of the Demised premises would be delivered back to the
Lessor.
(iii) That subject to the LESSOR covenants the LESSEE shall keep the interior of the
demises in good order and condition.
(iv) That the LESSEE shall use the demised premises for Residential purposes only
and shall pay for consumption of electricity direct to the concerned authorities as
per bills received by them.
(v) That the LESSEE shall not sub-let, assign or otherwise part with possession of the
demised premises in any case to any other persons.
(vi) The Lessee shall be responsible/ liable for any illegal/ irregularity committed with
respect to the violation of the Local Bye Laws included in regards to the Demised
premises.
(vii) That the Lessee shall not carry out any structural additions and alterations to the
premises, layout, fittings and fixtures without the consent of the Lessor in writing.
(viii) That the Lessee shall comply with all rule and regulations of the local authority,
whatsoever with regard to the Demised premises.
(ix) That the Lessee has inspected the said premises, its fittings including the electric
fittings, all fixtures in various rooms, doors, windows, balconies, kitchen,
bathrooms, fans, exhaust fans, tube lights and other light fittings and found them
to be in good working order, the Lessee shall be responsible to restore them in the
same condition at the time of surrender of the possession
(x) The Lessee shall be liable to carry out all the day to day repairs such as fuses,
leakage of taps, replacement of bulbs, tube lights, lighting fittings, shades, fans
with regulators and bearing, with elements, thermostats and connecting pipes,
cisterns, showers, sinks etc and other such repairs required at his own cost.

(xi) That the LESSOR or LESSEE shall be entitled to terminate the lease at any time
during the initial or renewed term(s) of the lease upon serving one month’s
previous notice in writing of this intention to do so.
(xii) That the LESSEE shall deliver the demised premises in good and tenable
condition, to the LESSOR on the expiration or earlier determination of the lease
together with the LESSOR’S fitting and fixtures, in such conditions herein
contained. The LESSEE shall be responsible for any breakage and damage done to
the electrical, sanitary & other fittings & fixtures in the premises during the
tenancy period.
(xiii) If maintenance charge as described above revised before expiry of this lease
agreement will be borne by Lessor only.

(II) THE LESSOR HEREBY CONVENANTS WITH THE LESSEE AS FOLLOW:-


(i) That the LESSOR shall pay all taxes, rates, license fees, ground rent and
chargers of whatsoever character assessed, levied, charged and imposed by any
lawful authority in respect of the demised premises.
(ii) That the LESSEE shall peacefully and quietly hold and enjoy the demised
premises during the lease period(s) without any interruption or disturbance by
the LESSOR or any person rightfully claiming under or in trust for him.
(iii) That the LESSOR represents and warrants that he is fully entitled to execute
this Lease Deed and that he will hold the LESSEE free and harmless of any
demands, claims actions or proceedings by others in respect of quiet possession
of the demised premises.

(III) IT IS HEREBY MUTUALLY AGREED AS FOLLOWS:-

(i) That the LESSEE shall permit the LESSOR and his representative(s) etc. to enter
upon the leased premises for inspection, wherever necessary to inspect the
premises to view condition of that or carry out repairs etc at reasonable time as
and when necessary.
(ii) That the lease terms can be renewed, if mutually agreed to between the LESSOR
and LESSEE on the fresh terms and conditions then mutually agreed to between
them for which the LESSEE shall give the LESSOR a notice not less than one
month before the expiration of the term hereby granted.
(iii) That if the LESSEE shall apply the telephone connection, gas connection,
LESSOR has no objection.
(iv) That the period of the lease is fixed for the period of eleven months only with
effect from 1st August 2015 to 30th June 2016, and on the expiry of the lease,
no notice period to quit is necessary and lease shall stand duly terminated by
efflux of time, and the Lessee shall be obliged to hand over the vacant and
peaceful possession of the Demised premises to the Lessor upon completion of
the lease period and the Lessee shall not object, resist or put any hindrance in
delivering the vacant and peaceful possession of the premises.
(v) The renewal of the lease is at the option and sole discretion of the Lessor,
subject to the expiry of the said lease, if both the parties so desire, the lease may
be further extended on such terms & conditions that may be mutually settled.
Whenever the Lessee is desirous to renewing the lease period, the Lessee shall
give the notice in writing to the Lessor, one month before the expiry of the lease.
However, it will be the option and sole discretion of the Lessor to grant further
renewal or not. If further lease is not granted by the Lessor, the Lessee shall be
obliged to vacate the Demised premises upon completion of the leased period.

(vi) That if the lease is to be renewed as per mutually agreed terms, the rent will be
increased by 10% after 11 months.
(vii) That notwithstanding anything herein before contained, it is expressly agreed by
and between the two parties, hereto that in the event of default of any condition
herein before referred to, Lessor shall be entitled to and shall always have the
power to terminate the lease there under granted at his absolute discretion and/
or keep the said premises without subject himself of any liability on that
account and in such an event, the Lessee shall surrender the premises and
deliver the possession of the same to the Lessor.
(viii) That the LESSOR will hand over ONE complete set of all original keys to the
LESSEE at the time of signing this agreement/ handing over / giving possession
of the demised premises for tenancy. Likewise the LESEE shall hand back the
complete sets of all original keys to the LESSOR at the time of vacating and
handing over the premises
